Loyola High School V. Attorney General Of Quebec: On Non-Triviality And The Charter Value Of Religious Freedom, Howard Kislowicz Dec 2015

Loyola High School V. Attorney General Of Quebec: On Non-Triviality And The Charter Value Of Religious Freedom, Howard Kislowicz

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

In Loyola High School, et al. v. Attorney General of Quebec, the Supreme Court of Canada held that the government of Quebec could not require a Catholic high school to teach Catholic religion and ethics from a non-Catholic perspective. The government could, however, require the school to teach other religions from a “neutral” perspective. This article takes Loyola as an opportunity to examine two ways that courts have justified limits on religious freedom. First, I interrogate an under-examined aspect of the law of religious freedom: the requirement that claimants prove the interference with their religious freedom is “more than trivial …

Constitutional (Mis)Adventures: Revisiting Quebec’S Proposed Charter Of Values, Dia Dabby Dec 2015

Constitutional (Mis)Adventures: Revisiting Quebec’S Proposed Charter Of Values, Dia Dabby

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

In November 2013, the Parti Québécois introduced the Charter affirming the values of State secularism and religious neutrality and of equality between women and men, and providing a framework for accommodation requests (also known as Bill 60). This proposed piece of legislation would substantially alter how public services are offered and received in Québec. This article argues that this legislative project was much more than a simple law, and rather, as discussed, about reconfiguring the constitutional relationship that Quebecers entertain with the rest of Canada. As such, it engages with the constitutional “misadventures”, as experienced in Quebec in 2013-2014. Drawing …

Ethical Transformations In Yan's 陆犯焉识 (The Criminal Lu Yanshi), Weihong Zhu Dec 2015

Ethical Transformations In Yan's 陆犯焉识 (The Criminal Lu Yanshi), Weihong Zhu

CLCWeb: Comparative Literature and Culture

In her article "Ethical Transformations in Yan's陆犯焉识 (The Criminal Lu Yanshi)" Weihong Zhu uses ethical literary criticism to explain the reason for the change in attitude which the novel's hero undergoes. Zhu argues that in Geling Yan's novel the turning point lies in the protagonist's realization of his inner "animal" factor. Subjected to severe tests by the extreme circumstances in a northwest prison in China, this realization helps him transform from a proud man to a humble human being, so that he learns to love his family. Although set in a grand historical background of important political events, Yan's …

Narrative Ethics And Alterity In Adichie's Novel Americanah, Nora Berning Dec 2015

Narrative Ethics And Alterity In Adichie's Novel Americanah, Nora Berning

CLCWeb: Comparative Literature and Culture

In her article "Narrative Ethics and Alterity in Adichie's Novel Americanah" Nora Berning analyses Chimamanda Ngozi Adichie's novel through the lens of a narrative ethics of alterity. Focusing on the notion of alterity, Berning argues that a specific turn-of-the-century ethics emerges in contemporary fictions of migration in general and in intercultural novels in particular. An ethical genre in its own right, such twenty-first century fictions as Americanah generate a particular kind of ethical knowledge that revolves around questions of identity and alterity and around individual and collective perceptions of self and other. By addressing the interplay of "the ethics …

No Sabía Que Tenía Valor”: Uncovering Latina Mothers’ Multiple Literacies, Julia Lopez-Robertson Dec 2015

No Sabía Que Tenía Valor”: Uncovering Latina Mothers’ Multiple Literacies, Julia Lopez-Robertson

Journal of Family Strengths

Five Latina mothers were engaged in pláticas literarias/literature discussions about Latino children’s literature at their children’s school. The pláticas served as means to build the links from personal experiences to school learning and to help the mothers recognize that their ways of knowing and making meaning of the world-their multiliteracies-are tools from which their children will and do learn. A community cultural wealth [CCW] framework was employed to identify and make visible the significance of these rich contributions and strengths. Basing the pláticas on texts that interested and were relevant to the mothers and providing them a safe space …

A Rare Family: Exploring Genetic Literacy In An Online Support Group, Heather H. Goltz, Sandra Acosta

Journal of Family Strengths

Healthy People 2020 and the Institute of Medicine (IOM) define health literacy as the “degree to which individuals have the capacity to obtain, process and understand basic health information and services needed to make appropriate health decisions.” Essential components of health literacy include oral and print literacy, numeracy, and cultural and conceptual knowledge; the latter is influenced by sociodemographic factors and cultural understandings and approaches to concepts such as healthcare. Genetic literacy, a form of health literacy, may be defined as the knowledge, skills and attitudes necessary to individual understanding of genetic information, and genetic-based health, behavior, technology …

You Don’T Need A Metaphor To Know Which Way The Case Goes: The Senate Reference And Constitutional Metaphors, Richard Haigh Dec 2015

You Don’T Need A Metaphor To Know Which Way The Case Goes: The Senate Reference And Constitutional Metaphors, Richard Haigh

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

This article uses the Supreme Court of Canada’s Reference re Senate Reform as a basis for arguing that metaphors are not always appropriate in constitutional adjudication. In that decision, the Court relies on the metaphor of “constitutional architecture” ten times (11 if a subheading is counted). Despite the multiple references, the Court leaves unanswered questions about what the architecture metaphor is doing. Does it help to clarify? Is it the same or different from the text itself? Is it the same or different from “structure”? Is not the metaphor itself capable of multiple meanings? Relying too heavily on metaphors allows …

Journal of Health Disparities Research and Practice

ABSTRACT

This critical literature review was conducted to identify both individual- and environmental-level social determinants of health using an ecological framework as a way to contextualize risk for, and distributions of, late HIV diagnosis among African Americans and Latinos in the United States.

Background: Late diagnosis, defined as a diagnosis of AIDS simultaneously with or within one year of an initial HIV diagnosis,1 disproportionately affects African American and Latino communities;2,3 disparities in this health problem thus represent a preventable inequity. Such disparities affect not only late diagnosed individuals but also population levels of HIV incidence, as transmission is …

Discourse, Identity And International Development Cooperation: China, Africa And Focac, Daniel Lemus Delgado

Asia-Pacific Social Science Review

This article analyses the relationship between discourse and identity in the case of the People’s Republic of China in Africa. It assumes that the interests of the Chinese government in Africa can be understood from a theoretical constructivist approach. So, the activities of International Development Cooperation of China into Africa are a result of material and ideational aspirations. Thus, the ties of China in Africa have been boosted by the identity of the Chinese state in the international arena. To understand how identity and interest are linked, this article analyses the official discourse of China in Forum on China Africa …

Economic Determinants Of Communal Conflict: Evidence From Indonesia, Edgar Demetrio García, Indra Prasetya Adi Nugroho Dec 2015

Economic Determinants Of Communal Conflict: Evidence From Indonesia, Edgar Demetrio García, Indra Prasetya Adi Nugroho

Asia-Pacific Social Science Review

Religion, ethnicity, and politics are typical explanatory variables of violent conflicts. From an economic point of view, economic growth reduces the risk of civil war, yet the economic determinants of conflict have been little studied. In this article, we empirically study the impact of regional macroeconomic conditions on the number of violent conflicts in Indonesia, a country with potential risks of communal conflict because of the plurality of its society. We use panel data consisting of observations on 16 Indonesian regions from 2004 to 2013 to assess the impact of economic factors on conflict, reevaluating the religion effect using dynamic …

Invariant Spatial Information In Sketch Maps — A Study Of Survey Sketch Maps Of Urban Areas, Jia Wang, Angela Schwering Dec 2015

Invariant Spatial Information In Sketch Maps — A Study Of Survey Sketch Maps Of Urban Areas, Jia Wang, Angela Schwering

Journal of Spatial Information Science

It is commonly recognized that free-hand sketch maps are influenced by cognitive impacts and therefore sketch maps are incomplete, distorted, and schematized. This makes it difficult to achieve a one-to-one alignment between a sketch map and its corresponding geo-referenced metric map. Nevertheless, sketch maps are still useful to communicate spatial knowledge, indicating that sketch maps contain certain spatial information that is robust to cognitive impacts. In existing studies, sketch maps are used frequently to measure cognitive maps. However, little work has been done on invariant spatial information in sketch maps, which is the information of spatial configurations representing correctly the …

Development And Evaluation Of A Geographic Information Retrieval System Using Fine Grained Toponyms, Damien Palacio, Curdin Derungs, Ross S. Purves

Journal of Spatial Information Science

Geographic information retrieval (GIR) is concerned with returning information in response to an information need, typically expressed in terms of a thematic and spatial component linked by a spatial relationship. However, evaluation initiatives have often failed to show significant differences between simple text baselines and more complex spatially enabled GIR approaches. We explore the effectiveness of three systems (a text baseline, spatial query expansion, and a full GIR system utilizing both text and spatial indexes) at retrieving documents from a corpus describing mountaineering expeditions, centred around fine grained toponyms. To allow evaluation, we use user generated content (UGC) in the …

Convertability And Oil Resistance Of Paperboard With Hydroxypropyl-Cellulose-Based Dispersion Barrier Coatings, Ville Leminen, Sami-Seppo C. Ovaska, Panu Tanninen, Juha Varis Dec 2015

Convertability And Oil Resistance Of Paperboard With Hydroxypropyl-Cellulose-Based Dispersion Barrier Coatings, Ville Leminen, Sami-Seppo C. Ovaska, Panu Tanninen, Juha Varis

Journal of Applied Packaging Research

The convertability and barrier properties of paperboard coated with hydroxypropyl-cellulose (HPC) based dispersions were studied via tray pressing trials, oil resistance measurements and microscopic analyses. To improve the oil resistance of the HPC-based coatings and to maximize their convertability, talc, gelatin and latex were used as additives in coating formulations. The oil resistance of the coatings improved to some extent with these additives, but scanning electron micrographs revealed the existence of pinholes particularly in coatings with a high HPC content. The coated paperboard samples were pressed into rectangular trays and the convertability of the paperboards was evaluated with a microscope. …
