This thesis analyzes Japan’s decision to use Dispute Settlement Mechanisms (DSMs) in trade agreements. International trade rules are effective when properly applied: they prevent abrogation of the obligations that come with membership in international economic organizations. The DSMs are important ways to enforce the international trade commitments agreed upon by signatory countries. To date, member countries have filed more than 500 cases through the World Trade Organization (WTO), effectively enforcing the rules of the largest multilateral trade organization. On the other hand, in Japan's regional trade agreements (RTAs), none of the DSMs have ever been invoked despite the presence of …

This dissertation analyzes punitive trade conflicts between the U.S. and two trading partners: China and Japan. Punitive trade conflicts can be defined as trade wars between two states, retaliatory tariffs, or other forms of conflict, e.g. preventing the acquisition of foreign assets or sanctions for an undervalued exchange rate. I will examine several trade conflicts between the U.S. and Japan in the 1980s and several trade conflicts between the U.S. and China from 2001 to the present. This chapter uses the analytical framework of transnational legal ordering (TLO) developed by Halliday and Shaffer and applies it to the area of law and disasters. In contrast to the increasingly transnational legal nature of social ordering highlighted by Halliday and Shaffer, it argues that the emergence of transnational regulatory networks and cross-border principles or policies in the area of disaster management has been uneven and incomplete. Although there are many factors that help to explain why the law/disasters area has resisted the trend toward “transnationalization,” two stand out. Japan’s food self-sufficiency ratio is remarkably low compared to other industrialized nations. Growing world population, food, water, and energy shortages in combination with climate change and the rising competition for the world’s limited resources are the transnational dimensions of food and nutrition security related risks that are already affecting Japan. Energy is critical to the functioning of the global economy and seriously impacts global security as well. What factors influence the extent to which countries will pursue nuclear energy in their overall mix of energy approaches? This dissertation explores this critical question by analyzing the nuclear energy policies of the United States, Germany and Japan. Rather than citizen opposition or proximity to nuclear disasters, it seems that a country's access to other resources through natural endowments or trading relationships offers the best explanation for nuclear energy pursuance.

China’s military modernization has allowed it to take a more assertive position on the territorial disputes it currently has with Japan and its Southeast Asian neighbors. Japanese Prime Minister Shinzo Abe, the highest political leader in Japan, shook his head in disbelief. His tenure as Prime Minister had been tense, partly due to the ongoing question of a replacement airfield for the U.S. Marines in Futenma. A predecessor, Yukio Hatoyama, also suffered political fallout stemming from his reversal of a public promise to find a replacement location for the U.S. Marine Corps Air Station. South Korea and Japan usually cooperate but occasionally experience periods of conflict that disrupt their relationship. This paper seeks to explain those sporadic periods of conflict using a dynamic theory. This theory posits that South Korean leadership power status coupled with Japanese action on sensitive issues will lead to a period of conflict. President Kim Dae Jung’s administration serves as the case study for this paper.

China’s emergence as an economic powerhouse has often been portrayed as threatening to America’s economic strength and to its very identity as “the global hegemon.” The media’s alarmist response to an economic competitor is familiar to those who remember US-Japanese relations in the 1980s. This dissertation examined the formation of Japanese identity politics after World War II. Since World War II, Japan has had to deal with a contradictory image of its national self. On the one hand, as a nation responsible for colonizing fellow Asian countries in the 1930s and 1940s, Japan has struggled with an image/identity as a regional aggressor. This thesis explores Chinese Communist Party's political use of history as a fuction to conduce patriotism and to legitimize Party rule. The research initially focused on how anti-Japanese sentiments have grown in China since the Tiananmen demonstrations in 1989 and after the esablishment of a new educational system in 1991. It then explores the impact of CCP's bias referral to conservative Japanese textbooks and views of history. This paper describes and evaluates the competition policies in Japan, China, and Hong Kong. A simple framework based on the economic incentive of violations of law is used to evaluate the effectiveness of competition policy. After half a century of effort, Japan has finally established of a modern antitrust system, although its surcharge system could be further improved so as to enhance the deterrence effect of the law. China and Hong Kong (as most other East Asia countries) are at the early stage of developing an adequate and effective competition policy.
