From Community Policing To Political Police In Nicaragua, Lucia Dammert, Mary Fran T. Malone Dec 2020

From Community Policing To Political Police In Nicaragua, Lucia Dammert, Mary Fran T. Malone

Faculty Publications

In a region plagued by high rates of violent crime and repressive policing practices, Nicaragua has earned a reputation as exceptional. Despite poverty, inequality, and a historical legacy of political violence and repression, Nicaragua has defied regional trends. It has registered low rates of violent crime while deploying policing practices that emphasized prevention over repression. April 2018 marked an end to this exceptionalism. Police attacked anti-government protestors, and launched a sustained campaign against dissidents that continues to the present day. While the Nicaraguan police had long cultivated a reputation as community-oriented and non-repressive, they appeared to quickly change into a …

Autonomous Cyber Weapons And Command Responsibility, Russell Buchan, Nicholas Tsagourias Dec 2020

Autonomous Cyber Weapons And Command Responsibility, Russell Buchan, Nicholas Tsagourias

International Law Studies

Autonomous cyber weapons have made their way onto the battlefield, raising the question of whether commanders can be held criminally responsible under command responsibility when war crimes are committed. The doctrine of command responsibility has a long history in international criminal law and comprises three core elements: the existence of a superior-subordinate relationship, the commander’s knowledge of the crime, and the commander’s failure to prevent or repress the subordinate’s criminal actions. This article unpacks the content of these elements and applies them to autonomous cyber weapons by treating them as being analogous to soldiers since they operate within an organized …

Pretrial is an institution to control and correct law enforcement which are deemed to have violated mechanisms established in procedural laws. The correction is not aimed to look into the aspects of the alleged criminal case but determine whether “rules of the game” established in the formal criminal law have been implemented properly or not. In practice, tax payers being involved in tax criminal cases often file pretrial motion although tax investigators actually have applied the principles of formal criminal law in legal measures they take. There are often different interpretations of laws and regulations used in pretrial institution for …

International Experience In Regulating And Organizing Investigations By International Investigative Teams., Dilshod Egamberdiyev Sep 2020

International Experience In Regulating And Organizing Investigations By International Investigative Teams., Dilshod Egamberdiyev

Review of law sciences

In recent years, the international community has developed and opened for signature a number of international agreements regulating international cooperation in the fight against crime. Along with the legal regulation of traditional legal institutions, such as mutual legal assistance in criminal matters, these instruments provide an international legal framework for new areas of cooperation in this field. One of them is the operational-investigative group or the international investigation team. The organization of such types of investigations and joint activities of States is one of the most effective forms of interaction between investigators, investigative bodies and law enforcement agencies, as well …

BAU Journal - Health and Wellbeing

The accelerated development in the industry of weapons has reshaped the human behaviors, which led to spreading of wars and terrorism. Since World War I, homeless people could not live without making crimes as a source of income. Residential compounds, private proprieties, and public projects have become attraction points magnetizing robbers. Consequently, architects have realized the importance to use design strategies reducing crimes. The scale of crime prevention is varied to cover a single building or a group of buildings. This paper proposes awareness-guidelines for 'architecture against crime' to be considered before setting the urban design of residential compounds in …

A Comparison Of Strain, Social Learning, Control, And Trauma Theories Of Crime, Nicole Trauffer Sep 2020

A Comparison Of Strain, Social Learning, Control, And Trauma Theories Of Crime, Nicole Trauffer

Dissertations, Theses, and Capstone Projects

The field of criminology has been dominated by Strain, Control and Social Learning Theories, among others. More recently, research and theory has focused on the role of trauma as a predictor of criminal behavior, especially for women. However, little research has empirically compared these theories to one another. The current study examined these four major theories to determine which best explains non-violent and violent criminal behaviors. Race and sex differences were examined. The data is from a large prospective cohort design study of individuals with documented histories of physical and sexual abuse and neglect and a control group of children …

See No Evil: Are Community Colleges Underreporting Or Nonreporting Sexual Assaults?, Songa Y. Thomas-Montford

Seton Hall University Dissertations and Theses (ETDs)

The Clery Act is a consumer protection law intended to protect students by forcing institutions of higher education to be transparent about campus crime, as the concern is that many colleges and universities are underreporting or nonreporting campus crime statistics. This study included two research questions. The first question, “What are the common themes determined in the audits concerning Clery Act violations for two-year schools?,” was addressed by conducting a deductive content analysis by reviewing each U.S. Department of Education (USDOEd) Clery Act compliance audit in the research sample. The USDOEd, Federal Aid Data Center’s public database, was the source …

The Effects Of Admission To Jail On Crime Rate In Mclean County, Illinois, Derek Conley Aug 2020

The Effects Of Admission To Jail On Crime Rate In Mclean County, Illinois, Derek Conley

Stevenson Center for Community and Economic Development—Student Research

The relationship between crime and incarceration is growing in interest in the United States. The United States incarceration rate is often double or triple the rate of other Organization for Economic Co-operation and Development (OECD) countries. The hardline approach the United States has taken on crime has many citizens and academics questioning its effectiveness on achieving safer communities. Traditional theory suggests incarcerating individuals for deviant behavior reduces the crime rate through the mechanisms of incapacitation, deterrence, rehabilitation, and retribution. However, some scholars believe concentration of incarceration in neighborhoods disrupts the social fabric of the neighborhood and produces the opposite of …

Why People Remain In Socially Disorganized Communities: A Critique Of Social Disorganization Theory, Lasheyla Kajuan Jones Aug 2020

Why People Remain In Socially Disorganized Communities: A Critique Of Social Disorganization Theory, Lasheyla Kajuan Jones

Public Affairs Dissertations

The literature surrounding social disorganization has typically focused on crime and a communities inability to influence existing social rules of behavior upon individuals (Paulsen & Robinson, 2004). This qualitative study examines twenty-one tenure tract residents, business owners, and/or leader’s motivation for remaining in areas deemed socially disorganized under the HUD R/ECAP standards. Utilizing interviews and surveys to understand how individual participants experience living, working, and/or advocating in communities classified as socially inadequate, allowed patterns to emerge that pinpointed why people chose to remain in these communities. Leaders, business owners, and residents alike, offered an array of information supporting their position …

Immigrants And Crime, Daniel L. Stageman Jul 2020

Immigrants And Crime, Daniel L. Stageman

Publications and Research

The gap between public perception of immigrant criminality and the research consensus on immigrants’ actual rates of criminal participation is persistent and cross-cultural. While the available evidence shows that immigrants worldwide tend to participate in criminal activity at rates slightly lower than the native-born, media and political discourse portraying immigrants as uniquely crime-prone remains a pervasive global phenomenon. This apparent disconnect is rooted in the dynamics of othering, or the tendency to dehumanize and criminalize identifiable out-groups. Given that most migration decisions are motivated by economic factors, othering is commonly used to justify subjecting immigrants to exploitative labor practices, with …

Immigration And Crime In The News, 2014-2018: Do Focusing Events And Policy Windows Affect Framing?, Abigale Rongey

Graduate Theses and Dissertations

Although an abundance of literature demonstrates that immigrant populations are less crime-prone than the native-born population, the majority of Americans believe that immigration inherently threatens the security of the United States. Because Americans are not well versed in the complex issues of immigration and crime, public opinion is undoubtedly influenced by media outlets’ crafted narratives that simplify circumstances and events into easily digestible material. The current study examines how media behavior changes and responds to social and political events by examining “frames” utilized in articles that produce narratives about immigration and crime. Using content analysis of over 1,700 articles published …

The Politicization Of Crime And Its Implications, Komysha Hassan Jun 2020

The Politicization Of Crime And Its Implications, Komysha Hassan

The Pegasus Review: UCF Undergraduate Research Journal

The relationship between law enforcement and the public has recently come under scrutiny after a number of high-profile deaths of African-Americans at the hands of police officers. The ensuing public outcry has given way to a wide-ranging debate about the origins of such tension and why it has continued to manifest with such vigor despite apparent progress. This research attempts to uncover the underpinnings of this tension through a historical review of the development of the law enforcement institution and the narrative of crime in society. Specifically, this research investigates the role of federalization and politicization on crime and its …

Reflective Writing In Prisons: Rehabilitation And The Power Of Stories And Connections, Sandeep Kumar Jun 2020

Reflective Writing In Prisons: Rehabilitation And The Power Of Stories And Connections, Sandeep Kumar

VA Engage Journal

The United States has the highest rate of incarceration in the world. Even though the rate of crime is dropping, incarceration rates remain fairly steady. What’s more, recidivism (i.e., re-offending after conviction for other crimes) is also very high in the US. If offenders continue to offend, even after completing their sentences in a correctional system designed to address their underlying criminal activity, what is the point of having such a system? Can the system be made more accountable and better? Have we considered all the options for criminal reform? This article explores these questions using effective rehabilitation principles to …

How Property Crime And Violent Crime Respond To A State Setting Their Minimum Wage Above The Federal Minimum Wage, Kevin Loonam Jun 2020

How Property Crime And Violent Crime Respond To A State Setting Their Minimum Wage Above The Federal Minimum Wage, Kevin Loonam

Culminating Projects in Economics

Labor market conditions are known to be an important factor for determining crime rates. This is why policy makers suggest increasing the minimum wage can help reduce crime. The argument is based on the assumption that raising the minimum wage will not have undue negative employment effects and result in improving the legitimate labor market by enticing those who would commit crimes to enter the legitimate labor market. Using a cross-section of the 50 states, this study examines overall youth property crime and overall youth violent crime from the 2000-2016 Uniform Crime Reports (UCR) to determine what effect there is …

Ethical Implications Of Forensic Genealogy In Criminal Cases, Solana Lund May 2020

Ethical Implications Of Forensic Genealogy In Criminal Cases, Solana Lund

The Journal of Business, Entrepreneurship & the Law

The use of forensic genealogy to solve criminal cases is likely to increase in the coming years, especially given its success in solving cold cases. While its potential for good is impressive, there are also legitimate ethical concerns that need to be addressed. As society sees an increase in the use of forensic genealogy and DTC databases in criminal investigations as well as an increase in the media attention it garners, there will be more discussion regarding ethical implications. Legal scholars say that it is only a matter of time before courts weigh in on the privacy of DNA and …

The Relationship Between Traumatic Brain Injuries, Impulsivity, And Crime, Brian Ramanauskas May 2020

The Relationship Between Traumatic Brain Injuries, Impulsivity, And Crime, Brian Ramanauskas

Student Theses

The rate of traumatic brain injuries (TBIs) are increasing each year, impacting an estimated 1.4 million Americans. After further investigation, researchers have concluded that 8.5% of the general public sustains at least one TBI, whereas this number ranges from 25% to 87% in criminal populations. In the literature, impulsivity is frequently described as poorly conceived, prematurely expressed, or inappropriate behaviors. Additionally, poor impulse control has been shown to significantly impact the likelihood of criminal activity, increasing the rate of recidivism. The current study examined an archival dataset of 95 incarcerated individuals from a private correctional facility in a large mid-Atlantic …

Delinquency In The Caribbean: Stakeholder Perceptions Of Root Causes, Laura Nolterieke May 2020

Delinquency In The Caribbean: Stakeholder Perceptions Of Root Causes, Laura Nolterieke

Honors Theses

There is a gap in the research on juvenile delinquency within the Caribbean context. As countries such as St. Lucia, Guyana, St. Kitts, and Nevis have growing delinquency and crime rates, there is a need to bridge this gap in the literature. This research sought to examine the main causes of juvenile delinquency within St. Lucia, Guyana, St. Kitts, and Nevis, as described by juvenile justice stakeholders, such as probation officers, prosecutors, and judges, within their respective countries. Through the use of grounded theory, the data were coded and analyzed using a constant comparison method. From these data, six themes …
