The definition of domestic violence is broad and includes physical as well as psychological and sexual abuse. The legal system, however, gives considerably less attention to these latter forms of abuse. One reason for the relative neglect of these types of domestic abuse is the assumption that physical abuse causes more harm than do psychological and sexual abuse. In reality these forms of abuse may have a far greater impact on their victims. Apart from physical abuse, greater attention must be given to those who suffer on-going psychological and sexual abuse at the hand of a spouse or intimate partner. …

Body And Soul: Equality, Pregnancy, And The Unitary Right To Abortion, Jennifer S. Hendricks

This Article explores equality-based arguments for abortion rights, revealing both their necessity and their pitfalls. It first uses the narrowness of the “health exception” to abortion regulations to show why equality arguments are needed—because our legal tradition's conception of liberty is based on male experience, and we have no theory of basic human rights grounded in women's reproductive experiences. Next, however, the Article shows that equality arguments, although necessary, can undermine women's reproductive freedom because they require that pregnancy and abortion be analogized to male experiences. This project used primary historical documents from the Jessie A. Ackermann collection at ETSU's Archives of Appalachia, other books and documents from the temperance period, and recent scholarship on the subjects of temperance, suffrage, and women travelers and civilizers. As the second world missionary for the Woman's Christian Temperance Union, Ackermann traveled in order to establish WCT Unions and worked as a civilizer, feminist, and reporter of the conditions of women and the disadvantaged throughout the world.

This article suggests that the international trend toward supporting legal autonomy from state control for indigenous communities under the guise of “self-determination,” as embodied in the recently enacted Declaration on the Rights of Indigenous Peoples, has created a manifest legal conflict within the body of international human rights laws between the rights of individuals and the new concept of collective group rights. The article highlights one indigenous woman’s recent struggle in Mexico to assert her right to participate in a local election contrary to her tribe’s customary law forbidding women to do so, in order to illustrate the potential human …

Her Last Words: Dying Declarations And Modern Confrontation Jurisprudence, Aviva A. Orenstein

Dying declarations have taken on increased importance since the Supreme Court indicated that even if testimonial, they may present a unique exception to its new confrontation jurisprudence. Starting with Crawford v. Washington in 2004, the Court has developed strict rules concerning the use of testimonial statements made by unavailable declarants. Generally, testimonial statements (those made with the expectation that they will be used to prosecute the accused) may be admitted only if they were previously subject to cross examination. The only exceptions appear to be dying declarations and forfeiture by wrongdoing if the accused intentionally rendered the declarant unavailable.

This thesis compares how Lilian Ngoyi of South Africa and Fannie Lou Hamer of the United States crafted political identities and assumed powerful leadership, respectively, in struggles against racial oppression via the African National Congress and the Student Non-Violent Coordinating Committee. The study asserts that Ngoyi and Hamer used alternative sources of personal power which arose from their location in the intersecting social categories of culture, gender and class. These categories challenge traditional disciplinary boundaries and complicate any analysis of political economy, state power relations and black liberation studies which minimize the contributions of women. Restructuring the Labor Market to Democratize the Public Forum makes the provocative argument that the identities we construct in the labor market prevent us from creating a democratic public forum. The labor market, where we spend most of our time as adults, wields tremendous influence over our identities, yet its influences are deeply undemocratic. Employers work to create hierarchy and ideological conformity – through many mechanisms, including sex-based pay scales and stereotypes – rather than to promote equality and ideological diversity. This study assessed how women's perceptions of emotional and material social support affect their completion of residential drug treatment. Although previous research has examined how social support affects recovery, few studies, if any, have examined both the types and the sources of social support. The study hypothesized that women's perceptions of the emotional and material social support they receive from family, friends, partners, drug treatment, child welfare, and welfare agencies will affect treatment completion. Because the government has historically enacted laws criminalizing abortion to preserve traditional stereotypes regarding a woman's domestic and subordinate position in society,22 abortion regulations necessitate an Equal Protection Clause analysis. [...] this article will examine first how Gonzales and Glucksberg forecast Roe's now inevitable demise, and accordingly, why abortion regulations must now be evaluated under an Equal Protection Clause analysis- in place of the crumbling Due Process Clause framework.23 Finally, this article will explain how and why the Partial Birth Abortion Act of 2003 violates the Equal Protection Clause of the Fourteenth Amendment.

The Pakistani Constitution extends protection to an impressive catalog of fundamental rights, placing Pakistan in line with some of the most western-minded constitutional regimes in the world.3 At the same time, in contrast to the American-style constitutional commitment to separate church and state,4 the Pakistani regime is constitutionally committed to integrate the two, in the sense that all laws must conform to the injunctions of Islam as a condition of their constitutional validity.5 So the same Constitution that protects western fundamental rights also elevates Islamic law, a …

“Boadicea Onstage Before 1800, A Theatrical And Colonial History.” Studies In English Literature 1500-1900 49.3 (Summer 2009): 595-614., Wendy Nielsen

This essay examines the theatrical legacy of Boadicea, the British warrior queen defeated by the Romans around 61 AD, in three plays: John Fletcher's "The Tragedy of Bonduca, or the British Heroine" and two unrelated dramas titled "Boadicea" by Charles Hopkins and Richard Glover. Performance histories attempt to explain why audiences respond to Boadicea with ambivalence. Each production underplays the defeated queen and gives starring roles to one or more of her daughters and a male lead, who contrast with Boadicea's supposed brutality and provide British audiences with lessons about ways to rule in an ostensibly civilized fashion.

This paper argues that microfinance initiatives are an attractive aid mechanism to promote gender equality in Muslim countries because such initiatives both alleviate poverty and provide women with economic empowerment without violating Muslim customary banking laws. By promoting female entrepreneurship, microfinance initiatives are, perhaps, the most effective means of achieving the Millennium Development goal of gender equality without upsetting the Islamic governments or the prospective borrowers.

The ideology of choice, embedded in the pro-choice, anti-abortion debate in the United States, is founded on Enlightenment notions that take the autonomous individual with perfect knowledge and rationality as the unit of analysis. The basic premise is that each woman 'chooses' from a variety of equally accessible options. Hidden in the political language of choice are the constraints all women face as they attempt to negotiate reproduction, especially if they wish to end a pregnancy. This study examines the flexibility of Quaker women's roles in their domestic, sacred, and secular communities. It traces the experiences of a group of Philadelphia Quaker wives and mothers who were forced to support their families when revolutionary authorities arrested and banished their husbands to Virginia during the American Revolution. First, it investigates Quaker women's duties in their households and suggests that gendered responsibilities overlapped significantly for eighteenth-century Quaker men and women. By considering the Quaker husband-wife relationship and the Quaker parent-child relationship, one may conclude that Quaker gendered tasks were not rigid. Chapter Three proposes the idea that Quaker …

This is a research about effectiveness of businesswomen leadership in four different ethnic groups in Indonesia. The effectiveness is measured in a condition where the leadership is supported by several factors, such as intrapersonal skills, interpersonal skills and culture. In an effort to more fully understand the experiences and aftermath of girlhood and adult woman physical, sexual and psychological victimization, research was undertaken that explored the prevalence and the consequences of such victimization, and the survival strategies women activate at various points in their lifespan in the aftermath of that violence. Women participants were recruited from five different communities; three urban, one rural and the only correctional facility for women in a Midwestern state. Spanish director Julio Medem’s visually stunning yet controversial 2007 film Chaotic Ana was panned for its ostensibly Manichaean treatment of gender relations and its crudely scatological ending, both of which have distracted attention from the work’s fascinating incursions into global politics. While the film’s complex layering of hawk and dove imagery figures centuries of male violence against women, it is also imbricated with an extended meditation on the divergent roles of the United States and Spain on the contemporary world stage. As the Italian thirst for excellence and knowledge burgeoned throughout the Quattrocento, the genre of instructional literature responded accordingly to social demands. Offering advice on a wide range of experience from the quotidian to the extraordinary, from superstition to scientific, conduct manuals appealed to readers of all Italian social classes. Investigating the relationship between this body of literature and the lives of contemporary women, this paper will focus specifically on those manuals which prescribe behaviors for women, and will investigate the reception of these precepts and the extent in which these notions informed and transformed women's lives.

We employed participatory, community-based research methods to explore the perceptions of home among women who are homeless. Twenty women engaged in one or more techniques including qualitative interviews, digital story telling, creative writing, photovoice, and design charrette to characterize their perceptions of home. Analysis of the data revealed themes related to the physical, affective, and external environment. By understanding how participants perceive home and the qualities they deem necessary for home, we can begin to construct home from both a service and design perspective that meets womens needs for stable, safe housing and home, and also gain a better understanding …
