The case discussed in this Note is surely one of the most important cases rendered by the Israeli High Court of Justice (hereinafter, HCJ) regarding judicial review of administrative acts performed by a Military Commander (hereinafter, MC) in areas subject to belligerent occupation based on a legal analysis of international humanitarian law (the Fourth Geneva Convention). The Court's ruling on the matter in question highlighted the fact that, while State Courts in other countries continue to refrain from putting measures undertaken by MCs of their respective armed forces under legal scrutiny, the HCJ sustains a longstanding tradition of such scrutiny; …

The author reviews the history of Hizballah since its inception in 1982, and examines its role in the recent political turmoil of Lebanon and the region. Not only is Hizballah's role central in the dispute over the Sheb'a Farms enclave between Lebanon and Israel, it is part of an entangled set of linkages involving Syria, Iran, the United States, the European Union, and the Palestinians. The challenge that Hizballah poses to U.S. policy in the Middle East involves complicated strategic issues, not merely problems of terrorism that could be dealt with by countermeasures.

The author considers the critical questions of U.S. military presence in the Gulf, the challenges it faces, and the prospects that lay ahead. He relies, in his presentation and analysis, on a variety of regional sources including newspaper reports and personal interviews conducted in the United States and the Gulf region, as well as government and academic sources. The result is a comprehensive study, including policy recommendations for U.S. military and civilian decisionmakers that makes intelligible the complex subject of U.S.-Gulf relations.

"Originality" After The Dead Sea Scrolls Decision: Implications For The American Law Of Copyright, Urzula Tempska

Ms. Tempska examines the Israel Supreme Court's ruling on August 31, 2002 regarding reconstruction and copyright infringement of the Dead Sea Scrolls. She reviews the copyrightability doctrine and its possible misapplications, illustrates the reconstruction process of the text involving the Dead Sea Scrolls, and describes the legal arguments and procedure of the Dead Sea Scrolls case. Tempska concludes that: 1) the arguments opposing copyright protection fail because they gloss over the facts of the reconstruction process and disregard the originality requirement for copyrightability under United States law; 2) the Israeli court's copyrightability analyses adequately accounted for the creative process, the …

This Article examines the role of courts in controlling state violence in the United States and Israel. The Author considers how U.S. federal courts should respond to illegal state violence by comparing a U.S. Supreme Court case, "City of Los Angeles v. Lyons", with a case decided by the Supreme Court of Israel, Public Committee Against Torture in Israel v. Israel. Part II highlights the legal issues that were central to each court in reaching a decision, including standing, the scope of equitable discretion to craft remedies, and baseline attitudes towards illegal government action. Through Assyria's Eyes: Israel's Relationship With Judah, Tammi J. Schneider

The goal of the Bible was not to record history, and the text does not shy away from theological explanations for events. Given this problematic relationship between sacred interpretation and historical accuracy, historians welcomed the discovery of ancient Assyrian cuneiform documents that refer to people and places mentioned in the Bible. Discovered in the 19th century, these historical records are now being used by scholars to corroborate and augment the biblical text, especially the Bible’s “historical books” of Kings. This field for comparison complements the recent trend among biblical scholars of using new interpretative methodologies and archaeology to question some …
