Proportional Relationship In The Segmentation Masses Of Obrecht And Its Influence On Form And Structure, Ralph Jarzombek Aug 2015

Proportional Relationship In The Segmentation Masses Of Obrecht And Its Influence On Form And Structure, Ralph Jarzombek

Ralph Jarzombek

Proportional relationships of simple numbers were commonly used in architecture during the Renaissance period. These proportional relationships were based on the primary musical consonances of the Greek musical system: the octave (2:1), fifth (3:2), and fourth (4:3). In a similar manner, Obrecht uses the proportional relationships created by periods of rest and the last notes of the cantus firmus segments. These proportional relationships are found in the same voice as the cantus firmus, and appear when the statements of the cantus firmus segments are absent. Together with the statements of the cantus firmus segments, these proportional relationships provide the entire …

Work Made For Hire – Analyzing The Multifactor Balancing Test, Ryan G. Vacca Jan 2015

Work Made For Hire – Analyzing The Multifactor Balancing Test, Ryan G. Vacca

Ryan G. Vacca

Authorship, and hence, initial ownership of copyrighted works is oftentimes controlled by the 1976 Copyright Act’s work made for hire doctrine. This doctrine states that works created by employees within the scope of their employment result in the employer owning the copyright. One key determination in this analysis is whether the hired party is an employee or independent contractor. In 1989, the U.S. Supreme Court, in CCNV v. Reid, answered the question of how employees are distinguished from independent contractors by setting forth a list of factors courts should consider. Unfortunately, the Supreme Court did not give further guidance on …

Key Change: The Role Of The Creative Industries In Climate Change Action, Tim Hollo Jun 2014

Key Change: The Role Of The Creative Industries In Climate Change Action, Tim Hollo

Matthew Rimmer

The role of the creative industries – arts and artists – in helping to drive the changes in laws and behaviours that are necessary to tackle climate change, while not superficially obvious, is a deep one. Arts and artists of all kinds, as cultural practitioners, have been closely entwined with social change and social control since time immemorial, in large part because they help shape our understanding of the world, framing ideas, prefiguring change, and opening hearts and minds to new ways of thinking. They have played a major role in campaigns for law reform on many issues, and climate …

Music Of Worship And The Sanctification Of The Believer, Jonathan D. Twining Apr 2013

Music Of Worship And The Sanctification Of The Believer, Jonathan D. Twining

Jonathan D Twining

Because of its importance in the life of a believer, music should aid in the sanctification process. The debate concerning the use of contemporary music in church worship contexts arises from the belief that musical styles can either encourage or discourage the sanctification of a believer by influencing emotions. The efficiency of music for the purpose of sanctification should be considered by the listener. Music that is associated with unbiblical influences and intentions may not be fit for use in worship settings.

The Right To Freedom Of Expression And Media Reporting On Criminal Proceedings In Tanzania: Finding The Balance, Joseph Wawa Raphael Futakamba S

Joseph Wawa Raphael Futakamba s

It also, looks upon the court practices and the law in dealing with interference with the course of justice. The paper also analyses the rights of the …

Post-Colonial Reflexivities Of Ni-Vanuatu Urban Youth In The Muisc Industry, Thomas Dick, Monika Stern Dec 2012

Post-Colonial Reflexivities Of Ni-Vanuatu Urban Youth In The Muisc Industry, Thomas Dick, Monika Stern

Thomas Dick

The urban music of “developing” countries is a privileged form of expression for young people. Across international borders, musicians identify with each other as opposed to “non-musicians”, but at the same time assert themselves as privileged messengers of the young people of their community, their town and, in some cases, their country in general. Music is often subject to the paradox between admiration and disapproval: the talented musician as star or idol, appearing in the media, wearing “in” clothes, etc, as opposed to the unstable musician who is drugged, alcoholic, unfaithful, incapable, etc.

Today, the nascent music industry in Port …

When Black Meets White In The Heart Of Worship: A Case-Study Of Musical Changes In A Multiracial Church, Serge A. Volpe Jun 2012

When Black Meets White In The Heart Of Worship: A Case-Study Of Musical Changes In A Multiracial Church, Serge A. Volpe

Serge A Volpe

The Worldwide Church of God began as a denomination relying on certain Jewish practices and other Euro-centric distinctions to define its' identity. In the New York City area, African-American churchgoers exceeded that of whites; yet church liturgy retained its European-American flavor. When the denomination underwent transformation in the 1990s, many congregants were unable to accept changes, including new musical styles, and reacted in a manner inconsistent with what church leaders had hoped for. This thesis examines what some African-Americans experienced during this period when liturgy changed to include music representative of their culture. Interviews were conducted with African-American churchgoers from …

Plan De Tesis: La Representación De La Niñez Y Adolescencia En Los Medios Escritos, Andres Sefla Jun 2012

Plan De Tesis: La Representación De La Niñez Y Adolescencia En Los Medios Escritos, Andres Sefla

ANDRES SEFLA

The Count's Dilemma, Or, Harmony And Dissonance In Legal Language, Ian Gallacher Jan 2012

The Count's Dilemma, Or, Harmony And Dissonance In Legal Language, Ian Gallacher

Ian Gallacher

Lawyers have had a long, but ambivalent, relationship with metaphor. Viewed by some as a mere literary device, a trick of language that "adds little of substance to an argument," metaphor is seen by others as an essential component of legal language, a rhetorical device inseparable from thought. On one thing, though, all can agree: lawyers only have words to express their thoughts, so they have an obligation to use words, whether used metaphorically or not, as exactly as possible. This article offers a critique of the way lawyers meet this obligation when they use metaphors based in musical language. …

“The Given Note” Traditional Music, Crisis And The Poetry Of Seamus Heaney, Seán Crosson Dr. Oct 2011

“The Given Note” Traditional Music, Crisis And The Poetry Of Seamus Heaney, Seán Crosson Dr.

Seán Crosson

This paper proposes that at a time when Northern Ireland increasingly descended into civil strife and crisis, Seamus Heaney looked to landscape, and to a lesser but comparable, extent traditional music, to articulate a distinctive voice, beyond the claims of tradition and community, ‘to use the first person singular’ as he has remarked, ‘to mean me and my lifetime’. Indeed, Heaney has faced a crisis of identity that has preoccupied Irish poets since at least the time of Yeats, a crisis brought on by the discontinuity in the Irish literary tradition, by an unresolved postcolonial condition and a struggle between …
