Rethinking Copyright And Personhood, Christopher S. Yoo

One of the primary theoretical justifications for copyright is the role that creative works play in helping develop an individual’s sense of personhood and self-actualization. Typically ascribed to the writings of Immanuel Kant and Georg Wilhelm Friedrich Hegel, personhood-based theories of copyright serve as the foundation for the moral rights prominent in European copyright law and mandated by the leading intellectual property treaty, which give authors inalienable control over aspects of their works after they have been created. Studying law is in many ways like studying another culture. Students often feel as though they are learning a new language with unfamiliar vocabulary and different styles of communication. Throughout their legal education, students are also exposed to a profession comprised of unique traditions and expectations. As a result, learning law takes time and energy. It can be both engaging and frustrating and may even challenge some of students’ values and belief systems. This paper examines impressive new applications of legal text analytics in automated contract review, litigation support, conceptual legal information retrieval, and legal question answering against the backdrop of some pressing technological constraints. First, artificial intelligence (Al) programs cannot read legal texts like lawyers can. Using statistical methods, Al can only extract some semantic information from legal texts. For example, it can use the extracted meanings to improve retrieval and ranking, but it cannot yet extract legal rules in logical form from statutory texts. Second, machine learning (ML) may yield answers, but it cannot explain its answers to legal questions or …

Using Ai To Analyze Patent Claim Indefiniteness, Dean Alderucci, Kevin D. Ashley

In this Article, we describe how to use artificial intelligence (AI) techniques to partially automate a type of legal analysis, determining whether a patent claim satisfies the definiteness requirement. Although fully automating such a high-level cognitive task is well beyond state-of-the-art AI, we show that AI can nevertheless assist the decision maker in making this determination. Specifically, the use of custom AI technology can aid the decision maker by (1) mining patent text to rapidly bring relevant information to the decision maker attention, and (2) suggesting simple inferences that can be drawn from that information.

The Intermedial Politics Of Handwritten Newspapers In The 19th-Century U.S., Mark A. Mattes

Handwritten newspapers appeared in a variety of social contexts in the 19th-century U.S.1 The largest extant portion of 19th-century handwritten newspapers emerged from home and school settings. More far-flung examples include those written aboard ships during exploratory and military voyages. Others were produced within institutions such as hospitals and asylums. Such works were written during times of privation, including life in an army regiment or a prisoner-of-war camp during the Civil War. At other times, handwritten newspapers accompanied efforts at westward settlement and transcontinental railway journeys. Postpartum Celebrity Images: Influence On Self- Thoughts And Appearance Management Behaviours Of Postpartum Women, Alyssa Dana Adomaitis, Kim K. P. Johnson

Within previous decades, opinions about pregnancy and post-partum behaviour featured in various news articles and within popular literature emphasized issues related to pregnancy and liquor; campaigns against teen pregnancy; pregnancy and weight gain; and pregnancy and dieting behaviour. Attention has shifted from these issues to appearance-related topics including rapid weight loss, exercise regiments and food restriction. For example, photographs of celebrities have provided visual evidence that women can gain weight during pregnancy, give birth and within weeks revert to a thin, pre-pregnant body size. Servant Leadership Characteristics And Empathic Care: Developing A Culture Of Empathy In The Healthcare Setting, Mark Anthony Martin

The purpose of this study was to assess the degree to which servant leadership characteristics are exhibited in medical group practices, and the degree to which servant leadership characteristics correlated with measures of empathic care. This study featured an explanatory mixed methods research design embedded in appreciative inquiry. A total of 189 mid-level practitioners consisting of nurse practitioners, physician assistants, and practice mangers responded to a 32-item scale survey that featured a six-point Likert scale to measure servant leadership items and a 10-point continuous scale to assess measures of empathic care.
