More surrogacy contracts are fulfilled in the United States than in any other country (Bromfield, 2016, p. 193). In 2014, there were approximately 2,000 surrogacy arrangements in the U.S., yet the market is totally unregulated (Shellnutt and Grizzle, 2018, p. 31). Given that 1 in 6 American couples face infertility, there will continue to be a demand for alternative and assisted reproductive options (Shellnutt and Grizzle, 2018, p. 34). This paper seeks to explore several areas of surrogacy, including contract enforcement, potential problems parties in surrogacy agreements face, current legislation, the role of religion in surrogacy, and specific case studies. …

The Online Criminal Trial As A Public Trial, Stephen Smith

There are two ways of favorably conceiving online trials in Sixth Amendment terms. One is that an online trial is a public trial, by its terms. The other is that an online trial may not be public, for Sixth Amendment purposes, but may nonetheless satisfy applicable constitutional demands for trials considered “closed.” This Essay proposes both: that an online trial is fundamentally “public” for Sixth Amendment purposes and, if it is not, it may still be a constitutional accommodation of the Sixth Amendment’s public trial guarantee, in appropriate circumstances.

Delinquent youths oft en do not receive the opportunity to be mentored. Th is is especially true for youths who have committed serious law violations or are detained for multiple law violations. In the United States, youths with the most serious off enses are oft en committed to detention, or rehabilitation, or treatment centers. Since 2011, the Juvenile Reentry Mentoring Project (JRMP) has matched mentors to youths detained in Nebraska Detention, and Treatment Facilities. An Experimental Test Of The Impact Of Varying Questionnaire Response Format On Prevalence Rates For Sexual Violence Victimization And Perpetration, Raeann E. Anderson, Kelly Cuccolo

Objective: This study examined the impact of a dichotomous versus scaled response format on prevalence rates of sexual violence perpetration and victimization, thus conceptually replicating Hamby et al., 2006 and extending those findings to the context of sexual violence.

Methods: Two samples were recruited from Amazon Mechanical Turk and were randomly assigned to either a dichotomous or scaled response format of the same questionnaire. Sample 1 was used to examine perpetration and received a perpetration specific version of the Post-Refusal Sexual Persistence Scale (PRSPS). Sample 2 was used to examine victimization and received a victimization specific version of the PRSPS. …

The important questions laid out by the Appeals Chamber in this case highlight the need for the proper delineation and interplay between mental illness and criminal responsibility under international law. Specifically, this case represents a watershed moment for the Appeals Chamber to set a framework for adjudicating mental illness in the context of collectivized child abuse and trauma. This is especially true for former child soldiers who occupy both a victim and alleged perpetrator status.

Mind-reading is no longer a concept confined to the world of science-fiction: "Brain reading technologies are rapidly being developed in a number of neuroscience fields." One obvious application is to the field of criminal justice: Mind-reading technology can potentially aid investigators in assessing critical legal questions such as guilt, legal insanity, and the risk of recidivism. Two current techniques have received the most scholarly attention for their potential in aiding interrogators in determining guilt: brain-based lie detection and brain-based memory detection. Purpose

The purpose of this study is to describe the evolution of fraud schemes with historically conducted with fiat money in physical space to the crypto-assets in digital space as follows: ransomware, price manipulation, pump and dump schemes, misrepresentation, spoofing and Ponzi Schemes. To explain how fraud schemes have evolved alongside digital asset markets, this study applies the space transition theory.

Empirical research on public policy preferences must attend to Whites’ animus toward Blacks. For a quarter-century, studies have consistently found that Kinder and Sanders’s four-item measure of “racial resentment” is a robust predictor of almost every social and criminal justice policy opinion. Racial animus increases Whites’ opposition to social welfare policies that benefit Blacks and their support for punitive policies that disadvantage this “outgroup.” Any public opinion study that fails to include racial resentment risks omitted variable bias. The main objective of this research is study of impact of the prison library services on prisoners’ spiritual well-being. Descriptive survey method was adopted and four null hypotheses were tested to achieve the main objective. A research questionnaire was used to collect data on the sampled 80 prisoners. Result indicated that information needs, accessibility to library information resources and utilization of library information resources are very critical ingredients in determining the spiritual well-being of prisoners. There was significant relationship between: spiritual well-being and utilization of library information resources (r=0.660; (p=0.000) ≤0.05), accessibility to library information resources by prisoner (r=0.341; (p=0.016) …

Background: Exposure to opioids, preoperatively or during surgery, is a significant risk factor for developing opioid addiction and may increase the risk of acute tolerance and chronic use. More specifically, spinal lumbar surgery is associated with increased opioid requirements to counter associated pain secondary to lumbar manipulation. Currently, there is a lack of studies that exemplify the anesthetist’s role in minimizing narcotic use while effectively managing pain for this patient-specific population. Dexmedetomidine, an alpha-2 agonist, administered as a continuous infusion, has been shown to reduce opioid consumption in spinal lumbar surgery patients.

Abolition Constitutionalism And Non-Reformist Reform: The Case For Ending Pretrial Detention, René Reyes

The prison abolition movement encompasses a range of objectives and perspectives. While dismantling the carceral system may be the ultimate goal, incremental steps can be an important component of this long-term project. This Essay makes a case for the constitutional elimination of pretrial detention as one part of an incremental abolitionist agenda. The analysis pays particular attention to the Massachusetts Supreme Judicial Court’s recent decision in Commonwealth v. Lougee, which illustrates some of the ways in which the COVID-19 crisis has exacerbated preexisting injustices and inequities in the pretrial detention system.
