Privacy Or Safety? The Use Of Cameras To Combat Special Ed Abuse, Sarah M. Benites
Privacy Or Safety? The Use Of Cameras To Combat Special Ed Abuse, Sarah M. Benites
University of Massachusetts Law Review
Self-contained classroom students face abuse from educators at disproportionate rates compared to general education students. To combat the abuse, several jurisdictions, including Massachusetts, have proposed or enacted bills enabling cameras to be placed in self-contained classrooms. This has sparked privacy concerns, particularly regarding whether the usage would amount to an infringement on the Fourth Amendment rights of students and educators. This note argues that surveillance is an ineffective deterrent to prevent violent and abusive behavior and should not justify bypassing potential privacy and constitutional violations. It outlines the relevant case law regarding students and teachers and apply these standards to …

Censorship Of Family Violence In Cinema In Iran, Atefeh Batyari
Censorship Of Family Violence In Cinema In Iran, Atefeh Batyari
Dignity: A Journal of Analysis of Exploitation and Violence
Prevention and control of family violence require an accurate understanding of its causes and effects. Iranian filmmakers try to fulfil their mission to raise awareness about family violence by showing hidden and unpleasant social issues in the family and presenting an accurate picture of family violence. However, to do so is taboo and goes against the Islamization policy of the Iranian regime against portraying family violence. Breaking the taboo leads to the seizure and censorship of films that show negative perspectives of family relationships. This article analyzes the Iranian regime’s approach to film productions based on Islamization policies and investigates …
A Look Back In Time: Analyzing The Success And Value Of The 2014 Amendments To Rule 2a-7 And Reporting On Form N-Cr In Light Of The March 2020 Market Events, Jocelyn Near
Catholic University Law Review
Money market funds have frequently been a target of regulation by the Securities and Exchange Commission (“SEC”). Perhaps the most expansive regulation came as a response to the 2008 financial crisis, in which the Reserve Primary Fund “broke the buck.” The SEC’s misguided 2014 reforms exacerbated the inherent risks of money market funds, including the risk of runs and first mover advantage, particularly with the implementation of Form N-CR. Form N-CR requires a money market fund to publicly report when various events occur, including when a retail or government money market fund’s current net asset value per share deviates downward …
Parks And Separation: How The Mississippi Legislature Decided Just Compensation In Bay Point Properties, Inc. V. Mississippi Transportation Commission, Kyle Usner
Mississippi College Law Review
At first glance, Bay Point comes across as the standard, run-of-the-mill eminent domain case: the government contracts with a citizen for an express easement over privately-owned land limited to a certain use; the government then exceeds the scope of that easement, resulting in a taking. Governmental taking is usually not anything outside of the norm. But with a potential seven billion dollars' worth of federally funded highway projects destined for Mississippi highway only a Presidential signature away from being approved, this decision is not one Mississippi landowners should ignore. Further, the crux of Bay Point lies with an issue of …

Conflict, Resistance, And Resolve: Uncovering Lost Narratives In Japanese-American Internment, Hannah De Oliveira
Conflict, Resistance, And Resolve: Uncovering Lost Narratives In Japanese-American Internment, Hannah De Oliveira
Swarthmore Undergraduate History Journal
By the end of 1942, the U.S. army and the national government had forcibly removed 120,000 Japanese descended individuals from their homes on the West Coast, confining them to ten internment camps across the nation. In an effort to construct a more accurate representation of the mindset of internees in the wartime era, my thesis hones in on conflict and division within camp life. I emphasize the heterogeneity of Japanese-American voices and push back against the oversimplification of the different internee subgroups: the Japan-born immigrants (“Issei”), U.S.-born citizens (“Nisei”), and Japan-educated Nisei who returned home before the war (“Kibei”). Throughout …

Reshaping Government’S Fiduciary Role Under The 1992 Constitution Of Ghana, Rose Rameau, Abdul Baasit Aziz Bamba
Dickinson Law Review (2017-Present)
In Ghana and across many African States, the people—through the instrumentality of law or their respective Constitutions— have constituted their presidents trustees of the natural resources to be held in trust for the benefit of the people. With a few exceptions, mineral resource governance in Africa has been horrendous: Many African States have failed to leverage their natural resource endowments as a catalyst for much-needed socioeconomic development.
This Article analyzes the 1992 Constitution of the Republic of Ghana which provides that all public lands and natural resources in Ghana shall be vested in the President on behalf of, and in …

The Technology, Organization, And Environment Framework For Social Media Analytics In Government: The Cases Of South Africa And Germany, Brenda M. Scholtz, Khulekani Yakobi
The African Journal of Information Systems
This paper investigates factors influencing the adoption of social media analytics (SMA) for citizen relationship management (CzRM). Three real-world cases of government departments, two in South Africa and one in Germany, were investigated, and focus group discussions were conducted. The technological, organizational, and environmental (TOE) theory and qualitative content analysis guided the data analysis. The findings revealed that in all cases, staff usually conducted a manual analysis of social media and SMA had not been implemented sufficiently to realize its full potential. Insights were obtained from TOE and factors were identified that should be considered for improving the planning of …
A Lutheran Perspective On Righteousness In China, Futao (Gary) Liu
A Lutheran Perspective On Righteousness In China, Futao (Gary) Liu
Grapho : Concordia Seminary Student Journal
The recent history of China cannot get away from the impact of western thoughts and industrialization, including Democracy, Marxism, Republicanism, etc. For two millienium or so, the Chinese philosopher, Confucius (551–479 BCE), had dominated Chinese society through his philosophy (commonly called Confucianism) in every respect, from the hierarchical structures of governments and states to familial relations. Confucianism met its real challenge only in the recent history of China. At the collasping edge of the last feudal society (the Qing Dynasty which fell in 1911), patriotic Confucians had tried to bring what is useful of the West into traditional values and …

Intelligence Operations Conducted On Martin Luther King Jr. And His Loose Morals: The Changing Motivations For His Surveillance, Haley D. North Ms.
Madison Historical Review
The United States intelligence community took great pride in producing insightful intelligence for the protection of threats to their nation and its citizens. However, the government's intentions for surveillance under their administrations can be questioned when analyzing the individual governmental agendas for conducting surveillance against American citizens. One American consecutive administration targeted in particular was Martin Luther King Jr. Throughout Marin Luther King Jr.’s public career there was a constant effort on the part of the government to conduct surveillance of his every move. The National Security Agency’s (NSA) justification under project MINARET for the surveillance of King was claimed …

Can A Christian Be A Lawyer Or Can Both God And Jackson Browne Be Right, Randy Lee
Can A Christian Be A Lawyer Or Can Both God And Jackson Browne Be Right, Randy Lee
Touro Law Review
Jesus’s final command at His final meal before His death was to “love one another.” No less than Jackson Browne insisted that the ultimate absurdity in an absurd world is a “lawyer in love.” Thus, Jesus has commanded that even lawyers must love, but Jackson Browne has emphatically stressed that lawyers are incapable of love. Given the apparent conflict for lawyers between these two observations of Jesus and Jackson Browne, one might wonder whether one can be a Christian and a lawyer both. Can both God and Jackson Browne be right? Of course, the government could seemingly make the answer …

Implementasi Peraturan Daerah Dalam Otonomi Daerah Menjadi Salah Satu Parameter Good Governance, Ananda Rayhana Putri
"Dharmasisya” Jurnal Program Magister Hukum FHUI
Regional Regulation as one of the regional legal products is something inherent with the Regional Autonomy system. This is a consequence of the regional autonomy system itself which is based on independence and is not a form of freedom of an independent government unit. Independence itself means that the Region has the right to regulate and manage the domestic affairs of its own government. The authority to regulate here means that the region has the right to make legal decisions in the form of laws and regulations. In forming a region it is not easy because it requires sufficient knowledge …

Features Of The Demise Of The Theory Of Sovereign Acts In The Field Of Judicial Review Over Enforcement Of International Treaties, Sofiane Abdelli Judge
مجلة جامعة الإمارات للبحوث القانونية UAEU LAW JOURNAL
The theory of Sovereign Acts (acts of state) is a real departure from the principle of legitimacy and the state's submission to the law. The French Council of State invented this theory only to protect its existence and competence from the government's reaction on the eve of the return of the monarchy, it was only to fortify some of its acts from its control and to courtesy the government through its rulings.
However, the orientations of the State Council in its early stages have known many transformations, especially in the area of limiting the effects of the implementation of that …

The Promise And The Peril: Artificial Intelligence And Employment Discrimination, Keith E. Sonderling, Bradford J. Kelley, Lance Casimir
University of Miami Law Review
Artificial intelligence (“AI”) is undeniably transforming the workplace, though many implications remain unknown. Employers increasingly rely on algorithms to determine who gets interviewed, hired, promoted, developed, disciplined, or fired. If appropriately designed and applied, AI promises to help workers find their most rewarding jobs, match companies with their most valuable and productive employees, and advance diversity, inclusion, and accessibility in the work- place. Notwithstanding its positive impacts, however, AI poses new perils for employment discrimination, especially when designed or used improperly.
This Article examines the interaction between AI and federal employment antidiscrimination law. This Article explores the legal landscape including …

Poverty Implications Of Covid-19 And Government Social Protection Programmes In Nigeria, Adeponle Adeoye, John Lola Okunola, Sunday Fakunle
Journal of Social, Behavioral, and Health Sciences
The sole objective of this paper was to investigate the poverty implications of COVID-19 on Nigerians, relative to the effectiveness of the government’s social protection programs in mitigating the socioeconomic strain caused by the pandemic. The paper used documentary analysis to assess the impact of COVID-19 on Nigerians’ socioeconomic lives and the government’s policy response to the situation. The review found that COVID-19 exacerbated the existing poverty in Nigeria, and most of the government policy programs were not effective in mitigating the effects. We concluded that government policy responses to the socioeconomic strain caused by the pandemic were ineffective due …

Still Standing: Does The Government Ever Waive A Right To Challenge Standing In Fourth Amendment Cases?, Stefanie M. Bowen
Lincoln Memorial University Law Review Archive
While "standing" in Fourth Amendment cases is not a preliminary inquiry, perhaps it should be. When the government fails to object to a defendant's standing to challenge a Fourth Amendment search, there may be an opportunity to renew the objection on appeal. Your outcome is jurisdiction-specific. This article explores the reasons that the Supreme Court should again visit the question of standing with respect to Fourth Amendment searches and eliminate the government's ability to challenge standing for the first time on appeal.
Rage Against The Machine: Reducing Robocall Abuse To Protect At-Risk Consumers, Nicole Egan
Rage Against The Machine: Reducing Robocall Abuse To Protect At-Risk Consumers, Nicole Egan
University of Massachusetts Law Review
For most people, robocalls are nothing more than an annoying side-effect of owning a cell phone today. But a successful robocall scheme is still capable of wreaking financial and psychological havoc on its victims. Senior citizens and cognitively impaired individuals are often targeted by fraudulent phone calls or texts because they may have trouble understanding how to identify and protect themselves from robocall abuse. This Note proposes a collaborative solution to this problem by calling on the judiciary and legislatures to minimize the amount of robocalls received by American telephone consumers. By adopting a broader understanding of the law and …

Fire And Furry: Pets Get Political, Amanda Morgan
Children's Book and Media Review
Politics have gone crazy in the past few years, and these animals are here to tell and show you all about it. Cat-ivists hold signs. A hedgehog laments his small hands. A chihuahua with a doughnut pleads for “Equal bites for all.” After pages of paw-litical puns and adorable animal pictures, a wise owl finishes the book off by telling the reader to “stay woke” in civic and political engagement.

Many of the United States presidents have served their country honorably, but all have made mistakes. This book gives a brief history on every U.S. president, including the things that show they're only human. Thomas Jefferson and John Adams dueled, argued, and name-called for years before becoming friends. John Quincy Adams approved an expedition to find mole people in the center of the earth. William Howard Taft got stuck in a bath tub. Andrew Johnson was the first president to be impeached. William Nixon liked eating cottage cheese with ketchup. Oh yeah, and he was a part of the Watergate …

A Disordered Estate: A Lutheran Approach To Institutional Evils, Christian Dollar
Grapho : Concordia Seminary Student Journal
The question of institutional evils weighs heavily on the mind of the American Zeitgeist. Institutional racism, once happily relegated to history as a relic of Jim Crow, has reentered the public discussion on a national level in a way not seen since the 1960’s Civil Rights Movement. The new virtue of “fair-trade” is lauded as the solution for an exploitive economic system, while “going green” promises absolution of a company’s carbon footprint. The extent of government COVID-19 measures and the debate surrounding the inclusion of critical theories in public education dominate primetime and social media. These are all examples of …
