The legislative procedures regarding wild pigs in the United States are expanding in scope and priority, however, the uniformity of legislation is entropic at best. Each state addresses the issues of wild pigs differently and treatment is based on a priority of resource concerns. An evaluation was conducted at the national level of federal, state, and local policy with regards to wild pig control. Additionally, successful and unsuccessful legislation is evaluated to determine commonalities in the social, economic, and ecological factors contributing to the success or failure of legislation. Despite the comprehensive nature of many universities’ cyberstalking policies, the rapid rate of technological growth has created legal loopholes. The growing popularity of unregulated spyware apps--typically marketed towards employers and parents, has fallen into the hands of abusers, creating an innovative outlet to easily stalk victims. Domestic violence shelters are increasingly receiving young victims who have been stalked by spyware apps. Thus, by analyzing the cyberstalking policies of three top universities, this study will seek to discover the effectiveness of fighting against those perpetuating violence through spyware apps. Municipalities tend to develop their stormwater management policy by examining those of their neighboring communities, chosen out of convenience and perception of similarity rather than a purposeful, directed search. Alternatively, having a policy that is backed by science creates regulations that policy makers can confidently support. To address this issue, the model used in this study incorporates local rainfall and development data to analyze stormwater runoff volumes for various storm events using one year of development data from Chattanooga, Tennessee. The article examines the legal framework of public contracting in the EU. It argues that while European public procurement law explicitly allows for measures to foster gender equality be taken into account in public tendering, European legislation and jurisdiction also impose limits to the range of these measures.

This dissertation is set in the context of a 21st-century America undergoing rapid immigration-driven demographic change accompanied by highly polarized debates about immigrants and immigration policy. With this research I seek to answer questions related to the impact of contemporary immigration policymaking in the U.S. states on the political participation of adults and the well-being of children from immigrant communities nationally. I focus on the impacts of state immigration policy enacted during the decade 2003-2012 among legal immigrants, naturalized immigrants, and U.S.-born children of immigrants from among the four largest U.S. racial/ethnic groups. For decades there has been an ongoing push to increase student achievement through large-scale policy reform and yet far too many students in the United States still perform below proficiency levels with achievement gaps according to race and socio-economic status. Choctaw County School District (CCSD) was no different, as low performance, especially in reading/language arts, and achievement gaps according to race and SES were present. To address these issues, CCSD implemented a K-2 promotion/retention policy in 2008 to improve student achievement. Hepatitis is an infectious disease that affects millions of people worldwide. The current project seeks to achieve two objectives: 1) To understand how hepatitis policies affect hepatitis prevalence in prison, and 2) To understand how hepatitis prevalence in prison affects the general population. Using a content analysis of correctional policies available through each state Department of Corrections (DOC) and secondary data from the 2010 Census, Centers for Disease Control and Prevention, and Corrections Compendium; hepatitis prevalence and policies are analyzed. Recent technological innovations allow Southeastern blueberry farmers to machine harvest highly profitable fresh-market berries with marginally equivalent quality as labor intensive hand harvesting, drastically reducing labor costs while minimally increasing equipment costs. Concurrent with these innovations, the largest blueberry producing Southeastern states of North Carolina, Georgia, Florida, and Mississippi have proposed statewide legislation affecting immigrant status and enforcement, leading to documented labor shortages and wage volatility among seasonal agricultural laborers. Using survey information, this study uses ex-post and ex-ante logit regression models to determine if machine harvester technology (MHT) adoption is explained by human capital variables, production differences, risk preferences, …

Providing affordable housing in the United States involves coordination between the federal, state, and local levels of government. Local jurisdictions must ensure that all requirements are met in order to receive funding. In Albuquerque, NM, this includes the production of a Consolidated Plan to satisfy federal requirements, and an Affordable Housing Plan to satisfy state requirements. Mortgage Resolution Partners, a venture capitalist firm based out of San Francisco, has been visiting with state and local governments across the country. Mortgage Resolution Partners proposes that eminent domain can, and should, be used to seize mortgages and refinance them in an attempt to correct the United States' foreclosure crisis. This article identifies and analyzes the policy issues and constitutional concerns that are inherent in the plan. The most critical constitutional concerns with the plan implicate the Takings Clause, the Contracts Clause, and the Dormant Commerce Clause of the United States Constitution.

Discourse in the United States characterized health disparities' as the disproportionate burden of morbidity and mortality suffered by racial, ethnic and other disadvantaged populations. This dissertation contributes a theory of social construction that transformed health inequalities and inequities into 'health disparities,' a hegemonic (dominant) concept that prevented structural analysis of root causes and effective solutions. Consequently health disparities remain. My study focuses on the discourse during the latter part of President Clinton's administration (1999-2001), when eliminating 'health disparities' became a major objective. The purpose of this study was to determine whether the location of hospitality venues considering; rurality, presence of local ordinances, and socioeconomic status, influenced the quantity of tobacco smoke pollution in a predominantly rural state. The study built on current scientific literature in four aspects. First, it was the first U.S. statewide study on tobacco smoke pollution levels in hospitality venues. Second, it quantified indoor tobacco smoke pollution specifically in rural areas. Third, it used random sampling, a method rarely used in studying indoor tobacco smoke pollution. The contemporaneous objection rule is very clear and precise in its application. However, as the law stands in the Ninth Circuit, failure to contemporaneously object coupled with any mention of race by the sentencing judge is automatic grounds for resentencing. This article explores the origins of this exception to the contemporaneous objection rule. Next, it explores why these statements constitute harmless error on the part of the trial court. Finally, it explains why this “cowardly counsel” exception could have potentially devastating effects to the policies that underlie the contemporaneous objection rule.

This document analyzes the effects of the moratorium on renewable energy incentives passed in Spain in January 2012. It draws the following conclusions: 1) Adjustments to the electric grid should neither be placed on consumers nor on energy efficiency & savings policies; 2) Although it is recognized that the power system is unsustainable, not enough is being done to reform it; and 3) Renewable energy is not the source of the tariff deficit; rather, despite the cuts made to renewable energy, energy costs continue to rise even as demand falls.
