Suicide, Law And Morality, Edward Rubin
Suicide, Law And Morality, Edward Rubin
Edward Rubin
Dear Editors,
The enclosed article argues that blanket prohibitions against assisted suicide are unconstitutional. This position has been advanced by a number of commentators, who have generally based their argument on the so-called right to die. From a constitutional perspective, however, this right can only be grounded on either substantive due process or the right of privacy, that is, the penumbra of the first eight amendments. While the argument isn’t necessarily wrong, it suffers from its reliance on aggressive and controversial interpretations of the constitutional text.
The position this article advances is that prohibitions against assisted suicide violate the First …

Coinfection with hepatitis C virus (HCV) and HIV is an increasingly recognized clinical dilemma, particularly since the advent of highly active antiretroviral therapy. Several studies of this population have demonstrated both more rapid progression of liver disease and poorer overall prognosis compared to HCV monoinfected patients. Consensus guidelines, based primarily on the results of 4 major randomized trials, recommend treatment with peginterferon and ribavirin for 48 weeks in coinfected patients. However, this current standard of care is associated with lower response rates to therapy than those seen in monoinfected patients. Important predictors of response include HCV genotype, pretreatment HCV RNA …

Etiological Characterization Of Emergency Department Acute Poisoning, Abdmalek S. Khlifi
USF Tampa Graduate Theses and Dissertations
Poisoning is frequently associated with psychological and physiological co-morbidities that can be assessed in order to improve patients' management and reduce cost. The primary objective of this study is to conduct a review of emergency department (ED) poisonings to characterize its demographics and assess associated co-morbidities. The second objective is to explore correlation between personal history of diseases and poisonings. Predictors for poisonings and its outcomes were investigated and risk factors for suicidal poisoning and how it relates to mental illnesses were explored. Six hundred and forty nine cases admitted to ED between 2004 and 2007 were studied. Results indicate …
Do Community Factors Influence Suicide? An Application Of Strucutral Pluralism Theory On Suicide Cases, Rosa Giovanna Nigro
Do Community Factors Influence Suicide? An Application Of Strucutral Pluralism Theory On Suicide Cases, Rosa Giovanna Nigro
Theses and Dissertations
Suicide and suicidal behavior affect individuals of all ages, genders, races and religious groups in all countries, representing an important social issue. The major risk factor associated with suicide is depression. However, in some instances, suicide is not preceded by warning signs of mental disorders. Variations in the sociopolitical structures in the communities in U.S. may hold the explanation of variations on suicide rates. The objective of this study is to understand how suicide relates with variations in the community structure. Some specific socio-structural elements of a community have the potential to protect against distress by protecting individuals’ socio-psychological health. …

Is There A Duty?: Limiting College And University Liability For Student Suicide, Susanna G. Dyer
Is There A Duty?: Limiting College And University Liability For Student Suicide, Susanna G. Dyer
Michigan Law Review
This Note argues that nonclinician administrators employed by institutions of higher education do not have a special relationship with their students such that they have a duty to act with reasonable care to prevent a foreseeable student suicide. Courts that have in recent years ruled to the contrary have done so by incorrectly basing their duty-of-care analysis on foreseeability of harm alone. With an eye toward a proper duty-of-care analysis, this Note analyzes multiple factors to reach its conclusion, including the ideal relationship between colleges and their students and the burden on and capability of colleges to protect their students …

Suicides Among Farmers In Three Southeastern States, 1990-1998, Steven R. Browning, Susan C. Westneat, Robert H. Mcknight
Epidemiology and Environmental Health Faculty Publications
Several studies have documented higher rates of suicide among farmers in comparison to other occupational groups, both in the U.S. and internationally. The purpose of this study is to describe the epidemiology of farmer suicides in three southeastern states (Kentucky, North Carolina, and South Carolina) during the nine-year period 1990-1998. Electronic death certificate data were obtained from the National Center for Health Statistics. Over the nine-year period, there were 590 deaths related to suicide (E-codes: 950-959) among farmers (occupation codes: 473, 474, 475, 477, and 479) in the states of Kentucky, North Carolina, and South Carolina. The results of this …
Institutes Of Higher Education, Safety Swords, And Privacy Shields: Reconciling Ferpa And The Common Law, Stephanie D. Humphries
Institutes Of Higher Education, Safety Swords, And Privacy Shields: Reconciling Ferpa And The Common Law, Stephanie D. Humphries
Stephanie D Humphries
In light of the Virginia Tech shootings, this Note argues that both FERPA and the common law contain internal tensions regarding safety and privacy that neither Congress nor the courts have adequately reconciled, and that important discrepancies regarding information sharing exist between IHEs' practices, the common law's demands, and FERPA's limitations.
Part I provides background on FERPA and argues that FERPA's emergency exception is too narrow and confusing, so that IHEs default to the nondisclosure option rather than disclosing information to third parties, such as parents, when students threaten to harm themselves or others. At the same time, FERPA's tax …

The Quasi-Confessional Autobiography: Mort D'Un Silence, By Clémence Boulouque, Jane E. Evans
The Quasi-Confessional Autobiography: Mort D'Un Silence, By Clémence Boulouque, Jane E. Evans
Jane E. Evans
Since 2003, when Clémence Boulouque's memoir, Mort d'un silence, was published, its author has written in a variety of genres, including novels, articles, and film scripts. Mort d'un silence, her first autobiographical work, interests the reader for several reasons: it revisits Judge Gilles Boulouque's suicide in December 1990 and the consequences of this act for his family, especially his thirteen-year-old daughter, Clémence; it recalls the political climate in France during the late 1980s, when Gilles Boulouque had already begun to fight terrorism; and it illustrates the tension between disclosure and concealment as its twenty-six-year-old narrator describes her passage …
A Gift Worth Dying For?: Debating The Volitional Nature Of Suicide In The Law Of Personal Property, Adam J. Macleod
A Gift Worth Dying For?: Debating The Volitional Nature Of Suicide In The Law Of Personal Property, Adam J. Macleod
Faculty Articles
Suicide poses difficult and foundational problems for the law. Those who most highly value personal autonomy, those who believe in the inviolability of human life, and those who remain uncommitted on end-of-life issues, all must settle challenging questions about suicide before advancing upon the more complex terrain of physician-assisted suicide, euthanasia, and infanticide. And the way in which a society fashions legal responses to suicidal choices reveals much about the society's cultural commitments and legal assumptions.
The bodies of insurance law, tort, and health care law are also among those areas of the law in which lawmakers reserve special exceptions …
Treating Suicidality In African American Adolescents With Cognitive-Behavioral Therapy, Curtis E. Bryant, Jeanette Harder
Treating Suicidality In African American Adolescents With Cognitive-Behavioral Therapy, Curtis E. Bryant, Jeanette Harder
Social Work Faculty Publications
Methods for preventing adolescent suicide are surveyed, and cognitive-behavioral therapy (CBT) is explored as a method for serving suicidal African American adolescents. Strengths, limitations, and compatibility of CBT with social work values are examined. Although CBT shows much promise in helping suicidal African American adolescents, research on the efficacy and effectiveness of CBT with this population is lacking. Suicide risk and protective factors and social inequities are evaluated as they relate to African American adolescents generally. In addition to relieving suicidal symptoms, CBT potentially could facilitate social liberation for this population.

Hope Theory: A Framework For Understanding The Relation Between Childhood Maltreatment And Adult Suicidal Action, Parveen Kaur Grewal-Sandhu
Hope Theory: A Framework For Understanding The Relation Between Childhood Maltreatment And Adult Suicidal Action, Parveen Kaur Grewal-Sandhu
Electronic Theses and Dissertations
This study was designed to increase our understanding of the mechanisms underlying the link between childhood maltreatment and suicidality in adulthood using the theoretical framework of Hope Theory (Snyder, 1991). Two hundred university students between the ages of 18 and 60 took part in the study. One hundred participants were pre-selected for having suicidal behaviour histories and 100 participants were pre-selected for having no previous suicidal behaviours. In total, 34 males and 166 females participated in groups of five to ten. The following measures were administered to all participants in the same order: Hope Scale (HS; Snyder et al.,1991); Beck …
