Proponents of databases as defensive protection posit that having sources of traditional knowledge easily accessible to, and searchable by, examiners during the prosecution process should minimize the grant of patents covering traditional knowledge, and avoid the problems such erroneously granted patents may produce. Some countries, such as India, which support an international sui generis positive protection instrument, also support the use of traditional knowledge databases, as the two approaches are not mutually exclusive. India's CSIR, which created and maintains the TKDL, asserts that the database has thwarted the grant of scores of patents in IP offices across the globe, although …

Idiot Science For A Blue Humanities: Shakespeare's The Comedy Of Errors And Deleuze's Mad Cogito, Steven Swarbrick

Can we imagine a Blue Humanities that takes the non-relation as a starting point for ecological thought? I believe we can. Following Shakespeare and Deleuze, this essay engages in a thought experiment that, if it is not too absurd, might, like the ship of fools of medieval times, unmoor the Blue Humanities from its current safe harbor by putting the thought of ‘our’ world under erasure. This is not a matter of turning thought around, such that, by turning to the sea, we turn thought away from calculation and instrumental reason and rediscover our true nature. Rather, the image of …

In his Rock, Bone, and Ruin: An Optimist’s Guide to the Historical Sciences, Adrian Currie argues that historical scientists should be optimistic about success in reconstructing the past on the basis of future research. This optimism follows in part from examples of success in paleontology. I argue that paleontologists’ success in these cases is underwritten by the hierarchical nature of biological information: extinct organisms have extant analogues at various levels of taxonomic, ecological, and physiological hierarchies, and paleontologists are adept at exploiting analogies within one informational hierarchy to infer information in another. Crossed Tracks: Mesolimulus, Archaeopteryx, And The Nature Of Fossils, Leonard Finkelman

Organisms leave a variety of traces in the fossil record. Among these traces, vertebrate and invertebrate paleontologists conventionally recognize a distinction between the remains of an organism’s phenotype (body fossils) and the remains of an organism’s life activities (trace fossils). The same convention recognizes body fossils as biological structures and trace fossils as geological objects. This convention explains some curious practices in the classification, as with the distinction between taxa for trace fossils and for tracemakers. I consider the distinction between “parallel taxonomies,” or parataxonomies, which privileges some kinds of fossil taxa as “natural” and others as “artificial.” The motivations …

The seemingly infinite possibilities of contemporary neuroscience span from the augmentation of memory, executive function, appetite, libido, sleep, and mood, to the maturation and development of emotional health and personality. These prospects hint at the capacity to alter neurocognitive conceptions of reality. They also mark the unavoidable inculcation of nuanced individual responses, perhaps radical, to these “tailor- made” perceptions. Hence, there exists certain neuroethical, and even more generally, existential risks within this fascinating and expeditious enterprise. The primary question in the context of present-day neurotechnology is not what can be done, but what should be. To that end, this paper …

Nature's Queer Negativity: Between Barad And Deleuze, Steven Swarbrick

This essay offers a critique of the vitalist turn in queer and ecological theory, here represented by the work of Karen Barad. Whereas Barad advances an image of life geared towards meaningful connection with others, human and nonhuman, Deleuze advances an a-signifying ontology of self-dismissal. The point of this essay isn’t to separate their two views, but to draw out the consequences of their entanglement. Insofar as Barad’s work conceptualizes life (and art) as a vitalizing encounter, it cannot, this essay argues, account for the queer negativity at play in environmental politics, including the politics of climate change.

Calculating Restaurant Failure Rates Using Longitudinal Census Data, J. J. Healy, Máirtín Mac Con Iomaire

Failure rates in the restaurant industry are popularly perceived to be far higher than they actually are. This paper calculates failure rates in the Irish Food and Drinks Sector (IFDS), for the first time, using longitudinal census data from the Central Statistics Office (CSO) in Ireland, which follows the European statistical classification of economic activity (NACE). The results are compared with previously published literature on restaurant failure rates in the United States of America. This study also compares IFDS failure rates with other industry sectors in Ireland (construction, manufacturing).
