Part III steps through the Second Circuit’s majority opinion, and Part IV critiques the opinion. Part V concludes the Case Note by discussing the ramifications of Nicholas for future DNA-indexing cases.

OBJECTIVE: Racial and ethnic disparities in the criminal justice system have been widely reported, as have racial and ethnic disparities in diagnoses and certain aspects of clinical management. This study examined the association between race and ethnicity and dispositions for pretrial defendants who were referred for forensic mental health evaluations. METHODS: Available data were reviewed for all defendants in Massachusetts who were referred to a Massachusetts court clinic from 1994 to 2001 for a screening evaluation of their competence to stand trial, their criminal responsibility, or both. Objective Current knowledge regarding psychiatric disorders and crime in youth is limited to juvenile justice and community samples. This study examined relationships between psychiatric disorders and self-reported crime involvement in a sample of youth representative of the US population. Method The National Comorbidity Survey–Adolescent Supplement (N = 10,123; ages 13–17 years; 2001–2004) was used to examine the relationship between lifetime DSM-IV–based diagnoses, reported crime (property, violent, other), and arrest history. Logistic regression compared the odds of reported crime involvement with specific psychiatric disorders to those without any diagnoses, and examined the odds of crime by psychiatric comorbidity. This study examined Virginia community college students' perceptions of campus safety. A survey of 11,161 students revealed the crimes students most feared being a victim of while on the community college campus and the areas in which they felt the most and least safe. The research also demonstrated the effect of certain variables had on students' overall perception of campus safety. The variables studied included student demographics, the presence and type of security personnel, and the rurality of the campus setting. The campuses with the highest and lowest degrees of perceived safety were then further studied via case studies to …

In this thesis I investigate the effectiveness of the RealVictory Program, a juvenile aftercare program combined with a phone coach system, in the state of Utah. Using treatment and control groups, I examine both time to re-arrest as well as number of post-participation arrests to determine how effectively RealVictory reduces recidivism among juvenile participants released from secure care, in foster homes, or while on probation. I found the treatment group was at a 21.7 percent higher risk of being rearrested, but this result was not statistically significant. Historians can better understand the path that urban reform took at the end of the nineteenth by focusing on the social networks that participated in many different reform efforts. In Baltimore, a group of elite businessmen began a variety of association and societies to aid the poor in their midst. The Charity Organization Society best combined this group of men. The way courts treat criminals depends on a variety of factors. This paper examines how age, sex, and race affect an offender’s treatment during sentencing. These variables were collected using the 2010 General Social Survey and were tested using the SPSS 20.0 Student Version Statistical Software. The independent variables include age, race, and sex, while the dependent variable is the way courts deal with criminals. The hypotheses that were tested stated that older individuals, nonwhite persons, and men would believe that courts deal too harshly with criminals. Crime in the United States has steadily been decreasing since the 1990s. Social disorganization theory states that breakdowns of social institutions were the root causes of juvenile delinquency. Using exogenous variables of poverty, residential mobility, and ethnic heterogeneity, this study aims to investigate the impacts and magnitude of these variables on violent and property crime committed in the United States for adults and for juveniles. While graffiti is a gateway crime towards more serious criminal offending, little is known about graffitists' patterns of desistance from, and persistence in, crime. This paper addresses this knowledge shortfall through an examination of the Western Australian Police Information Management System (IMS) database for three age-groups (i.e. preteens, adolescents, adults) and three categories of graffiti offenders (Early Desisters, Limited Persisters, Chronic Persisters). Descriptive and chi-squared statistics reveal that: i) nearly three-quarters of all of the 667 preteen, adolescent and adult graffiti offenders desisted from further offending after their first or second contact with police; ii) the mainly adolescent cohort of …

This thesis examines how the relationship between crime and poverty is rhetorically constructed within the news media. To this end, I investigate the content of twelve news articles, published online, that offered coverage of crime in the city of Detroit, Michigan. I employ three methods in my criticism of these texts: ideographic analysis, critical framing analysis, and an approach that considers ideographs and framings elements to be rhetorical constructions that function together. In each phase of my analysis, I developed ideological themes from concepts emerging from the texts. I then approached my discussion of these findings from a perspective of …

Your Friends And Neighbors: Localized Economic Development And Criminal Activity, Matthew Freedman, Emily Owens

We exploit a sudden shock to demand for a subset of low-wage workers generated by the 2005 Base Realignment and Closure (BRAC) program in San Antonio, Texas to identify the effects of localized economic development on crime. We use a difference-in-difference methodology that takes advantage of variation in BRAC’s impact over time and across neighborhoods. We find that appropriative criminal behavior increases in neighborhoods where a fraction of residents experienced increases in earnings. This effect is driven by residents who were unlikely to be BRAC beneficiaries, implying that criminal opportunities are important in explaining patterns of crime.

Abstract

This study explains how community activists make use of available social capital and collective efficacy while attempting to mediate gun violence. It specifically focuses on twelve in-depth interviews of activists' perspectives, processes and rationales to alleviate community gun violence, based on informal social control models. Findings suggest activists must establish trust and respect with youth they work with before mediation begins, which is established through similar life experiences or backgrounds. Once a strong bond is established with youth, activists identified five core processes to reduce violence: 1) improve the mindset, 2) provide life skills, 3) assist youth as their …

On the night of February 26, 2012, George Zimmerman, a member of a neighborhood watch program, was patrolling his community in Sanford, Florida, when he spotted Trayvon Martin, a seventeen-year-old Africa-American high school student, walking through the neighborhood. Zimmerman dialed 911 and indicated that he was following "a real suspicious guy". The police dispatcher requested that Zimmerman discontinue following Martin, but he ignored the request and approached the teenager. In the resulting confrontation, Zimmerman used his legally owned semi-automatic handgun to shoot and kill Trayvon Martin. Martin, who was unarmed, had been returning from a local convenience store.
