Beyond The Lines: Exploring The Impact Of Adverse Childhood Experiences On Ncaa Student-Athlete Health, Braden J. Brown, Jakob J. Jensen, Jennifer L. Hodgson, Alexander M. Schoemann, Damon L. Rappleyea
Journal of Issues in Intercollegiate Athletics
Emerging research has highlighted a link between adverse childhood experiences (ACEs) and various health concerns experienced by NCAA student-athletes. Building on prior work (Kaier, Cromer, Davis, & Strunk, 2015), we hypothesized that ACEs would significantly predict student- athletes’ biopsychosocial (BPS) health and that spirituality would serve as a protective factor against the effect of ACEs on BPS health outcomes. Division I, II, and III NCAA student-athletes (N = 477) representing 20 sports across 53 universities completed an online quantitative survey (k = 133) that assessed for ACEs, injury/physical health concerns, anxiety, depression, stress, social support, substance use, and spirituality. Ncaa Enactment Of A Disciplinary Policy: Uniformity To Regain Institutional Legitimacy, Matteson Landau

This article examines issues surrounding decentralized disciplinary systems and inconsistent enforcement against student-athletes who engage in criminal misconduct across the National Collegiate Athletic Association (“NCAA”). The NCAA recognizes the inherent conflicts of interest that arise when institutions are left to regulate their own recruiting practices. To negate these conflicts, the NCAA has established a robust disciplinary system, the NCAA Committee on Infractions, which oversees investigations into violations of NCAA Bylaws, reviews materials provided by the athlete and/or institution, and issues binding rulings which may include suspensions and fines. Yet the NCAA fails to see how the same conflict issues arise …

Student Athlete Or Student Employee? Considering The Future Implications Of Recent College-Athletics Decisions Regarding Employee Classification, Nathan Schmutz, Joseph Hanks

Nature often provides warning signs of oncoming danger. For example, a generally recognized phenomenon associated with a tidal wave caused by an oceanic earthquake is the major withdrawal of water resembling an extreme low tide. Universities take note, a similar phenomenon might be occurring in relation to college sports. Recent decisions might be signaling a receding of waters before a surge of litigation that results in college athletes being considered employees of the university. This paper considers recent court and administrative decisions that might be indicative of this major shift and discusses possible implications of such a change.

This Note explores the evolution of the amateur status in college athletics, particularly the absence of a consistent definition for “amateur collegiate athlete” by the NCAA over the years. The traditional demarcation between amateur and professional athletes blurred significantly, particularly with the exponential growth of college football revenues, leading to indistinguishable time commitments for both categories. The landmark case of NCAA v. Alston marked a pivotal moment as the Supreme Court ruled in favor of allowing college athletes to earn compensation for the use of their name, image, and likeness ("NIL"). The Making Of Modern-Day Nil Laws: The Past, Present, And Future Of Amateurism And Commercialization In College Sport, W. Andrew Czekanski, Amanda Siegrist
Journal of Issues in Intercollegiate Athletics
The purpose of this study was to increase the understanding of state laws governing collegiate student-athletes’ name, image, and likeness (NIL) rights and place the laws within the framework of the NCAA’s historic and current views on amateurism and commercialization. To accomplish such, a content analysis of the 30 existing NIL laws/executive orders was performed to identify trends in the statutes and establish what commonalities and differences exist across states. The analysis found five themes/sections common across state laws (i.e., definitions, basic NIL rules, limitations, disclosures and review processes, agent and representation rules, and required workshops). Due to COVID-19, in the spring of 2020, the NCAA gave scholarship athletes an extra year of eligibility but did not increase the number of scholarships a school could issue. This potentially led to increased competition for scholarships as coaches could choose between retaining athletes or recruiting new ones. Furthermore, the Spring 2020 track and field season for high school seniors ended early – limiting high school athletes’ chance to get their best scores, and interrupting student to college interaction. This note proposes a multifaceted approach for congressional intervention in the NIL market. While there are many areas needing NIL regulation in the collegiate athletic market, the most critical area of need for NIL regulation involves the collectives and directives. These entities have formed and operated without any meaningful guardrails since the NCAA permitted student-athletes to be compensated for their NIL. Additionally, they have been able to influence recruiting both at the high school recruit level and in the collegiate athlete transfer portal.

Due to the pervasiveness of athletic role engulfment and a salient athletic identity, collegiate athletes often experience difficulties upon conclusion of their competitive athletic career. Such engulfment and fixed athletic identity are detrimental to an athlete’s post-athletic transition. Given the role of athletic department institutional members (e.g., administrators, coaches, staff) in the formative development of collegiate athletes’ lives, athletic departments occupy an integral position to assist athletes in their post-athletic transition.
