The Curious Case Of Convenience Casinos: How Internet Sweepstakes Cafes Survive In A Gray Area Between Unlawful Gambling And Legitimate Business Promotions, Steven Silver Aug 2012

The Curious Case Of Convenience Casinos: How Internet Sweepstakes Cafes Survive In A Gray Area Between Unlawful Gambling And Legitimate Business Promotions, Steven Silver

Steven Silver

Once relegated to the Nevada desert and New Jersey shore, gambling is now everywhere in the United States. State governments strapped for cash and desperate for increased tax revenues are welcoming gambling with open arms as forty-three states sponsor lotteries and twenty-three states house casinos. Despite this gaming boom, the ease of access to casinos has not deterred entrepreneurs from successfully creating an offshoot industry of “convenience casinos.” Convenience casinos are simply Internet cafes that sell Internet time cards attached with instant-win sweepstakes entries, much like the code underneath a Coke bottle or a McDonald’s Monopoly game piece. Although seemingly …

Teaching Chang-Rae Lee’S _Aloft_: Exploring The Limits Of Race And Ethnicity, Jaime Cleland Aug 2012

Teaching Chang-Rae Lee’S _Aloft_: Exploring The Limits Of Race And Ethnicity, Jaime Cleland

Asian American Literature: Discourses & Pedagogies

Chang-rae Lee’s 2004 novel Aloft may not be his most famous work, but it is a highly effective classroom text. In its contemporary, multicultural, suburban setting, it portrays a world that students recognize; simultaneously, however, it can effectively challenge their assumptions about ethnic American literature. The novel centers on Jerry Battle, an amateur pilot who distances himself from his problems in his private jet, and explores the problems of four generations of his multi-ethnic family. The Battles, with both Italian and Korean heritage, are representative of the current landscape of race and ethnicity in America; mixed-race identities have become accepted …

Disturbing Stereotypes: Fu Man/Chan And Dragon Lady Blossoms, Audrey Wu Clark

Asian American Literature: Discourses & Pedagogies

Article Submission (Accepted with Revisions): “Disturbing Stereotypes: Fu Man/Chan and Dragon Lady Blossoms” Article Abstract: In documenting anti-miscegenation laws in the United States, critic Sally L. Kitch argues that they were not only directed against mixed heritage African Americans but also against Asians after the Civil War. Kitch writes, “Fourteen states, including many that entered the Union after the war, adopted or revised anti-miscegenation statutes to apply to ‘Mongolians,’ or ‘Malays’ in general or to the Chinese in particular. Gender was also paramount to western lawmakers as they determined that the ‘blacks’ white women were most likely to marry were …

The Abjection Of James Dean: Mixed Media/Mixed Race Performances In Ai's Poem, "James Dean", Cathy Irwin Aug 2012

The Abjection Of James Dean: Mixed Media/Mixed Race Performances In Ai's Poem, "James Dean", Cathy Irwin

Asian American Literature: Discourses & Pedagogies

This paper investigates how the developmental process of the Japanese-Black-Choctaw-Irish American poet Ai translates into a creative process that integrates aspects of identity thrown out or made abject by dominant cultural norms and ideals. Just as Ai once disidentified with parts of her identity to discover and integrate her abject Japanese heritage, Ai's dramatic monologue "James Dean" explores the intersections where the poetic voice-the narrator or subject speaking-disidentifies with the cinematic and textual image of iconic white, heterosexual masculinity in order to integrate a sexuality that usually constitutes its "outside." In the process, this paper argues that by mixing print …

Carnival, Convents, And The Cult Of St. Rocque: Cultural Subterfuge In The Work Of Alice Dunbar-Nelson, Sibongile B. Lynch

English Theses

In the work of Alice Dunbar-Nelson the city and culture of 19th century New Orleans figures prominently, and is a major character affecting the lives of her protagonists. While race, class, and gender are among the focuses of many scholars the eccentricity and cultural history of the most exotic American city, and its impact on Dunbar-Nelson’s writing is unmistakable. This essay will discuss how the diverse cultural environment of New Orleans in the 19th century allowed Alice Dunbar Nelson to create narratives which allowed her short stories to speak to the shifting identities of women and the social …

Unesco’S Cultural Heritage Lists: Protecting Indigenous Traditional Sports And Games, Jesse W. Busta

Jesse Busta

This Note, entitled UNESCO’s Cultural Heritage Lists: Protecting Indigenous Traditional Sports and Games, will be the first to examine fully from a legal perspective a proposal to develop a means for protecting indigenous traditional sports and games, which are a valuable asset to all humanity. Protections are needed for indigenous traditional sports and games due to the harmful effects of globalization and the deviation of today’s people from their ancestors’ traditions. Currently, only tangible cultural heritage and limited intangible cultural heritage are protected by the United Nations Educational, Scientific, and Cultural Organization (“UNESCO”). Cultural heritage forms the backbone of human …

The Mediating Role Of Coping On The Relationship Between Attachment Style And Posttraumatic Stress Disorder Among Suicidal African American Women, Wendy Heath-Gainer Aug 2012

The Mediating Role Of Coping On The Relationship Between Attachment Style And Posttraumatic Stress Disorder Among Suicidal African American Women, Wendy Heath-Gainer

Counseling and Psychological Services Dissertations

The literature on clinical interventions for suicide prevention indicates that low-income, suicidal African American females are an historically underserved population. Contributing to this lack of service are the intersecting influences of race, ethnicity, culture, gender, sexual orientation, socioeconomic status and related oppressions (APA, 2007). In suicidal African American females, a higher level of reported symptoms of posttraumatic stress disorder has been found in suicide attempters as compared to nonattempters (Kaslow et al., 2000), and PTSD has been shown to be associated with heightened risk of an ensuing suicide attempt (Wilcox, Storr, & Breslau, 2009). One factor affecting manifestation of PTSD …

Grandparents' Visitation Rights: A Survey Of Reciprocal Kinship-Ties Based In Historical Common Law And Legislative Policies, Jane E. Atkinson

Marquette Elder's Advisor

This article presents an in-depth exploration of the view that family ties and relationships should play an important role in determining grandparent-grandchild visitation rights, based on the important role of the extended family throughout recorded history. Atkinson postulates that post-Troxel visitation decisions should include increased consideration of the value to the child of grandparent visitation.

All Things Shining: A Narrative And Stylistic Analysis Of Terrence Malick's Films, C. Clinton Stivers Aug 2012

All Things Shining: A Narrative And Stylistic Analysis Of Terrence Malick's Films, C. Clinton Stivers

Doctoral Dissertations

This dissertation fills a gap in the scholarship on the films of Terrence Malick by providing a historically based and grounded auteur study that provides a comprehensive examination of his formal and thematic concerns in Badlands (1973), Days of Heaven (1978), The Thin Red Line (1998), The New World (2005), and with a coda on The Tree of Life (2011).

This auteur study draws on critical approaches to formalism, Hollywood genres, American cultural myths, and the philosophy of Martin Heidegger. Each chapter that addresses a specific film opens by historically situating Malick and that film within an industrial and production …

Leaving The Dale To Be More Fair: On Cls And First Amendment Jurisprudence, Mark Strasser Aug 2012

Leaving The Dale To Be More Fair: On Cls And First Amendment Jurisprudence, Mark Strasser

Mark Strasser

In Christian Legal Society of the University of California, Hastings College of Law v. Martinez, the Supreme Court upheld the Hastings College of Law’s requirement that all recognized student groups have an open membership policy. The decision has been criticized for a variety of reasons, e.g., that the Court conflated the First Amendment tests for speech and association. What has not been adequately explored is the degree to which the Court has modified limited purpose public forum analysis in the university context over the past few decades, resulting in a jurisprudence that is virtually unrecognizable in light of the more …

Paper Towns: Sense Of Place In Industrial, Small-Town New England, 1869-1927, David William Deacon

History - Dissertations

After the Civil War, new technologies and business structures transformed the American economy and society. One area that has received much attention in the antebellum period but much less after the Civil War, is small town New England. In the late 1860s, the introduction of wood pulp paper technology transformed formerly small market and manufacturing communities into centers of heavy industry. This dissertation is a study of this transformation. It focuses on three communities: Bellows Falls, Vermont, Franklin, New Hampshire, and Turners Falls, Massachusetts.

This study examines four broad areas: the historical background of the towns, and townspeople's awareness of …

Community Reclamation: The Hybrid Building, Laura Maynard Aug 2012

Community Reclamation: The Hybrid Building, Laura Maynard

Architecture Theses

Reclamation of a city involves reusing abandoned buildings in conjunction with new construction. These negative spaces of disuse generated by a changing infrastructure are often overlooked or destroyed. If they are instead viewed as positive spaces for reuse, a city’s infrastructure and its residents can adapt and grow.

Recognizing these newly positive spaces produces a chance to examine what social needs of the community are not being met. Pushing the modern concept of the hybrid building creates a unique opportunity; flexibility of use derived from flexibility of space. A community building can best serve the social needs of its residents …

From Confederate Expatriates To New South Neo-Filibusters: Major Edward A. Burke And The Americas, Michael Powers Aug 2012

From Confederate Expatriates To New South Neo-Filibusters: Major Edward A. Burke And The Americas, Michael Powers

All Theses

The traditional historiography of the American South presents the New South creed as a vision emphasizing national reconciliation based upon the advancement of Southern commerce and industry. In addition, scholars broadly define New South spokesmen as men who came to maturity after the Civil War and did not involve themselves in state or national politics. An examination of Major Edward Austin Burke, however, reveals that at least one pivotal New South booster was a Confederate veteran and leading political figure; it also suggests the presence of an international component inherent in the New South paradigm of the 1880s. It is …

Through The Looking Glass: Another Reading Of Willa Cather's The Professor's House, Rebecca H. Bonacchi

English Theses

This project examines Cather’s experimentation with conflicting voices of narrative authority in the presentation of four central female characters in The Professor’s House, using St. Peter and an entity termed the implied narrator as lenses through which we view other characters. The project is broken down into four chapters, each dealing one addressing the central issues involving that specific female character.

Protected Area Governance Conflicts In Ireland - Mending Poor Relations And New Modes Of Governance, Noel Healy Jul 2012

Protected Area Governance Conflicts In Ireland - Mending Poor Relations And New Modes Of Governance, Noel Healy

Noel Healy

Protected area governance concerns the interactions among structures, processes and traditions that determine how power is exercised, how decisions are taken and how citizens or stakeholders have their say (Graham et al., 2003). Over the last few decades, protected area governance has moved away from being a predominantly state-based ‘top-down’ model to a multi-level system under which powers and responsibilities are difused among a diversity of national and local government actors, civil society organisations and local communities management (Lockwood, 2010). Although the 1990s saw the emergence and increasing emphasis on the role of partnerships and collaboration as important elements in …

From The Golden Gate To The Green Mountains: A Hapa Educational Autobiography And Meta-Critical Reflection, Noelle Brassey

Graduate College Dissertations and Theses

As a former UC Berkeley undergraduate and a University of Vermont graduate student, this is an educational autobiography of a self-identified Hapa, or mixed-race Asian American, through the lens of race and identity. Exploring what it means to be “white” and “privileged,” and realizing that these concepts--like identity--are fluid, this thesis adopts a dual methodology that includes personal narrative, as well as a meta-critical reflection. This thesis focuses on three memoirs: Bone Black and Wounds of Passion by bell hooks, and Hunger of Memory by Richard Rodriguez, each of which explore themes of reclaiming voice and reconstructing identity with regards …

Forging The Future: Community Leadership And Economic Change In Coös County, New Hampshire, Michele Dillon Jul 2012

Forging The Future: Community Leadership And Economic Change In Coös County, New Hampshire, Michele Dillon

Carsey School of Public Policy

Author Michele Dillon conducted a case study of community change in Coös County, New Hampshire, for two-and-a-half years (June 2009-December 2011) to investigate how local community leaders in Coös assess the initiatives, challenges, opportunities, and progress in the North Country during this time of economic transition. Her primary data-gathering method included personal interviews with community leaders, supplemented by observation, documentary, and survey data. Dillon discusses how there is a strong consensus among community leaders that Coös needs to work together as a county with a unified vision and voice while respecting the specific character, strengths, and needs of each local …
