Part II of this Note begins by providing a brief overview of the background and goals of CERCLA. Part II also provides an examination of the issue of ownership liability under CERCLA and recounts the federal courts’ difficulty in applying ownership liability. Part II then describes how the federal government’s “bare legal title” argument arose out of the confusion surrounding ownership liability in CERCLA litigation. Attendance Trends Threaten Future Operations Of America’S State Park Systems, Jordan Smith, Emily J. Wilkins, Yu-Fai Leung

This research examines how the operating expenditures of America’s state park systems will be affected by a continued growth in attendance consistent with observed trends as well as potential climate futures. We construct a longitudinal panel dataset (1984–2017) describing the operations and characteristics of all 50 state park systems. These data are analyzed with a time-varying stochastic frontier model. Estimates from the model are used to forecast operating expenditures to midcentury under four different scenarios. Allegheny County, Pennsylvania, signed a lease to allow unconventional natural gas extraction from Marcellus Shale beneath Deer Lakes County Park in 2014. The park has three man-made lakes and four waterways that eventually flow into the Allegheny River. Drilling commenced in early 2016, and there are now five producing wells. The park has an extensive abandoned coal mine network and several abandoned oil and gas wells. Thus, an independent water quality study was undertaken beginning in July 2015. Samples from seven different sites in the park were used to establish a water quality baseline prior to the drilling. Monthly sampling …

This essay examines the controversy regarding confederate monuments and attempts to contextualize this debate within the current preservation framework. While much attention has been paid to this topic over the past year, particularly with regard to "public" monuments, such discussion has generally failed to recognize the varied and complicated property law layers involved which can fundamentally change the legal requirements for modification or removal. We propose a spectrum or framework for assessing these resources ranging from public to private, and we explore the messy space in-between these poles where most monuments actually fall. The public land use planning process is broken. The land use plans of the principal multiple-use agencies—the United States Forest Service and the Bureau of Land Management (“BLM”)—are unnecessarily complex, take too long to complete, monopolize the time and resources of public land management agency staffs, and fail to engage the general public in any meaningful way. Moreover, the end result is too often a plan that is not sufficiently nimble to respond to changing conditions on the ground, a problem that appears to be accelerating due to climate change.

This study examines how proximity to public lands influences housing values. This will be done using a hedonic pricing strategy, which is useful when analyzing heterogeneous goods such as a house or apartment. The data for this study comes from the American Community Survey (ACS) of Denver, CO from 2010 and 2017. This study also includes four variables related to distance from large open public spaces: one each for the distance from the Rocky Mountain Arsenal National Wildlife Refuge, Rocky Flats National Wildlife Refuge, Cherry Creek State Park, and Chatfield State Park.
