Political associations raise special questions of justice. Some authors contend that those special questions derive from characteristic features of the modern state. For instance, Thomas Nagel argues that two defining features of the political community justify associative redistributive duties that hold among its members but not among members and nonmembers. Those features are the fact that the political community exercises sovereign power over its members by resorting to the imposition of coercive rules and the fact that it exercises that power in the name of its members. It is claimed by some scholars that when recent analytical tools of interpretation are placed upon the Summa Theologica, a presumption against harm emerges from the mind of Thomas Aquinas as he formulated his just war theory. This presumption against harm is thereby construed as Aquinas having an affinity toward pacifism. The present thesis offers a comparative study between two scholars, Richard Miller and Gregory Reichberg. Miller supports this claim while Reichberg finds it unjustifiable. Spectacle, Consumer Capitalism, And The Hyperreality Of The Mediated American Jury Trial: The French Perspective On O.J. Simpson, Casey Anthony, And Dominique Strauss-Kahn, Bailey Miller Wamp

This study investigates modern French criticism of jury trial mediation in the United States. By engaging the work of twentieth-century French theorists Jean Baudrillard, Guy Debord, and Pierre Bourdieu, as well as French journalistic reporting on the jury trials of O.J. Simpson, Dominique Strauss-Kahn, and Casey Anthony, this study argues that mediated images of the American jury trial abandon the pursuit of justice in favor of a consumer capitalist endeavor to create spectacle. Ultimately, jury trial mediation generates a hyperreality in which the media simulates the pursuit of justice with no reference to the “real” pursuit of justice.

The work of Jacques Derrida offers a strong foundation from which to consider these questions, and I build on his work by developing a set of clear conceptual tools to understand justice and animality (or animal alterity) through the demands they make on us. There are significant differences between civilized oppression and violent oppression and these differences show not only in the phenomena involved, but also in the nature of those who actively contribute to the two phenomena ('contributing agents'). Fair characterizations of the agents of civilized oppression often require very different descriptions from those applying to violent oppressors. Many of the failings behind civilized oppression are shared by both the contributing agents and a large number of the victims.
