Analysis Of Japan's Rta And Wto Dispute Settlement Mechanism, Shunsuke Sato

This thesis analyzes Japan’s decision to use Dispute Settlement Mechanisms (DSMs) in trade agreements. International trade rules are effective when properly applied: they prevent abrogation of the obligations that come with membership in international economic organizations. The DSMs are important ways to enforce the international trade commitments agreed upon by signatory countries. To date, member countries have filed more than 500 cases through the World Trade Organization (WTO), effectively enforcing the rules of the largest multilateral trade organization. On the other hand, in Japan's regional trade agreements (RTAs), none of the DSMs have ever been invoked despite the presence of …

The Hermeneutics Of International Trade Conflicts: U.S. Punitive Trade Policy Towards China And Japan, Barry F. Murdaco

This dissertation analyzes punitive trade conflicts between the U.S. and two trading partners: China and Japan. Punitive trade conflicts can be defined as trade wars between two states, retaliatory tariffs, or other forms of conflict, e.g. preventing the acquisition of foreign assets or sanctions for an undervalued exchange rate. I will examine several trade conflicts between the U.S. and Japan in the 1980s and several trade conflicts between the U.S. and China from 2001 to the present. This study is situated within a larger debate concerning the resolution of four theoretical "puzzles" in political science. The first concerns the dispute …

Governing Disasters: The Challenge Of Global Disaster Law And Policy, Eric A. Feldman, Chelsea Fish

This chapter uses the analytical framework of transnational legal ordering (TLO) developed by Halliday and Shaffer and applies it to the area of law and disasters. In contrast to the increasingly transnational legal nature of social ordering highlighted by Halliday and Shaffer, it argues that the emergence of transnational regulatory networks and cross-border principles or policies in the area of disaster management has been uneven and incomplete. Although there are many factors that help to explain why the law/disasters area has resisted the trend toward “transnationalization,” two stand out. Japan is an important ally of the United States–the world’s third biggest economy, and one of the regional great powers in Asia. Making sense of Japan’s foreign and security policies is crucial for the future of peace and stability in Northeast Asia, where the possible sources of conflict such as territorial disputes or the disputes over Japan’s war legacy issues are observed.

Japan’s food self-sufficiency ratio is remarkably low compared to other industrialized nations. Growing world population, food, water, and energy shortages in combination with climate change and the rising competition for the world’s limited resources are the transnational dimensions of food and nutrition security related risks that are already affecting Japan. This paper analyzes the development and institutional context of Japanese policies related to its food security, particularly in relation to its commitments to support developing countries and to promote food security in Africa. This paper evaluates the effectiveness of the U.S. nuclear weapons arsenal in covering security commitments with its foreign allies, particularly Japan. The U.S. has promised to defend allies all over the world with nuclear forces, and consequently has been forced into a delicate and precarious position. President Barack Obama wants to reach nuclear zero, which would make the world safe from nuclear destruction in the future; yet he also wants to provide security for allied nations in the present, using the very weapons he has marked for destruction. Explaining Nuclear Energy Pursuance: A Comparison Of The United States, Germany, And Japan, Lauren Emily Mckee

Energy is critical to the functioning of the global economy and seriously impacts global security as well. What factors influence the extent to which countries will pursue nuclear energy in their overall mix of energy approaches? This dissertation explores this critical question by analyzing the nuclear energy policies of the United States, Germany and Japan. Rather than citizen opposition or proximity to nuclear disasters, it seems that a country's access to other resources through natural endowments or trading relationships offers the best explanation for nuclear energy pursuance.

China’s military modernization has allowed it to take a more assertive position on the territorial disputes it currently has with Japan and its Southeast Asian neighbors. The South China Sea (SCS) dispute is a clear example. Meanwhile, Japan is normalizing its military status to play a more proactive security role in the region. Japan’s normalization process has been greatly influenced by China’s growing military capabilities as it fears that China could pose a threat to its sea lanes of communications. Japanese Prime Minister Shinzo Abe, the highest political leader in Japan, shook his head in disbelief. His tenure as Prime Minister had been tense, partly due to the ongoing question of a replacement airfield for the U.S. Marines in Futenma. A predecessor, Yukio Hatoyama, also suffered political fallout stemming from his reversal of a public promise to find a replacement location for the U.S. Marine Corps Air Station. South Korea and Japan usually cooperate but occasionally experience periods of conflict that disrupt their relationship. This paper seeks to explain those sporadic periods of conflict using a dynamic theory. This theory posits that South Korean leadership power status coupled with Japanese action on sensitive issues will lead to a period of conflict. President Kim Dae Jung’s administration serves as the case study for this paper.

China’s emergence as an economic powerhouse has often been portrayed as threatening to America’s economic strength and to its very identity as “the global hegemon.” The media’s alarmist response to an economic competitor is familiar to those who remember US-Japanese relations in the 1980s. This dissertation examined the formation of Japanese identity politics after World War II. Since World War II, Japan has had to deal with a contradictory image of its national self. On the one hand, as a nation responsible for colonizing fellow Asian countries in the 1930s and 1940s, Japan has struggled with an image/identity as a regional aggressor. On the other hand, having faced the harsh realities of defeat after the war, Japan has seen itself depicted as a victim. Nation-building has historically and contemporaneously been a significant part of the foreign policy of the United States, and has been embraced by Republicans and Democrats alike at one point or another. The United States maintains military bases in foreign countries in efforts to protect American overseas interests, whether they are economic, diplomatic or for geostrategic purposes. In Japan, where the United States has maintained military installations since the end of World War II, debate over the realignment of forces on Okinawa has caused minor, yet growing, rifts in the stable United States-Japanese alliance. This thesis explores Chinese Communist Party's political use of history as a fuction to conduce patriotism and to legitimize Party rule. The research initially focused on how anti-Japanese sentiments have grown in China since the Tiananmen demonstrations in 1989 and after the esablishment of a new educational system in 1991. It then explores the impact of CCP's bias referral to conservative Japanese textbooks and views of history. These studies suggested that under the Patriotic Education Campagin and CCP's representation of Japanese right wing textbooks in China, the state has established methods to control the anti-Japanese sentiments to take focus away …

This paper describes and evaluates the competition policies in Japan, China, and Hong Kong. A simple framework based on the economic incentive of violations of law is used to evaluate the effectiveness of competition policy. After half a century of effort, Japan has finally established of a modern antitrust system, although its surcharge system could be further improved so as to enhance the deterrence effect of the law. China and Hong Kong (as most other East Asia countries) are at the early stage of developing an adequate and effective competition policy. Controversy surrounds the adjudication of the United States Navy (USN) commander whose submarine collided with and then sank a Japanese fishing boat in February 200l. The USN has Issued a letter of reprimand to the commander and is allowing him to leave the Navy with full pension based on his current rank, as opposed to authorizing a court-martial that would have rendered the commander liable to very serious criminal charges and sentences. At Issue have been the effects of the adjudication on military personnel aware of the adjudication.
