Faculty Views: The Legality Of Delaying Obamacare's Employer Mandate, Nicholas Bagley

Nicholas Bagley, assistant professor of law, teaches and writes in the areas of administrative law, regulatory theory, and health law. Prior to joining the Law School faculty, he was an attorney with the Appellate Staff in the Civil Division at the U.S. Department of Justice, where he argued a dozen cases before the U.S. Courts of Appeals and acted as lead counsel in many more. He also served as a law clerk to Justice John Paul Stevens of the U.S. Supreme Court and Judge David S. Tatel of the U.S. Court of Appeals. Portions of this article appeared in Professor …

One illustration of Michigan Law's global strength in recent years has been the prevalence of graduates on the highest courts of their countries of origin. Programs such as the Geneva Externships and Bates Fellowships have trained students and recent graduates how to practice law in other countries. Courses and clinics at the Law School have allowed for the development and refinement of tools such as a blood-filtering device that saves the lives of new mothers in Ghana.

Victor Caminata was convicted of arson. The Michigan Innocence Clinic and its experts say he didn't commit arson-in fact, that the fire in question wasn't arson at all, and that Caminata was convicted based on junk science. The Clinic's attorneys won him a new trial, so now, he awaits his fate once more.

Phi Delta Phi, the oldest of the three international law fraternities, was founded at Michigan in 1869. But the house at 502 E. Madison wasn't built until 1914. (It was then, and remains, the only "Phid" chapter with its own residence.)

Kyle is the Wade H. and Dores M. McCree Collegiate Professor of Law at the U-M Law School, where he teahes tax. Torts, and insurance law. Ruth Ann is a trained nurse who was homeschooling two of their kids at the time; another was in high school, one was a junior at U-M, and the oldest was a 1L at Michigan Law. Ruth Ann had heard from a friend about an 11-year-old boy in Ethiopia who had been diagnosed with Hodgkin's lymphoma-a cancer of the immune system-and who had been offered free treatment near Detroit. Caminker began his 10 years in the job as dean ready to focus on other goals and ambitions. Now, he is completing a tenure that has been filled with a string of accomplishments, many of which were completed under difficult economic and societal circumstances.
Through it all, Caminker has built a reputation as a fair-minded, thoughtful, and unflappable leader who also has the tenacity to push forward on difficult projects in spite of numerous obstacles.

Professor Ellen D. Katz writes and teaches about election law, civil rights and remedies, and equal protection. She and the Voting Rights Initiative at Michigan Law filed a brief as amicus curiae in Shelby County v. Holder, on which the U.S. Supreme Court heard oral arguments February 27. Here, she examines why Section 2 of the Voting Rights act bears consideration in the case, which involves a challenge to Section 5 of the act.
