Indonesian Notary
Notary is an authorized Public Officer who is under supervision to carry out their position as a noble, integrous and professional notary. With regard to conducting criminal offense, a notary could be accounted for the deed that they make, based on what they see, what they witness and what they experience in a legal act. The Process And Role Of The Judiciary In Election Administration Dispute Resolution In Indonesia, Eny Kusadarini, Anang Priyanto, Sri Hartini
Jurnal Civics: Media Kajian Kewarganegaraan
Election administrative violations occur at the time of the implementation of the general election by election organizers and contestants. Sometimes, they do not realize that they have committed a violation. Since the general election during the reformation period after the fall of the New Order in Indonesia, there have been frequent violations of election administration resolved through administrative courts through the State Administrative Court. The dispute resolution was carried out after complaints were made through Bawaslu and DKPP as administrative dispute resolution (ADR) institutions and did not bring results. This administrative violation is considered detrimental to the candidate contesting the …

American Surrogacy: Babies For Sale?, Madison Edwards
American Surrogacy: Babies For Sale?, Madison Edwards
Honors Projects
More surrogacy contracts are fulfilled in the United States than in any other country (Bromfield, 2016, p. 193). In 2014, there were approximately 2,000 surrogacy arrangements in the U.S., yet the market is totally unregulated (Shellnutt and Grizzle, 2018, p. 31). Given that 1 in 6 American couples face infertility, there will continue to be a demand for alternative and assisted reproductive options (Shellnutt and Grizzle, 2018, p. 34). This paper seeks to explore several areas of surrogacy, including contract enforcement, potential problems parties in surrogacy agreements face, current legislation, the role of religion in surrogacy, and specific case studies. …

Acknowledgment Of Culture And Stereotypes: Black Participants’ Perceptions Of Specific Therapist Behaviors, Tsotso T. Ablorh
Graduate Masters Theses
Mental health disparities for Black people of diverse ethnicities compared to people of other racial identities has been well-documented (Alegría et al., 2008; Maura & Weisman de Mamani, 2017). Research addressing this pervasive systemic and interpersonal problem often focuses on client-related factors that create or intensify barriers to care. However clinician-related factors (i.e., racial identity, multicultural training, implicit biases, behavior, etc.) also have a significant impact on barriers to care, retention in therapy, and clinical outcomes for people of African descent (Larrison & Schoppelrey, 2011; Owen, Imel, Adelson, & Rodolfa, 2012). Researchers suggest that the favoring of historically white perspectives, …

Elementary Teacher Experiences With English Language Learners With Special Education Needs In New York, Colleen Ann Cahill
Theses and Dissertations
This qualitative study aimed to understand teacher experiences working with English language learners (ELL) with or suspected of having a learning disability. This study also addressed the current problem of ELL students concurrently being under and over classified as needing special education services. This study explored the experiences of elementary school teachers in the state of New York. The participants were from different school districts within New York State. The participants all had experience teaching students who were designated ELL who were currently in the process of response to intervention (RTI) or had already been referred and classified as having …
The Illegally Traded Elephant In The Room: Species Terrorism & Combating Illegal Wildlife Trade, Áine Dillon
The Illegally Traded Elephant In The Room: Species Terrorism & Combating Illegal Wildlife Trade, Áine Dillon
Pace International Law Review
The illegal wildlife trade has been a dilemma for decades
and remains prevalent globally – international intervention is
required now. While most countries participate in the Convention
on International Trade in Endangered Species of Wild
Fauna and Flora (“CITES”), not all countries have the same approaches
to combating the illegal wildlife trade. Unique approaches
can be beneficial because each illegally traded species
requires a different response, and countries with limited resources
can also participate. However, the lack of a unified response
hinders the global fight against the illegal wildlife trade.
While traditional methods to combat crime, such as passing
laws, …
The Online Criminal Trial As A Public Trial, Stephen Smith
The Online Criminal Trial As A Public Trial, Stephen Smith
Faculty Publications
There are two ways of favorably conceiving online trials in Sixth Amendment terms. One is that an online trial is a public trial, by its terms. The other is that an online trial may not be public, for Sixth Amendment purposes, but may nonetheless satisfy applicable constitutional demands for trials considered “closed.” This Essay proposes both: that an online trial is fundamentally “public” for Sixth Amendment purposes and, if it is not, it may still be a constitutional accommodation of the Sixth Amendment’s public trial guarantee, in appropriate circumstances.
The constitutionality of an online trial may be largely an idle …

Cyberbullying Victimization As A Predictor Of Depressive Symptoms Among Selected Adolescents Amidst The Covid-19 Pandemic, Jeyaseelan Maria Michael, Marc Eric Reyes
Makara Human Behavior Studies in Asia
Cyberbullying victimization has become a significant mental health concern, particularly among adolescents at risk of experiencing negative consequences like depression. As the outbreak of the Covid-19 pandemic forced everyone to stay at home and participate in all their educational, recreational, and entertainment activities online, this study investigated the relationship between cyberbullying victimization (CV) and depressive symptoms among 612 college students in Tamilnadu, India. We hypothesized that experiences of cyberbullying victimization would predict depressive symptoms among the participants. Adolescent participants aged 18 to 19 years old from colleges in Tamilnadu completed an online survey composed of the Cybervictimization questionnaire for adolescents …
Nice White Parents And The Phantom Public School, Jason Loviglio
Nice White Parents And The Phantom Public School, Jason Loviglio
RadioDoc Review
Serial Productions’ Nice White Parents tells the story of “an utterly ordinary, squat, three-story New York City public school building”, and the many schools it has housed over six decades; each one, it turns out, shaped in ironic and disastrous ways by white parents’ ambivalent desire for diversity. Like some earlier Serial efforts, this is a story on a theme: the failure of the American experiment in public, democratic institutions. Thanks to impressive archival research, candid interviews with a wide range of stakeholders, and a deftly delivered dose of Serial’s trademark reflexivity between the object of study and the reporter’s …

Evaluating A Test For Shedding Propensity Using Tape Lifts From Different Skin Locations, Xiao M. Chen
Evaluating A Test For Shedding Propensity Using Tape Lifts From Different Skin Locations, Xiao M. Chen
Student Theses
The shedding propensity of a person can assist data interpretation in casework when assessing the possibility of passive transfer for DNA analysis. Past studies on shedding propensity evaluated palmar skin (washed and unwashed) deposits. This study compared different skin locations with respect to shedding propensity, and explored the potential of tape-lifts as a skin surface collection method. Eight different skin types and samples were collected with adhesive tape disks from 28 participants over three non-consecutive days; the washed and unwashed fingers from both hands, toe, and arm, neck below ear, and nape. Samples were extracted, quantified, amplified, genotyped, and evaluated …
Reproducibility Of Individual Dna Deposits Detected Through Cellular Fluorescence, Natalee Small-Davidson
Reproducibility Of Individual Dna Deposits Detected Through Cellular Fluorescence, Natalee Small-Davidson
Student Theses
Contact traces are an important part of DNA casework, but the probative value of any identified associations depends on the possibility of passive transfer. There is known individual variation in DNA left behind during contact, this DNA shedding propensity has an effect on whose DNA is detected. This study evaluated this variability using a cell staining approach. Volunteers were asked to deposit a fingerprint on a clean glass slide, then wash their hands and deposit a second fingerprint after a 30-minute wait without touching anything. Three sets of samples were collected over three consecutive weeks. Fingerprints were stained with a …
Disorderly Conduct: An Investigation Into Police And Prosecutor Practices, Michael Cicchini
Disorderly Conduct: An Investigation Into Police And Prosecutor Practices, Michael Cicchini
Lincoln Memorial University Law Review Archive
Disorderly conduct is usually a misdemeanor statute that criminalizes a broad range of behavior. Law professors have recently called for the abolition of such statutes, arguing that the police are surveilling African American neighborhoods “for signs of disorder” and using the statute “as a means of social control against people of color.”This Article investigates this claim of racist policing by examining a sample of disorderly conduct cases. The sample confirms that African Americans are indeed charged at a disproportionately high rate relative to their percentage of the population. However, the disproportionate charging is not due to racist police surveillance. Rather, …

An Experimental Test Of The Impact Of Varying Questionnaire Response Format On Prevalence Rates For Sexual Violence Victimization And Perpetration, Raeann E. Anderson, Kelly Cuccolo
Psychology Faculty Publications
Objective: This study examined the impact of a dichotomous versus scaled response format on prevalence rates of sexual violence perpetration and victimization, thus conceptually replicating Hamby et al., 2006 and extending those findings to the context of sexual violence.
Methods: Two samples were recruited from Amazon Mechanical Turk and were randomly assigned to either a dichotomous or scaled response format of the same questionnaire. Sample 1 was used to examine perpetration and received a perpetration specific version of the Post-Refusal Sexual Persistence Scale (PRSPS). Sample 2 was used to examine victimization and received a victimization specific version of the PRSPS. …

Contemporary Black Women's Voting Rights Activism: Some Historical Perspective, Alison Parker, Valeria Sinclair-Chapman, Naomi R. Williams
The Seneca Falls Dialogues Journal
As the United States arrived at the brink of the 2020 election, three interdisciplinary scholars engaged in a panel discussion about why and how Black women of all classes have been at the forefront of movements for civil rights and economic justice. Based on their expertise on race, gender, and class, and scholarly backgrounds in history, labor studies, and political science, this paper presents perspectives on the critical role of Black women in simultaneously fighting for the right to vote, while protesting the disenfranchisement of all African Americans from the Reconstruction Era to the present. The paper discusses why and …

The important questions laid out by the Appeals Chamber in this case highlight the need for the proper delineation and interplay between mental illness and criminal responsibility under international law. Specifically, this case represents a watershed moment for the Appeals Chamber to set a framework for adjudicating mental illness in the context of collectivized child abuse and trauma. This is especially true for former child soldiers who occupy both a victim and alleged perpetrator status.
