Terrorism Should Not Be A Crime: How Political Labels Are Dangerous To American Democracy, Abigail S. Grand Oct 2024

Terrorism Should Not Be A Crime: How Political Labels Are Dangerous To American Democracy, Abigail S. Grand

William & Mary Journal of Race, Gender, and Social Justice

This Note calls for a dismantling of the United States’ current method of prosecuting terrorism, rejecting the “terrorism” label as a mechanism for charging crimes. Prosecutors should instead charge individuals in terrorism cases for their underlying criminal actions rather than rely on material support statutes and political innuendos to secure a conviction. By examining the implications of the terrorism label in post-9/11 America, this Note addresses how a moral panic enabled the executive branch to overstep its constitutional restraints and threatened the delicate balance of powers central to American democracy. Next, it proposes, as many have before, that Article III …

Guns, Bombs, And Pollution: Unraveling The Nexus Between Warfare, Terrorism, And Ecological Devastation In Iraq, Hogr Tarkhani

The Journal of Social Encounters

Iraq's environment has experienced significant pollution and degradation, earning it the dubious distinction of being one of the most polluted and degraded regions globally, according to the Globe Pollution Review. The past three decades of armed conflict have exacted a heavy toll on the country, resulting in widespread human suffering, including countless fatalities, injuries, and a massive displacement of people. Amidst this death and destruction, the ecosystem has also endured severe damage, and its decline carries long-lasting implications.

The environmental crisis in Iraq has been worsened by the presence of extremist groups such as the Islamic State (ISIS) and various …

Piercing The Shield Of U.C.C. Article 4a: Estate Of Levin V. Wells Fargo Bank’S, Implications For Terrorism Victims’ Attachment Of Blocked Electronic Wire Transfers Originating From State Sponsors Of Terrorism, Olivia Lu

University of Miami Business Law Review

This Piece examines how ambiguity in the property interests that would be subject to attachment under section 201 of the Terrorism Risk Insurance Act (“TRIA”) and section 1610(g) of the Foreign Sovereign Immunities Act (“FSIA”) has affected efforts by victims of terrorism to fulfill their monetary judgments, especially in light of courts’ use of Article 4A of the Uniform Commercial Code to fill the definitional gap. This Piece focuses on a recent D.C. Circuit decision, Estate of Levin v. Wells Fargo Bank, N.A., analyzing its implications for terrorism victims holding monetary judgments to attach blocked electronic funds transfers (“EFTs”) originating …

Is Islam A Religion Of Peace?, Robert Greer Jan 2024

Is Islam A Religion Of Peace?, Robert Greer

Eleutheria: John W. Rawlings School of Divinity Academic Journal

One of the most troubling and controversial doctrines in Islam is that of jihad. Yet, in the West its meaning is unclear. Does it mean the struggle of the human soul to develop a wholesome spirituality, or is it more a struggle that results in terrorist attacks upon all who oppose Islam? Many politicians and academics in the West, along with many journalists and opinion-makers in the mainstream media insist that Islam, rightly understood, is a religion of peace. That means that Islamic jihadists who engage in wanton terrorism upon all who stand in their way are an aberration. They …

Ideological Parameters For Deradicalization Programs To Measure Changes In Terrorist Ideology In Indonesia, Yudi Zulfahri, Aldi Nur Fadil Auliya

Journal of Terrorism Studies

The paper analyzes the inefficiency of the Deradicalization strategy implemented by The National Counter Terrorism Agency (BNPT), causing the issue of recidivist terrorism in Indonesia. Although the occurrence of recidivism is common in various crimes, it poses unique challenges in terrorism cases, given that the government has allocated a specific budget and established a special agency, BNPT, to tackle terrorism-related issues. The high recidivism rate in terrorism cases has prompted public concern and criticism regarding the effectiveness of Deradicalization programs. Despite the ongoing debate, this paper argues that the success or failure of Deradicalization programs cannot be measured simply by …

Mass Media As Weapons In Contending Terrorism In Nigeria, Enakeno Victoria Oju Nov 2023

Mass Media As Weapons In Contending Terrorism In Nigeria, Enakeno Victoria Oju

International Review of Humanities Studies

Terrorism has been of global concern in recent times. The problem is not only a great challenge and a threat to the security and stability of a nation; it hampers overall growth and development. In spite of government’s counter-terrorism interventions and responses, as well as interventions from other nations and bodies, the issue of terrorism in Nigeria appears to be rising, which calls for more holistic approaches in tackling the menace. This study is an attempt to contribute to the ongoing interventions to combat the current challenge of terrorism, particularly the Boko Haram insurgency in Nigeria. The paper, therefore, attempts …

Chemicals And Creeds: Cbrn Weapon Use And Religious-Based Terrorism, Nikolai Apilado Nov 2023

Chemicals And Creeds: Cbrn Weapon Use And Religious-Based Terrorism, Nikolai Apilado

Governance: The Political Science Journal at UNLV

General theories of terrorism typically focus on economic, social, or political factors that lead to terrorist acts. Conversely, chemical, biological, radiational, and nuclear (CBRN) weapons are rarely spoken of in academic literature. Yet, these weapons are still used by terrorists in some capacity. In this paper, I argue that religion is the primary factor that influences terrorists to pursue CBRN weapons as opposed to more secular-based terrorists. This is due to the fact that religious-based terrorists are not concerned with preserving their reputation or credibility among society, as well as being so blinded by their religion that they are willing …

Claremont-UC Undergraduate Research Conference on the European Union

Françafrique refers to the complex system of political, economic, and military relationships between France and its former colonies in Africa, characterized by neocolonialism, paternalism, and corruption. This paper aims to analyze the history and future of French geopolitical activity in Africa, including its motivations, strategies, and impacts. We first establish the background of France’s complex relationship with Africa, beginning with French colonialism in the region and decolonization. Next, we look at the period of close ties France maintained with most of its former colonies in Africa throughout the late 1900s. Additionally, we discuss the effects on French and American geopolitical …

Like Treating The Symptom Rather Than The Cause - The Omission Of Courses Over Terrorism In Nsa Designated Institutions, Ida L. Oesteraas Oct 2023

Like Treating The Symptom Rather Than The Cause - The Omission Of Courses Over Terrorism In Nsa Designated Institutions, Ida L. Oesteraas

Journal of Cybersecurity Education, Research and Practice

The National Security Agency (NSA) awards Center of Academic Excellence (CAE) designations to institutions that commit to producing cybersecurity professionals who will work in careers that reduce vulnerabilities in our national infrastructure. A review of the curricula in the 327 institutions and their degree programs reveal that only two programs offer a required course about terrorism. Given the fluid nature of terrorism and its threat to national infrastructure, the omission is concerning. It is recommended that NSA-certified cybersecurity programs begin implementing educational content that aim to teach about this emerging crime and justice issue. One suggestion is to embrace the …

Migration And Terrorism In Europe: A Nexus Of Two Crises, Shreya Sinha Jun 2023

Migration And Terrorism In Europe: A Nexus Of Two Crises, Shreya Sinha

International Journal on Responsibility

The migration surge into the borders of the European Union has become a major problem in Europe as it has led to several challenges to societal integration and political legitimacy. It is also a danger to cultural identity, domestic and labour market stability as well as internal security, such that a migrant is often perceived as a threat to European society. The first part of the paper attempts to throw light on this migration-security nexus in Europe and how migration has developed into a security issue. The second part discusses how the two crises of migration and terrorism have come …

The impact of terrorism is different in developed and developing countries, according to many economists. But what leads to variation in the consequences of terrorism among two developing countries? This paper takes into account two developing countries from two different continents and quantifies the impact of terrorism on GDP per capita. The data is extracted and arranged from the Global Terrorism Index (Humanity, n.d.) for India and Egypt from the years 1975-2018 and 1977-2018, respectively. A set of statistical analyses using the OLS and Newey-West method is used to examine the relationship between the variables. For India, an act of …

Why Islamism Failed In Syria, Ararat Kostanian

Journal of Terrorism Studies

The Arab Spring has not fulfilled the desires of millions of demonstrators in Middle East. The desires to see the expanded role of the civil society has been muted by the Islamists and particularly by the Muslim Brotherhood. The Article puts the focus on the failure of Islamism in Syria during the uprising for several reasons, such as the inability of the Muslim Brotherhood to shape a new leadership, and its rejectionist agenda that had nurtured skepticism by the opposition factions. Furthermore, the Syrian Muslim Brotherhood had been unable to change its political motivation and kept insisted on shifting the …

Regarding the response to the change in status or terminology of the Free Papua Movement or Organisasi Papua Merdeka (OPM) to the Separatist Terrorist Group. DU Undergraduate Research Journal Archive

This paper intended to dissect the similarities and differences of media coverage for a very significant recent event--the 2017 Charlottesville "Unite the Right" riots and anti-racism protests. A focal moment within this series of events is the car attack by perpetrator James Alex Fields Jr., a white-supremacist responsible for the death of one woman and countless other injuries. The analysis reflects the coverage of this event through the lens of MSNBC and Fox News, two politically contrasting domestic news sources. An emphasis on media framing, which is loosely how media is manipulated to make the consumer think about a certain …

Activist Extremist Terrorist Traitor, J. Richard Broughton Mar 2023

Activist Extremist Terrorist Traitor, J. Richard Broughton

St. John's Law Review

(Excerpt)

Abraham Lincoln had a way of capturing, rhetorically, the national ethos. The “house divided.” “Right makes might” at Cooper Union. Gettysburg’s “last full measure of devotion” and the “new birth of freedom.” The “mystic chords of memory” and the “better angels of our nature.” “[M]alice toward none,” “charity for all,” and “firmness in the right.” But Lincoln not only evaluated America’s character; he also understood the fragility of those things upon which the success of the American constitutional experiment depended, and the consequences when the national ethos was in crisis. Perhaps no Lincoln speech better examines the threats to …

One Treaty To Apply Them All? Defining Maritime Terrorism By Cross-References And Reservations: The Asean Region Example, Arron N. Honniball

International Law Studies

Defining terms will shape a State’s treaty obligations, the domestic legislation necessary, the availability of cooperative mechanisms, and norm diffusion. Maritime terrorism is an umbrella term referring to the piecemeal approach of treaties creating offenses for identified acts at sea. Further treaties cross-reference the offenses in a selection of global instruments to create related offenses. This includes financing of terrorism (Convention for the Suppression of the Financing of Terrorism (ICSFT)) and regional maritime terrorism (ASEAN Convention on Counter Terrorism (ACCT)). All cross-referenced instruments shall apply to define ICFST or ACCT offenses unless a State excludes, by reservation, a cross-referenced instrument …

Typing A Terrorist Attack: Using Tools From The War On Terror To Fight The War On Ransomware, Jake C. Porath Jan 2023

Typing A Terrorist Attack: Using Tools From The War On Terror To Fight The War On Ransomware, Jake C. Porath

Pepperdine Law Review

The United States faces a grave challenge in its fight against cyberattacks from abroad. Chief among the foreign cyber threats comes from a finite number of “ransomware-as-a-service” gangs, which are responsible for extorting billions of dollars from American citizens and companies annually. Prosecuting these cybercriminals has proven exceedingly difficult. Law enforcement often struggles to forensically trace ransomware attacks, which makes identifying and prosecuting the perpetrators challenging. Moreover, even when prosecutors can identify the perpetrators of these attacks, the ransomware gangs are headquartered in foreign adversarial nations that do not extradite criminals to the United States. Finally, ransomware gangs are governed …

Long Live Joint Criminal Enterprise: With A Particular Reference To Tadić’S Interactive Construction Between “The Beast” And Specific Direction, Miguel Ângelo Loureiro Manero De Lemos

San Diego International Law Journal

The idea that Joint Criminal Enterprise, in particular its extended version, contravenes fundamental principles of criminal law has gained track. Thus, not only did the International Criminal Court distance itself from the construct but, today, the widely held view is that the extended version should be discarded, not least because it is not grounded in customary international law. This Article challenges that view. While addressing scholarly criticism towards Joint Criminal Enterprise, and demonstrating why the “beast” is a solid construction, it argues that prosecutors and judges must look past the written provisions of the Statute of the International Criminal Court …

Bureaucratic Resistance And The Challenge Of Implementing Asean Our Eyes: Case Study Of Jolo Church Bombing 2019, Chaula Rininta Anindya

Global: Jurnal Politik Internasional

Understanding Terrorism: An Alternative View And The Painful Truth: How Powerful Nations Legitimize Terrorism, Kwame B. Antwi-Boasiako, Cindy P. Davis

Journal of Terrorism Studies

Despite human beings’ noble achievements on this planet including medicine, technology, physics, and chemistry, there is one characteristic of humans, which is disturbing and that act is “committing extreme cruelty and violence against its own species” (Smith 2007:41). This cruelty by human beings against themselves stems from many factors including power, ideology, religion, and terrorism. These categorizations, as Smith (2011) noted, are unfortunately used to dehumanize the other through societal definitions where one group, the powerful, sees itself as the paragons of civilization against the other, the weak, as barbarians. Terrorism, racism, ideology, and religion are but some of the …

Developing An Equilibrium Of Protection Of The Right To Privacy And National Security In Terrorism Eradication In Indonesia, Wahyudi Djafar, Muhamad Syauqillah

Journal of Terrorism Studies

Tension between privacy and security is nothing new, however due to the development of information and communication technology use as well as more intensive efforts of terrorism eradication have affected to the increasing level of the conflict. The need for national security is often similar to the situation of state of emergency, which enables the state to conduct several limitations to the implementation of right to privacy. Many states use the said justification and further position the element of national security to be in the superior position compared to the protection of civil liberties, including right to privacy. As …

Terrorism Violence: Assessing The Impact Of Education Programs Through Mass Media On The Adoption Of Security Measures In Burkina Faso, Marie Madeleine Ouoba, Emmanuel Lompo

Journal of Terrorism Studies

This paper investigates the impact of mass media education programs (MEP) on the adoption of security measures in the context of terrorism in Burkina Faso. We collected information using questionnaires and key informant interviews in Ouagadougou, Burkina Faso. The results suggest that individuals who were educated on terrorism through MEP display higher intentions to adopt security measures and tend to have positive attitudes toward the role of media in fighting terrorism violence.
