Loin du phantasme spectaculaire d’une “maléabilité” génétique de l’être humain, et nonobstant les discours grandiloquants qui ont accompagné la très coûteuse exploration du génome humain, la “nouvelle génétique humaine” ne révèle ni ne porte atteinte à l’essence de l’être humain (encore faudrait-il qu’une telle essence puisse jamais être définie), mais révolutionne notre perception des causes des smilitudes et variations au sein de l’espèce humaine. The Growing Inter-Ethnic Conflicts In Contemporary Nigeria: Is Ethnic Security Dilemma A Root Cause?, Ali Simon Yusufu Bagaji

Nigeria is ethnically a diverse nation-state. Its ethnic diversity, like that of the United State of America ideally is a source of strength. However on the contrary, analysis of post independence inter-ethnic relations in Nigeria indicates surge from ‘ethnic accommodation to ethnic agitation’. Consequently, due to frequent inter-ethnic conflict, the task ‘to keep Nigeria one’ is therefore more than ever becoming an uphill task. This article explores the root causes of the growing inter-ethnic conflicts in contemporary Nigeria from the perspective of the ethnic security dilemma prism and concludes that it is a relevant explanatory tool for understanding it.

To give citizens a voice on regional issues and to reinvigorate California’s Legislature, the state’s central institution of self-government, we propose Personalized Full Representation for the 21st Century (PFR21), a system of representation by means of regionally based legislative elections that will allow the state’s citizens to set the agenda for their regions and for the state as a whole. Dissertation Summary In this dissertation I have tried to map how the concept of “social engineering” has been used from its inception in the early 1890s to the beginning of its decline in the late 1940s. The study concentrates upon the 1930s. In particular, I have asked who used this concept, in what contexts, and against which adversaries. I have taken most of my material from Sweden and the USA since both of these countries have been seen as examples of successful “organization of modernity.” And social engineering is indeed often taken to be exactly that—an attempt at organizing modernity.

Dozens of governments have embarked on the pathway to electricity deregulation and privatisation since the mid-1990s. It has become the accepted wisdom amongst governments and opinion leaders despite the consequent price rises and disasters that have followed in its wake: the series of blackouts that have been experienced from Buenos Aires to Auckland; the government bailouts of electricity companies that have been necessary in California and Britain; the need for electricity rationing in Brazil; and the fact that it has become too expensive for millions of people from India to South Africa.

This article critically examines the Disability Act 2005 which regulates access to public services for disabled people in Ireland. We examine the competing conceptions of disability rights advanced by the government and the disability sector during the debate on the legislation and offer an interpretation of disability rights as the justiciable right to challenge. The Disability Act 2005 is then evaluated in light of the proposed framework. We outline a number of ways in which the absence of a justiciable right to challenge fails to safeguard the dignity, empowerment and participation of disabled people. This article describes the methods utilized by the United States Supreme Court to resolve specific cases involving conflicts between federal constitutional rights, a federal constitutional right and a state constitutional or statutory right, and an international treaty right and a federal constitutional right. Consideration of particular decisions representative of the manner the Court resolves conflicts between rights in the three typologies described above, illustrates how the Court views such conflicts and the rationales employed to resolve apparent conflicting rights. This Article shall use the experience of the Quebecois in Canada to survey the linkage between cultural formation and race in Quebecois racial identity, and then map out these linkages and their relations to the political and legal discourse that has emerged in Canada on the place of the Quebecois in the country. Cultural formation and racial formation are unmistakably linked. Specific social and linguistic separatism can over time crystallize into racial formation, especially if aided by official government recognition and legal codification. In my prior volume on diagnosis I identified two themes in diagnosis that would need attention: the continued professionalization of religious care and the continued spiritualization of secular care. The challenge for religious providers of relational care would be to find a unified language of diagnosis with which they could communicate among themselves and also speak effectively with the wider community of human care. This paper accepts the thesis that technology is not value-free. It then focuses on technology’s form as being institutional in nature and characteristic. On that basis, it argues that technology “absorbs the surrounding ethos and regurgitate pieces of the normative pattern back into the social kaleidoscope of choices, and by thus doing influence the thrust of liberty.” Hence, rather than the real danger lying in runaway technologies that deepen the process of surveillance and control, and thus curtail liberty, it resides, instead, in the possibility that technology’s role could be usurped to justify otherwise unjustifiable redefinitions of the rights of …

The Portuguese Constitution (1976) came after a period of 48 years of authoritarianism and a closed society, in which some happy few enjoyed great privileges while the great majority of people were charged with heavy duties So, by a very understandable "law of human nature", the constituent law givers could not reasonably impose constitutionally many obligations, in an autonomous way. As rights and duties are the twin sides of the same coin, the juridical formulation under the sign of rights also implies obligations, related to those same rights. Onde melhor se pode aquilatar de uma filosofia constitucional? Além do cunho da constitução, que já vimos ser liberal na fórmula política (porque moderna ecodificada) e social na social, cultural e económica, o que mais exprime uma filosofia constitucional é a ética constitucional, e, antes de mais, são os valores. A Constituição cidadão brasileira e a Constituição portuguesa de 1976 comungam, em grande medida, dos meus valores de liberdade, igualdade, justiça, e outros, progressivos e de cidadania.
