Traditional Knowledge and Traditional Cultural Expressions are traditional forms of intellectual property that are closely related to copyright within the scope of Intellectual Property Rights (IPR). Among the various types of Expressions of Folklore in Indonesia, traditional music and songs are one of them. Traditional music is music or sound art found in various regions of Indonesia that is born and develops and is passed down from one generation to the next. Traditional music usually uses the language, style, and traditions of the region it originates from. The traditional music of each region has its own characteristics, for example, the …
Medieval Methods: Guido D’Arezzo’S Innovative Approaches To Music Education, Lydia C. Kee
Medieval Methods: Guido D’Arezzo’S Innovative Approaches To Music Education, Lydia C. Kee
Musical Offerings
Music education has been influenced by many people throughout history, but arguably none of them have done so as much as the monk, Guido D’Arezzo. His teaching methods have been embraced and developed by music educators throughout the centuries. For example, it is recorded that Guido was the first to use the five-line staff as we use it today. This was especially groundbreaking in a world of rote memorization. Today it is used globally in music education. The roots of solfege are also found in Guido’s writings; his syllables have been adapted by Zoltan Kodály. Not only that, but John …

The Higher-Cost Problem: How The Case Act Addresses The History Of Inequity In The American Copyright Regime, Michael Newell
The Higher-Cost Problem: How The Case Act Addresses The History Of Inequity In The American Copyright Regime, Michael Newell
University of Miami Law Review
The legislative history of copyright law in the United States and its judicial interpretation resulted in a complex web of statutes and doctrine theoretically meant to further the constitutional goal of “promot[ing] the Progress of Science and the useful Arts.” But because of its complexity, enforcing rights against infringers in federal court became prohibitively expensive for most. The American copyright regime simultaneously allowed the music industry to unfairly profit from the creativity of the under-resourced—particularly, musicians of color.
This Note discusses the disparate impact of the American copyright regime. Then, the Note discusses the Copyright Alternatives in the Small-Claims Enforcement …

Check Your Bank Account First: Examining Copyright Formalities And Remedies Through A Race Conscious Lens, Emma Burri
Check Your Bank Account First: Examining Copyright Formalities And Remedies Through A Race Conscious Lens, Emma Burri
Washington and Lee Journal of Civil Rights and Social Justice
This Note examines copyright formalities through a race conscious lens and concludes that further change is necessary given the legacy of economic inequality that communities of color experience. It examines the history of copyright formalities in the United States and the disenfranchisement of Black musical creators through the theft of their intellectual property. In exploring the relationship between race, wealth, and musical copyright protection this Note explains why considering the economic inequality is relevant to ensure copyright protection for Black creators. This Note proposes abolishing the registration timeline for certain remedies and altering the filing fee structure of the copyright …

Assessing The Effectiveness Of The Mover Program For Treating Attention Deficit In Children (Mover: Movement Opportunities Through Vestibular Engagement Rhythm), Lindsay B. Williams, Camille Skubik-Peplaski
Student Journal of Occupational Therapy
Background: The purpose of this study was to investigate the effects of participation in a movement- to music program on the attention span of elementary school-aged children who have attention deficits. The hypothesis was that participants would demonstrate improved attention on the Test of Sustained Selective Attention (TOSSA) (Kovacs, 2015).
Methods: This quantitative study involved nine children who participated in four movement-to-music sessions with a staggered stop over a period of six weeks. The study incorporated a single group pre-test/post-test design, and a non-parametric Sign Test was utilized to analyze data from the TOSSA subcategories of concentration, detection, …

Of Bollywood Songs, Film Producers And Collecting Societies: Locating The Rights Of The Composers, Poorna Mysoor
Indian Journal of Law and Technology
Bollywood films are known for their songs, and in many cases Bollywood films are known because of the songs. It is not merely in Bollywood films that songs have a significant role, but also in the lives of myriad composers, lyricists, singers and so on, lending an opportunity for their creative expression in addition to serving as a means of livelihood. Ideally, it should be possible for composers to be able to earn an income by composing music for films, as well as by being a member of a collecting society in such a way as to maximize their returns. …

Hearing Tolkien In Vaughan Williams?, Keri Hui
Hearing Tolkien In Vaughan Williams?, Keri Hui
Journal of Tolkien Research
In recent years, musicians and Tolkien readers alike have associated Ralph Vaughan Williams’ music, particularly Fantasia on a Theme by Thomas Tallis (1910), The Lark Ascending (1914), and Fantasia on Greensleeves (1934), with Tolkien’s fantasies. This article explores this tendency to hear Tolkien’s Middle-earth in Vaughan Williams’ musical fantasies, calling attention to the similarities in their shared devotion to the idea of English consciousness, interest in combining ecclesiastical and folk materials, and pastoral vision. A juxtaposition of their approach and philosophies not only helps explain the musical echoes, however, but also confirms an appealing mark of Tolkien’s craft is its …

The Creation Of New Tunes For Ci-Poetry In The Qing Dynasty And Their Dual Forms Of Music And Text, Shen Liu, Xianyi Sha
The Creation Of New Tunes For Ci-Poetry In The Qing Dynasty And Their Dual Forms Of Music And Text, Shen Liu, Xianyi Sha
Theoretical Studies in Literature and Art
Despite the loss of tunes to ci-poetry during the Qing Dynasty, poets still composed a large number of new ci-poems, and ci-poetry in Chinese classical poetry has been considered as lyrics to music in contrast to regulated poems. Based on the ci poetry of the Tang and Song Dynasties, Qing-dynasty poets developed two main methods to compose the new tunes for ci-poems, which were “tuning on the consideration of tones of every word” and “blending tunes to create a new tune.” These two methods enabled the poets to compose lyrics before revising the melodies. Thus, the poets in the Qing …

Structuralviolence includes any institutional, social, and political barriers that prevent equality. Twenty-six non-white participantswere recruited and asked to listen to and watch music videos for three contemporary hip hop songs: Nowhere Fast by Eminem ft. Kehlani (2017), This is Americaby Childish Gambino (2018), and Nothin’ Newby 21 Savage (2017). Other studies revealed a need for further training of pre-service and in-service educators to integrate technology into their instruction successfully.
Results of this survey revealed an increase in technology use and comfort levels with technology specific to distance learning such as …
Reissue & Revivalism: Uncovering Ireland's Lost Diy, Electronic And Post-Punk Histories, Neil O'Connor
Reissue & Revivalism: Uncovering Ireland's Lost Diy, Electronic And Post-Punk Histories, Neil O'Connor
Irish Communication Review
Reissues: a rediscovery of the past. This process of rediscovery is nowhere more evident than in the current output of the Dublin record label and shop, All City Records. Recently, its owner Olan O’Brien, has been delving into the unknown with a series of reintroduced gems from Ireland’s musical past with its AllChival imprint. Whether it is Quare Grooves, a compilation of Irish-made Seventies groove and funk or the re-release of Dublin producer Stano’s debut album of experimentalist new wave from 1983, the label has been playing a rival role in the recontextualising lost DIY (Do-it-Yourself), electronic and post …
Early Sound Systems Of The Irish Dance Bands And Showbands, Niall Coghlan
Early Sound Systems Of The Irish Dance Bands And Showbands, Niall Coghlan
Irish Communication Review
This paper examines the culture and technologies around the sound systems used by the Irish dance and show bands of the 1950s and 1960s. With limited financial and technical resources available to the average musician of the period, many performers were forced to adopt a DIY approach, adapting or building their own instruments and sound equipment to meet changing tastes and needs. Literary sources are augmented by material drawn from interviews with two musicians who played with the showbands. The evolution of the technologies from the post-war period is documented and a self-sufficient, DIY approach is evidenced, prior to the …
Clubbing Criminals: The Hirschfeld Centre And The Emergence Of Queer Club Culture In Dublin, Ann-Marie Hanlon
Clubbing Criminals: The Hirschfeld Centre And The Emergence Of Queer Club Culture In Dublin, Ann-Marie Hanlon
Irish Communication Review
Ireland in the 1970s and 80s was an extremely hostile place for the LGBT community: male homosexuality remained a criminal offence and social, legal and political oppression was the norm. This article documents the emergence of a nascent queer clubbing scene in Dublin in this period and investigates the historical intersection of partying and politics in a DIY translocal music scene defined by the sexual politics of the time. In particular, this research focuses on exploring the social and political importance of Ireland’s first purpose built queer club, Flikkers, which opened in the Hirschfeld Centre, Temple Bar on St. Patrick’s …

Diy Connections And Collaborations: Mid-West To North-East, Ciarán Ryan
Irish Communication Review
Alternative music cultures can be found in various Irish cities and towns outside of the capital Dublin. These scenes may retain their own local idiosyncrasies, but those subscribing to do-it-yourself (DIY) ideals in Ireland are clearly influenced by sounds and styles from further afield. As punk mutated into different forms from the 1980s onwards, political and musical cues came from the countries to the East and West of Ireland - hardcore (Fairchild, 1995) from the United States, and anarcho-punk (Dines, 2004) from Britain. The DIY aesthetics of the early punk movements have since translated to numerous music genres and practices …

“A Greater [Music]” And “A Song Of Greater Power”: Lúthien's Song And Dance In The Light Of The Ainulindalë, Giovanni Carmine Costabile
Journal of Tolkien Research
It is often given for granted that the whole history of Arda somehow reflects the primordial symphony played by the angelic Ainur before the highest deity Ilúvatar before the beginning of days. Yet, the specific modalities of such mirroring did not, up to the present day, receive the attention they should. Therefore, the present writing endeavours to trace the correspondances between the divine music and the narrative dedicated to the amazing accomplishments of the bethrothed Elven maiden Lúthien and human hero Beren. The choice of the latter story among all the tales of Arda is due to the fact that …

Local Garage Psychosis Rockabilly Disease: Glocalization And The Athenian Psychobilly, Michael Tsangaris
Journal of Global Awareness
Music is an art that permeates every human society. It is used for such diverse social purposes as ritual, worship, coordination of movement, communication, or entertainment. There are no limits to music as it can move freely in space through sound waves, radio, cinema, television, and the new digital technologies. Music is directly related to subcultures in that cultural identities and lifestyles can be mediated through music. This article aims to use the development of music scenes such as psychobilly to establish a link between music, subcultures, globalization, and the global-local dialectic.
“Sorry,” But I Didn’T Release It: How The Court’S Analysis Of The Fair Use Doctrine In Chapman V. Maraj Protects Innovation And Creativity In The Music Industry, Samantha Ross
University of Miami Business Law Review
The fair use doctrine is an important affirmative defense to copyright infringement when a particular use does not interfere with copyright law’s primary goal of promoting creativity for the public good. Artists and songwriters frequently experiment with copyrighted music without permission before seeking licensing approval from the original rights holders to “sample” or “replay” the work. In Chapman v. Maraj—a copyright infringement suit brought by Tracy Chapman against Nicki Minaj—the United States District Court for the Central District of California held that experimenting with a copyrighted musical composition for the purpose of creating a new work with an intent to …
Sound Familiar? Digital Sampling Is Taking Center Stage, Logan Zucchino
Sound Familiar? Digital Sampling Is Taking Center Stage, Logan Zucchino
University of Miami Business Law Review
In 2018, Kendrick Duckworth, better known by his stage-name Kendrick Lamar, became the first non-classical or jazz musician to win the Pulitzer Prize in Music. Equally as surprising, the album contained a magnitude of digital sampling. As digital sampling has become more prevalent since the 1980’s, courts have differed on how to handle the issue. By 2016, the Sixth and Ninth Circuit Courts of Appeals established a circuit split on the issue, with one holding that unlicensed digital sampling is per se unlawful, and the other holding that a more lenient test is needed. Courts have continued to struggle with …
Intellectual Heirs Property: Why Certain Musical Copyrights Should Be Included In The Heirs Property Reform Movement, Austin Weatherly
Intellectual Heirs Property: Why Certain Musical Copyrights Should Be Included In The Heirs Property Reform Movement, Austin Weatherly
Journal of Intellectual Property Law
The modern heirs property reform movement seeks to ameliorate the issues caused by the procedures governing the inheritance of real property from landowners who die intestate. This procedure can have a negative impact on heirs and the value of their inherited property. The reform movement, as it stands, only seeks to resolve the issues created by these procedures in the real property context. The rhetorical basis for the modern heirs property reform movement largely focuses on closing the racial wealth gap in the United States and slowing the wealth bleed from one black generation to the next. Many of the …

Creative Citizen Peacebuilding: Japanese Artists And Audiences Respond To The Vietnam-American War, Long T. Bui, Ayako Sahara
Peace and Conflict Studies
This article explores two case studies related to South Vietnam and Japan, relating them to the controversial history and legacy of the Second Indochina War. The first is the Japanese adoption and adaptation of South Vietnamese antiwar music. The second is a Japanese film, uncovered decades later after the war, exposing the role of Japan in South Vietnam. Cultural productions, from nations allied with the United States, sought to expose the popular struggle for peace against the rising tide of Cold War military violence and corporate capitalist exploitation. Through interviews, archival research, and textual analysis, the article argues for a …

Through the powerful interaction between the visual arts and music, an ancient story of brokenness and redemption is retold. This thesis seeks to give greater insight into this multimedia retelling of the biblical book of Ruth. Scholarly sources were reviewed to deepen understanding, and works from professional visual artists and musicians were examined for this project to come together. The end product is this thesis as well as a body of art and a five-movement piece of music. This combination of visual art and music allows the relevance of the biblical book of Ruth to be seen in the transforming …
