Bias In The Washington Courts: A Call For Reform, Melisa D. Evangelos

Because of the documented threat that racial and gender bias pose to the effective administration of justice in Washington, this Comment advocates amending the Washington Rules of Professional Conduct to explicitly make intentional gender and racial bias an act of attorney misconduct and to discipline any attorney who engages in such behavior. Section I of this Comment identifies and describes instances of attorney behavior that result in gender and racial bias and explains the impact of such bias on attorneys, clients, and the judicial system. The overseas qualified doctor is a potential threat to the state-sanctioned control practising doctors have over medical knowledge in Australia. The nonrecognition of qualifications of many migrant and refugee doctors, in particular from non-English speaking background (NESB) countries, presses them into a subordinate relationship lo that of registered practitioners. The ownership of medical knowledge is limited lo state-recognised practitioners, thus allowing them to maintain significant economic and social advantage within the general community. In 1983, after six years of drafting and lively debate, the American Bar Association adopted the Model Rules of Professional Conduct as its most recent statement of the ethical norms of the legal profession. Shortly thereafter the ABA forwarded the rules to the states for consideration and possible adoption as binding ethical principles. As of this writing, a number of states have adopted the Model Rules, in full or in substantial form, and several more have proposals for such adoption pending before their supreme courts

Tailoring is the process of using sewing and pressing techniques to mold and build shape into the garment fabric, define the garment edges and reduce bulk. Perhaps no procedural innovation has generated more controversy than the class action. As Professor Arthur Miller has observed, debate over “class action problem[s]” has raged at several different levels. For example, opponents and proponents of class actions disagree on whether such actions produce socially desirable results in an economical fashion and whether an already overburdened judiciary can handle the additional supervisory demands of the class action. Recently, a somewhat more ideological dialogue has addressed the merit of publicly funded class actions. Such questions arise only indirectly in the context of class action litigation. In 1969 the Kentucky Supreme Court adopted the American Bar Association's Code of Professional Responsibility as the disciplinary rules binding upon attorneys practicing in the state. The Court adopted the Code as an apparent attempt to provide the Kentucky bench and bar the certainty and guidance offered by a codification of the frequently subjective and occasionally nebulous body of law known as legal ethics. The Court used particular language in its rule adopting the Code, however, which renders uncertain the precise status of the Code in Kentucky. The Immigration And Nationality Act Amendments Of 1976: Implications For The Alien Professional, Beverly F. Harris

Although each major amendment of the Immigration and Nationality Act of 1952, the nation's first comprehensive immigration law, has had the positive effect of enhancing broad national policies, the position of the alien professional within the statutory framework has changed with each amendment. The result is that the professional must today comply with more requirements in order to enter the United States for the purpose of employment. The purpose of this Note is to analyze the changes in the immigration laws effected by the 1976 Immigration Act Amendments and the impact of these changes upon the alien professional.

Projecting future needs is a painstaking and hazardous affair. Avoiding such pain, however, is even more hazardous. There is good reason to attempt to project the next decade's need for, and potential supply of, new lawyers in Kentucky. Adequate legal services are an important ingredient in orderly economic growth and an essential element in preserving a free society. On the other hand, an over-abundance of lawyers can depress the economics of the profession to the point at which its ability to sustain desired standards of ethical conduct and to attract a high caliber of new talent are both threatened. A Study Of The Reasons For The Salary Differential Between Professional Staff Members At The University Of Utah And Utah State University, Terrance R. Volb

Salary differentials by rank were studied at the University of Utah and Utah State University on a departmental basis.
Multiple regression equations were developed from criteria at Utah State University which were used to predict individual salaries for professional staff members at the University of Utah. Thirteen of the fourteen multiple regression equations developed showed statistical significance at the .05 level and twelve departments were significant at the .01 level.
Salary comparisons by rank were considerably reduced as a result of the department by department analysis.
