The European Court Of Human Rights Ruling Against Britain's Policy Of Keeping Fingerprints & Dna Samples Of Criminal Suspects, K. Michael, Clive Harfield
The European Court Of Human Rights Ruling Against Britain's Policy Of Keeping Fingerprints & Dna Samples Of Criminal Suspects, K. Michael, Clive Harfield
Clive Harfield
In England and Wales, the Police and Criminal Evidence Act 1984 (the PACE) contained powers for the taking of fingerprints, and samples in the form of deoxyribonucleic acid (DNA). In 2001, Section 64(1A) of the PACE was substituted with Section 82 of the Criminal Justice and Police Act. The change to legislation meant that a suspect of a crime would have their fingerprints and samples permanently stored on the police national computer (PNC) even after having been acquitted. This paper critically analyses the circumstances of the landmark case of S. AND MARPER V. THE UNITED KINGDOM in two different contexts …
College Algebra In Context: A Project Incorporating Social Issues, Michael T. Catalano
College Algebra In Context: A Project Incorporating Social Issues, Michael T. Catalano
Numeracy
This paper discusses the development of an innovative college algebra text designed for use in a data-driven, activity-oriented college algebra course, incorporating realistic problem situations emphasizing social and economic issues, including hunger and poverty, energy, and the environment. The course incorporates quantitative literacy themes, is informed by existing college algebra texts within the college algebra reform movement, and implements a collaborative pedagogical approach intended to provide future K-12 teachers an alternative model for the teaching of mathematics. The paper contains a short history of the project development phase, supported by an NSF grant (DUE #0442979), as well as the perceived …

The Mobile Bay Watershed Project: An Experiment In Collaborative Learning About The Social Construction Of Environmental And Natural Resource Problems, Michelle Worosz
Journal of Rural Social Sciences
A collaborative research project was developed for a multidisciplinary class of advanced undergraduate and graduate students enrolled in Sociology of Natural Resources and the Environment. The goals of the project were to determine the feasibility of offering an experiential learning opportunity and to explore its usefulness in enhancing students’ thinking about the social constructedness of natural resource and environmental (NRE) problems. The context was the Mobile Bay watershed, which is the site of a variety of concerns such as land use, pollution, and habitat destruction. To explore these types of problems, students completed a series of assignments including a media …

Snyder V. Louisiana: Continuing The Historical Trend Towards Increased Scrutiny Of Peremptory Challenges, John P. Bringewatt
Snyder V. Louisiana: Continuing The Historical Trend Towards Increased Scrutiny Of Peremptory Challenges, John P. Bringewatt
Michigan Law Review
In March 2008, the Supreme Court decided Snyder v. Louisiana, the latest in the line of progeny of Batson v. Kentucky. This Note demonstrates that Snyder is part of a historical pattern of Supreme Court decisions concerning the use of peremptory challenges in which the Court has moved away from permitting the unfettered use of the peremptory challenge in favor of stronger Equal Protection considerations. Snyder alters the requirements for trial judges in deciding Batson challenges by requiring them to provide some explanation of their reasons for accepting a prosecutor's justification of a peremptory challenge. Snyder is the …

The Obama Administration’S Policy Change Grants Asylum To Battered Women: Female Genital Mutilation Opens The Door For All Victims Of Domestic Violence, David Z. Ma
David Z Ma
ABSTRACT Throughout his Presidential campaign in 2008 and at his inauguration on January 20, 2009, President Obama repeatedly promised the American people one absolute: change. Change would come in many forms, and on April 13, 2009, change came to immigration law and to victims of domestic violence. President Obama’s administration filed a supplemental appeal brief outlining its policies for victims of domestic violence seeking asylum in the U.S. This policy completely reversed the Bush administration’s position on the issue. Yet, how did this change come about? In the preceding decade before President Obama took office, the Board of Immigration Appeals …

Evaluating The School Performance Of Elementary And Middle School Children Of Incarcerated Parents., Melissa F. Neal
Evaluating The School Performance Of Elementary And Middle School Children Of Incarcerated Parents., Melissa F. Neal
Electronic Theses and Dissertations
Children of incarcerated parents are at significantly increased risk of negative long-term outcomes. With about 1% of the adult population incarcerated, the United States has millions of children at risk for these negative outcomes. Research on this population is increasing; however, it is still unclear whether children of incarcerated parents are at an increased risk for poor school performance as a specific result of parental incarceration above that associated with their social and economic status. Because parental incarceration may result in a variety of outcomes that can negatively impact school performance including school mobility, prolonged exposure to stress, and insufficient …

The Missouri Student Survey is based upon the Communities that Care® survey and is administered to students across the state of Missouri every two years. This study examines the reliability and validity of the Missouri Student Survey in a sample of 126,923 students from across the state of Missouri. Judging Genes: Implications Of The Second Generation Of Genetic Tests In The Courtroom, Diane E. Hoffmann, Karen H. Rothenberg
Judging Genes: Implications Of The Second Generation Of Genetic Tests In The Courtroom, Diane E. Hoffmann, Karen H. Rothenberg
Karen H. Rothenberg
The use of DNA tests for identification has revolutionized court proceedings in criminal and paternity cases. Now, requests by litigants to admit or compel a second generation of genetic tests – tests to confirm or predict genetic diseases and conditions – threaten to affect judicial decision-making in many more contexts. Unlike DNA tests for identification, these second generation tests may provide highly personal health and behavioral information about individuals and their relatives and will pose new challenges for trial court judges. This article reports on an original empirical study of how judges analyze these requests and uses the study results …

The Scarlet Gene: Behavioral Genetics, Criminal Law, And Racial And Ethnic Stigma, Karen H. Rothenberg, Alice Wang
Karen H. Rothenberg
Imagine that a scientist from the state university asks you and your family to participate in a study on a particular gene variant associated with alcoholism. The project focuses on your ethnic group, the Tracy Islanders, who have a higher incidence of alcoholism, as well as a higher incidence of the gene variant, than the general population. You will not be informed whether you have the gene variant, but your participation in the study might help scientists develop drugs to help individuals control their addiction to alcohol. You have a family history of alcoholism, and you are concerned that your …

UNL Libraries: Collection Development Policies

While materials from the field of social work (LC subclass HV) may be of interest to the teaching, research and service activities of the entire university community, their primary audiences at UNL are the faculty, staff, and students of the Department of Child, Youth and Family Studies in the College of Education and Human Sciences; the School of Criminology and Criminal Justice (Lincoln Program) in the College of Public Affairs and Community Service; the Department of …
