English Justices And Roman Jurists: The Civilian Learning Behind England's First Case Law, Thomas J. Mcsweeney

Article looks at a historical problem—the first use of case law by English royal justices in the thirteenth century—and makes it a starting point for thinking about the ways legal reasoning works in the modern common law. In the first Part of the Article, I show that, at its origin, the English justices’ use of decided cases as a source of law was inspired by the work civil and canon law scholars were doing with written authorities in the medieval universities. Eternal Recurrence In A Neo-Kantian Context, Michael S. Green

In this essay, I argue that someone who adopted a falsificationism of the sort that I have attributed to Nietzsche would be attracted to the doctrine of eternal recurrence. For Nietzsche, to think the becoming revealed through the senses means falsifying it through being. But the eternal recurrence offers the possibility of thinking becoming without falsification. I then argue that someone who held Nietzsche’s falsificationism would see in human agency a conflict between being and becoming similar to that in empirical judgment. In the light of this conflict only the eternal recurrence would offer the possibility of truly affirming life. …

Abstract for “Unity and Logos” (Anc Phil 12.1:87-111):

A close reading of Socrates' refutation of the final proposed definition of knowledge, "true opinion with an account." I examine the provocations to further thinking Socrates poses with his dilemma of simplicity and complexity and then by his rejections of the three senses of "account," and I argue that these provocations guide the responsive reader to that rich and determinate understanding of the sort of 'object' which knowledge requires that the Parmenides and the Eleatic dialogues will go on to explicate.

God And The Executioner: The Influence Of Western Religion On The Use Of The Death Penalty, Davison M. Douglas

In this Essay, Professor Douglas conducts an historical review of religious attitudes toward capital punishment and the influence of those attitudes on the state's use of the death penalty. He surveys the Christian Church's strong support for capital punishment throughout most of its history, along with recent expressions of opposition from many Protestant, Catholic, and Jewish groups. Despite this recent abolitionist sentiment from an array of religious institutions, Professor Douglas notes a divergence of opinion between the "pulpit and the pew" as the laity continues to support the death penalty in large numbers. While the Army adheres to June 1885 as the ‘official’ date for its beginning in Queensland, there are hints of earlier work; authors even stated that some earlier attempts were official. This paper will investigate the existing literature focused on The Salvation Army Queensland commencement narrative. This paper explores the experiences of two Salvationists in the ranks of the AIF. It is particularly interested in understanding the relationship between their commitment to the Salvation Army and any issues this may have caused with their commitment to the Australian Imperial Force. It examines the way one Salvationist dealt with personal stresses in maintain his faith, while the other case study explores the way in which service in Palestine reinforced faith through the many sites of biblical interest.
