In the wake of substantial trade liberalization in the world economy over the last two decades and growing environmental consciousness, the issues of the impacts of international goods trade and foreign direct investment (FDI) on local and global environment are becoming increasingly contentious. Whilst trade and FDI have been said to bring higher incomes and well-being for all, these are seen to act as "magnifiers" of environmental deterioration - especially in the developing countries. The Supply And Demand Sides Of Judicial Policy-Making (Or, Why Be So Positive About The Judicialization Of Politics?), Cornell W. Clayton

Law and Contemporary Problems

A major reason that many people are intensely interested in who sits on the Supreme Court is that legal decisions can have great influence on the effectuation or frustration of political objectives. Clayton does not view the trend toward the "judicialization" of politics as necessarily antithetical to democratic values because Court decisions are within the mainstream of contemporary political values and electoral preferences.

Munger comments on John Ferejohn's recent article in which Ferejohn examines some key issues raised by the exercise of legislative power by the judicial branch. Ferejohn claims that Americans have chosen to accept the judicialization of politics, leaving the courts the option of exercising power inappropriately. Munger argues that while the courts do have power, they forebear from exercising it for long periods of time.

Levinson examines the Supreme Court's decision in "Bush v. Gore" as an entry-point into understanding American constitutional culture. "Law," as people ordinarily think of it, may be much less important than people might believe (or hope) with regard to controlling politics. But "law" in another way may have Americans gripped within a constitutional iron cage that makes it next to impossible to engage in a cogent discussion of what might ail contemporary American polity and, concomitantly, what might be needed by way of reforms.

Since WWII there has been a profound shift in power away from legislatures and toward courts and other legal institutions around the world. It is no surprise that appointments to both the US Supreme Court and to other federal courts have become partisan political issues. Ferejohn argues that what is at stake, institutionally, is the allocation of legislative power--the power to establish general rules of prospective application.

Lupia argues that the suggestions of those who advocate deliberative democracy to incorporate more and more law-like precepts into politics will not achieve the ultimate ambition of deliberative theory, which is to have the resolution of disputes turn on nothing but the force of the better argument. Lupia discusses mechanisms to build civic competence by creating conditions in which the better argument has an improved change of winning the battle.

Deliberative democracy is one of the most discussed contemporary political theories. Schroeder argues that its central claim can be understood as the claim that politics needs to become more like law. While specific recommendations to make specific decision processes more deliberative are fair, the attempt to efface the distinctively non-lawlike attributes of politics entirely cannot withstand scrutiny.

The April 11 coup against Venezuelan President Hugo Chavez has had serious consequences for Cuba as coup leaders abruptly stopped scheduled shipments of oil to Cuba. Shipments did not resume after the collapse of the short-lived coup regime.Under an October 2000 agreement (Programa de Cooperacion Energetica), the Venezuelan state oil company Petroleos de Venezuela (PDVSA) was to ship 193 million barrels per year of crude and various derivatives for five years . Cuba agreed to pay up to 75% in 90 days and the balance was to be financed over 15 years.The agreement originally allowed Cuba to pay part of …

Almost The Same, But Not Quite: Re-Orienting The Story Of The Subject In Christina Fernández Cubas's El Año De Gracia , Jessica A. Folkart

Studies in 20th & 21st Century Literature

Cristina Fernández Cubas's novel El año de Gracia (1985), about a young Spaniard who is shipwrecked on a deserted island with only a mangy shepherd for company, evokes the political dialectics of self/other found in the European's discovery and conquest of an unknown island in Robinson Crusoe. In Fernández Cubas's literary depiction of the European subject, however, she situates him on the margins of power in order to view the dynamic from a different perspective. The postcolonial theorizations of Edward Said and Homi Bhabha inform this analysis of how Fernández Cubas's castaway is at first overpowered by the other …

Recent strands of western historical writing understand gender in medieval Islamic societies through any of number of local cultural, religious and political discourses. This type of writing shifts the focus of historical research away from questions regarding whether Islam debases or improves the status of women--questions that tend to immobilize the subject in a polemic of competing essentialisms-and instead finds gender as having been produced in historically dynamic local processes. The political satirists Jon Stewart and Stephen Colbert are largely celebrated for their nightly television programs, which use humor to offer useful political information, provide important forums for deliberation and debate, and serve as sites for alternative interpretations of political reality. Yet, when the two satirists more directly intervene in the field of politics—which they increasingly do—they are often met by a chorus of criticism that suggests they have improperly crossed normative boundaries. A key measure of the democratic quality of a political community is how its members vote. The design and implementation of voting arrangements can illuminate the nature, purposes, and even potential of a community of citizens. Voting is, at the very least, used to sort out and implement preferences. Voting processes help in sorting out winners from losers and thereby provide a presumptively fair method for the implementation of public policy.
