Participatory Evaluation Of The Tribal Victim Assistance Programs At The Lummi Nation And Passamaquoddy Tribe, Ada Pecos Melton, Michelle Chino

Public Health Faculty Publications

The high rate of crime in American Indian/Alaska Native (AI/AN) communities and/or against AI/AN people reflected in numerous studies in the last three decades, demonstrates the need for victim assistance programs in Indian Country to help victims cope with and heal from violent crime (Wolk 1982; Allen 1985; Sacred Shawl Women’s Society, no date; McIntire 1988; DeBruyn, Lujan & May 1995; Norton & Manson 1995; Fairchild et. al 1998; Greenfield & Smith 1999; Alba, Zieseniss, et al 2003; Perry 2004). The U.S. Department of Justice, Office for Victims of Crime (OVC) became aware of the lack of resources available to …

Does Violent Crime Cause Individuals To Join Gangs?, Colin Hottman May 2009

Does Violent Crime Cause Individuals To Join Gangs?, Colin Hottman

Economics Honors Projects

This paper examines the hypothesis that violent crime causes gang membership. I construct a theoretical model of the individual’s decision to join a gang based on the protection that gang membership provides from violent crime. Using data from the National Longitudinal Survey of Youth 1997 cohort and a probit specification, I test three different measures of the threat of violent crime: a dummy variable for experiencing gun violence, a dummy variable for being the victim of repeated bullying, and a dummy variable for being the victim of a violent crime. In my regressions, I find support for the hypothesis that …

Institutions From Above And Voices From Below: A Comment On Challenges To Group-Conflict Resolution And Reconciliation, Laurel E. Fletcher Apr 2009

Institutions From Above And Voices From Below: A Comment On Challenges To Group-Conflict Resolution And Reconciliation, Laurel E. Fletcher

Law and Contemporary Problems

Fletcher explores how assumptions about justice have succeeded in establishing a new international consensus on necessary processes of rebuilding societies, some pitfalls of this approach, and recommendations for new directions for the field of transitional justice. A central assumption animating the moral, political, and legal cases for transitional justice is that those responsible for unleashing and conducting mass violence that devastates countries and the lives of civilian residents should not get away with their criminal acts. And further, supporters of justice assume that a legal response is necessary in order to promote reconciliation. He thinks that the appropriate role of …

Intergenerational Transmission Of Abuse Of Incarcerated Fathers: A Study Of The Measurement Of Abuse, Jeremy Ball Mar 2009

Intergenerational Transmission Of Abuse Of Incarcerated Fathers: A Study Of The Measurement Of Abuse, Jeremy Ball

Criminal Justice Faculty Publications and Presentations

Research on the intergenerational transmission of abuse hypothesis often only examined the existence of abuse. The current study utilizes retrospective recalls of incarcerated male defendants (N = 414), using questions formulated from the modified Conflict Tactics Scales (Straus, 1974). Five logistic regression models are ran, representing a different physical abuse measure, including incidence of physical abuse, severity of physical abuse, and three composite measures: total frequency, total severity, and total frequency/severity. Although social desirability is a limitation in any study relying on self-report data, the comparison of the chi-square (x2) values of each model may give indication …

Deconstructing The Psychopath: A Critical Discursive Analysis, Cary H. Federman, Dave Holmes, Jean Daniel Jacob

Department of Justice Studies Faculty Scholarship and Creative Works

She loved accidents: any mention of an animal run over, a man cut to pieces by a train, was bound to make her rush to the spot. The spectacle of the wounded body has always had its lurid attractions. Coverage of serial killings and graphic accounts of brutal murders by various media is part of our “spectacular” culture fascinated by violence and brutality. The television is often the site where private desire and public fantasy meet, and where the fascination regarding dangerous offenders is initiated and nurtured (Knox, 17–18; Lesser). The convening of the public around scenes of violence represents …

Risk And Resilience: Crime And Violence Prevention In Aboriginal Communities, Ross Homel, Robyn Lincoln, Bruce Herd Feb 2009

Risk And Resilience: Crime And Violence Prevention In Aboriginal Communities, Ross Homel, Robyn Lincoln, Bruce Herd

Robyn Lincoln

Developmental prevention involves the manipulation of multiple risk and protective factors early in developmental pathways that lead to offending, often at transition points between life phases. The emphasis is not just on individuals but also their social contexts. Risk and protective factors for crime and violence in Aboriginal communities include such standard factors as child abuse, school failure and supportive family environments, but additional factors arise from unique aspects of Aboriginal history, culture and social structure. This paper draws on existing literature, interviews with urban Aboriginal community workers, and data from the Sibling Study to delineate those interrelated risk factors …

The Unconstitutionality, Ineffectiveness, And Alternatives Of Gang Injunctions, Thomas A. Myers Jan 2009

The Unconstitutionality, Ineffectiveness, And Alternatives Of Gang Injunctions, Thomas A. Myers

Michigan Journal of Race and Law

Gang violence across America puts in jeopardy the peace and tranquility of neighborhoods. Cities are challenged to keep their communities safe from gang violence. One common way in which cities attempt to combat violent gang activity is by using gang injunctions. Gang injunctions are court orders that prohibit gang members from conducting already-illegal activities such as vandalism, loitering, and use or possession of illegal drugs or weapons within a defined area. These injunctions, however, also prohibit otherwise legal activity such as associating with others within the restricted area of the injunction, using words or hand gestures, and wearing certain clothing. …

Reflections On Capital Punishment, Rob Warden Jan 2009

Reflections On Capital Punishment, Rob Warden

Northwestern Journal of Law & Social Policy

Authored by the Executive Director of the Center on Wrongful Convictions, this powerful article reviews the many different arguments against the death penalty and uses a multitude of case discussions to show how the death penalty works, not in theory, but in practice. Some of these arguments include: the death penalty does not have a demonstrable deterrent effect; it costs more to maintain the system than to imprison murderers for life; many wrongfully condemned defendants have been saved by the serendipitous discovery of evidence not available during trial; innocent persons have been executed; the death penalty has been applied in …

Reconciliation in Divided Societies: Finding Common Ground. By Erin Daly and Jeremy Sarkin. Philadelphia: University of Pennsylvania Press, 2007.

Healing is widely seen as an essential component of socio-political reconciliation, helping to promote a more peaceable future after violent conflict. At the same time, however, little is known about what exactly “healing” means to traumatized people and whether particular reconciliation efforts do indeed constitute healing. Instead, social healing is described usually in metaphorical terms, compared to the way …

Combating Violence & Abuse Of People With Disabilities: A Call To Action, Nancy M. Fitzsimons

MSU Authors Collection

Violence and abuse of people with disabilities is a widespread problem. This is the one book that empowers everyone - professionals, families, and self-advocates alike - to stop abuse before it starts and empower people with disabilities to fight back. In clear and straightforward language, abuse prevention educator Nancy Fitzsimons calls readers to action and gives them the no-nonsense guidance they need to help people with a wide range of disabilities learn concrete ways to arm themselves against violence and abuse; identify situations that might make a person vulnerable to violence or abuse; recognize the indicators of physical assault, sexual …

The Interaction Between Gender And Risky Lifestyles On Predicting Violent Victimization: A Test Of The Chivalry, Convergence And Evil Woman Hypotheses, Jennifer Elizabeth Angela Reynolds Jan 2009

The Interaction Between Gender And Risky Lifestyles On Predicting Violent Victimization: A Test Of The Chivalry, Convergence And Evil Woman Hypotheses, Jennifer Elizabeth Angela Reynolds

Digitized Theses

This thesis explores the interaction between risky lifestyle behaviours and gender in predicting violent victimization. Using a combination of routine activity theory (Cohen and Felson 1979) and lifestyle theory (Hindelang et al. 1978) and 'doing gender' literature, the chivalry hypothesis, convergence hypothesis and the evil woman hypothesis are examined. Prior research suggests that individuals with high-risk lifestyles are prone to violent victimization. In this thesis, I utilize the General Social Survey on Victimization (2004) and employ a series of logistic regressions to examine how gender and high-risk lifestyles interact to predict personal victimization. The chivalry hypothesis, convergence hypothesis and the …

Campus Violence: Understanding The Extraordinary Through The Ordinary, Nancy Chi Cantalupo Jan 2009

Campus Violence: Understanding The Extraordinary Through The Ordinary, Nancy Chi Cantalupo

Georgetown Law Faculty Publications and Other Works

Recent mass shootings on college campuses have focused many on the responsibilities of colleges and universities to prevent and respond to such violence. However, in statistical terms, this type of campus violence can thankfully be considered relatively extraordinary. In contrast, the only type of campus violence that is unfortunately common enough to be characterized as “ordinary” is peer sexual assault and similar forms of campus gender-based violence. Accordingly, this essay explores the scope and dynamics of both “ordinary” and “extraordinary” campus violence, discusses the law and “best practices” dealing with peer sexual violence victims’ rights and the due process rights …

The Effects Of Different Forms Of Risk Communication On Judicial Decision Making, Richard E. Redding, John Dolores Dec 2008

The Effects Of Different Forms Of Risk Communication On Judicial Decision Making, Richard E. Redding, John Dolores

Richard E. Redding

When mental health experts provide information to courts on the results of a risk assessment conducted on a defendant or patient, they engage in “risk communication.” We examined the effects of four different forms of risk communication (prediction, categorical, risk factors/risk management, or hybrid) on judges’ (n = 253) perceptions of risk assessment evidence introduced in a case where they must decide whether to release from the hospital an individual found not guilty by reason of insanity. Judges who received information in the risk factors/risk management form were more likely to release the patient than were those who received prediction …
