Ubi Jus, Ibi Remedium: The Fundamental Right To A Remedy Under Due Process, Tracy A. Thomas Nov 2004

Ubi Jus, Ibi Remedium: The Fundamental Right To A Remedy Under Due Process, Tracy A. Thomas

San Diego Law Review

This essay is part of the 2003 Remedies Forum symposium comprised of international remedies scholars addressing the topic of equitable relief in the fifty years since Brown v. Board of Education. It may be true as other scholars have argued that since the time of Brown, institutional defendants have won at the expense of plaintiffs. Defendants have learned that delay and defiance work. The U.S. Supreme Court has adopted a standard for ordering equitable relief that significantly defers to defendant wrongdoers at the plaintiffs' expense. Epithets of activist courts and judicial legislation have colored the existing scholarship and portrayed remedial …

School Funding Litigation: Who's Winning The War?, John Dayton, Anne Proffitt Dupre

Scholarly Works

This Article examines how the landscape of school funding litigation has changed over the three decades since Serrano and Rodriguez. The first part of the Article sets forth the history of school funding litigation since Serrano and Rodriguez and unravels the legal theories that have driven the school financing cases, explaining past dispositions and point out likely future trends. At first blush it would appear that the attorneys seeking social change through greater equity in school funding are litigating similar issues in each state. Yet judges have approached these matters from different directions with results that vary significantly from state …

Improving Instructional Practice: The Value Of Classroom Goal Teams As Measured By Elementary Teachers' Perceptions, Debra J.Easton Rodenburg

Student Work

Student achievement is in the forefront of education as never before. Educators, parents, business leaders, community members, and politicians are all actively watching reports of student achievement. Wong (2003) found in more than 200 studies, the only way to improve student achievement is with a knowledgeable and skillful teacher. The expertise of a teacher is a critical variable in effecting student achievement (Marzano, 2003). In this study, Classroom Goals Team Project (CGTP) was utilized as a professional development program to bring about improvements in teaching and learning in an effort to positively impact student achievement. The CGTP, implemented in a …

Instructional Methods And Efficacy Of Teachers Trained In Differentiated Instruction, Patricia A. Crum

Student Work

This study examined the instructional methods and efficacy of teachers involved in a two-part district staff development project in differentiated instruction. Responses from 194 kindergarten through twelfth grade teachers on a self-perception survey were collected after an initial district staff training and implementation and again after involvement in a second teacher centered district staff development plan in differentiated instruction with implementation time. The data collected were analyzed to determine what instructional methods and efficacy the staff displayed and to determine whether a change in teachers' perceptions occurred during the 9-month period following the second district plan.

Active Learning (4): Is Cooperative/Collaborative Learning A Self-Less Pursuit?, Pandeli M. Glavanis Dr. Oct 2004

Active Learning (4): Is Cooperative/Collaborative Learning A Self-Less Pursuit?, Pandeli M. Glavanis Dr.

Faculty Journal Articles

The immediate answer to the question is a very definite and emphatic NO. In fact the rest of this short essay will argue that as all forms of social cooperation are based on some type of self-interest thus, cooperative/collaborative learning is also anything but altruistic. Nevertheless, I will also argue that it is precisely because self-interest is embedded in all forms of cooperative/collaborative learning that it enables this style of learning to lead to an interactive and constructivist approach to learning, i.e. active learning. The logic of the argument once again derives from established social theory and in particular the …

The History Of Federal And Cooperative Animal Damage Control, Donald W. Hawthorne

Sheep and Goat Research Journal

The predecessor of the Wildlife Services program within the U.S. Department of Agriculture, Animal and Plant Health Inspection Service, was founded by C. Hart Merriam in 1885 with a Congressional appropriation of $5,000. These funds were used to organize a Section of Economic Ornithology as part of the Entomology Division of USDA. Merriam immediately hired longtime friend A. K. Fisher to be his assistant and the two shared a clerk. The new Section proved to be so popular with farmers and politicians that the Congress created a separate Division of Economic Ornithology and Mammalogy in 1886. The Commissioner of Agriculture …

Active Learning (3): Three Easy Pieces, Aziza Ellozy Dr. Oct 2004

Active Learning (3): Three Easy Pieces, Aziza Ellozy Dr.

Faculty Journal Articles

One of the most common obstacles in introducing active learning in the classroom, is the perception that it takes away from the lecture. The typical 40+ contact hours that a professor has with his/her students during a semester are usually considered to be barely enough to cover the “content” of the course. Yet thanks to excellent classroom research (McKeachie et al., 1990) we know a great deal about how learning happens, and not much of it will be happening in the classroom unless students are actively engaged.
