Imposing Punitive Damage Liability On The Intoxicated Driver, Martin Kotler

This Article explores the traditional justification for the imposition of punitive damage liability in the context of drunk driving. Though courts have increasingly found such damages to be available in the appropriate case, neither the deterrence nor punishment rationales can be justified in the absence of widespread public awareness that specific conduct has the potential to result in liability. Criminal sanction, therefore, better serves to accomplish the intended purposes.

Larval Parasitism Of Psilocorsis Spp. (Lepidoptera: Oecophoridae), Leaftiers Of Central Missouri Oaks, J. Pasek, W. Kearby

Larval parasitism of 3 Psilocorsis species in central Missouri forests averaged 22% for the years 1977-1979. Twenty-three species of parasitoids were reared in the laboratory from the larvae collected. Seventeen species emerged from P. reflexella Clemens, 14 from P. quercicella Clemens, and 10 from P. cryptolechiella (Chambers). The most abundant parasitoids were the braconids Apanteles n. sp., Agathis calcarata (Cresson), and A. cincta (Cresson); the eulophid Elachertus proteoteratis Howard; the ichneumonid Diadegma psilocorsis Walley; and the 3 closely related pteromalids, Perilampus fulvicornis Ashmead, P. prothoracicus Smulyan, and P. n. sp. Elachertus proteoteratis was reared only from P. reflexella. Twenty-three new …

This study analyzes juvenile delinquency and reformatory education issues in the People's Republic of China, Taiwan and Hong Kong. For each case, the literature concerning juvenile delinquency is reviewed and specific institutional policies are discussed. The evidence presented in the study is based upon primary and secondary source documentation, as well as field work and interviews conducted in each region in 1992 and 1983. The study’s three hypotheses argue that stigma is conferred upon both offenders and their family members, institutional policies can be categorized as non-rational when one compares stated goals with observable polices, and that formal educational organizations …

Let H be a completely distributive lattice and hence a Heyting algebra. Goguen's category of fuzzy sets Set(H) Eytan's logos Fuz(H) and the topos of sheaves on H, Sh(H), are interconnected by pairs of adjoint functors between them. Each of the categories has a predicate calculus. These predicate calculi are related through the functors between the categories. Change of base lattice gives rise to several functors which preserve or reflect specific kinds of statements in the predicate calculi. Predicting The Proton Mass From Pi-Pi-Scattering Data, Jf Donoghue, E Golowich, Br Holstein

We relate experimental information on ππ scattering to tree-level effective chiral Lagrangians. The result is of a form similar to that used in Skyrme-type models of the proton, where the nucleons are described as topologically stable solitons of the chiral fields. In such models, one can express the proton mass in terms of measured scattering data, with the result Mp=880±300 MeV. We interpret this as a consistency test for the Skyrme models.

The bulk of the critical study of Gustavo Bècquer's leyendas has dealt with the thematics, stylistics, or the folkloric motifs and origins of the individual works. Surprisingly little attention has been given to the structure or the narrative techniques used in the leyendas as a whole. The purpose of this study is to examine these structural and narrative aspects from a folkloric perspective in order to better appreciate Bècquer's blending of popular and literary art forms.

The National Supported Work Demonstration, Hollister Robinson, Peter Kemper, Rebecca Maynard

In this edited work, leading social scientists examine the intent, design, and administration of the Supported Work Demonstration programs in 10 cities, serving large numbers of long-term welfare recipients, ex-addicts, ex-offenders and young school dropouts. Eligible individuals were randomly assigned to the offer of the supported employment experience or to a business as usual control condition. The study samples were followed for up to three years following enrollment. The findings are synthesized through a comprehensive benefit-cost analysis.

This Article will address the most significant issues that arise under call-in pay and reporting pay clauses. After discussing in general the different situations covered by the two types of guarantee clauses, the Article will address problems concerning the application and calculation of pay under a call-in provision. The following sections examine qualification for reporting pay, the interpretation of contractual exceptions to the guarantee, and management's obligation to notify employees not to report if it wishes to avoid liability under a guaranteed pay clause.
