Evolving Hinduism: Comparing The Bhagavad Gītā, Michele Gibney

Hinduism was a semi-fluid belief system in the medieval period of India. At first it was built around the Brahmin class who were the priests that had the ritual authority to perform elaborate sacrifices for the other three caste levels. There was also then the canon of Vedic literature, one aspect of which was the Upanişads. The Upanişads preached a solitary, hermit-like existence which emphasized meditation. This produced a strong ascetic body, but did not contribute to the continuation of society as a whole. Noble, But Not Savage: Difficulties In Racial-Mythic Conception Of Media Stereotypes., Rick Clifton Moore, John R. Fisher

To overcome conceptual difficulties in earlier media stereotype research, Seiter (1986) and Gorham (1999) propose that we think of stereotypes in ideological terms, especially as perpetuators of racial myths. Racial myths reinforce negative views of oppressed groups and positive views of the powerful. In this study, however, empirical data about preconceptions and film portrayals of Native Americans suggest that in some instances powerless groups can be “stereotyped” much more positively than powerful ones are.

A Painful Labor: Photography And Responsibility

Despite the avalanche of objections regarding documentary's false promise to awaken social conscience, this paper considers the tension between photography and responsibility. By examining the encounter with images of suffering through a psychoanalytic register, the paper tries to articulate what Barthes describes as the ‘painful labour’ of responding to the photographic other – an encounter that illuminates the limit of the spectator's ability to respond. Photographs provide an occasion to register this limit, which, I argue, opens up the spectator's traditional notions of responsibility from a set of moral duties towards a questioning of the ethical relation.

Arbitration Clauses, Jury-Waiver Clauses And Other Contractual Waivers Of Constitutional Rights, Stephen Ware

Stephen Ware

Consenting to a contract containing an arbitration clause or a jury-waiver clause alienates or waives the Seventh Amendment jury-trial right in federal court. The standards of consent in arbitration law, however, tend to be lower than the standards of consent in the federal caselaw governing jury-waiver clauses. The Federal Arbitration Act (FAA) requires courts to apply contract law's standards of consent to arbitration agreements, while certain commentators argue that courts are instead constitutionally required to apply the higher standards of consent (knowing consent) found in the caselaw governing jury-waiver clauses. This article explores the efforts over the past quarter century by the conservative public interest law movement to revive the principle of federalism and, ultimately, the notion that the federal government is one of only limited, enumerated powers. Focussing on the Commerce Clause, the article traces the original meaning of the powers of the federal government over interstate commerce, as those powers were understood by those who drafted and ratified the Constitution, and contrasts that understanding with the expansionist view of the Commerce Clause adopted by the New Deal Court, which became the ruling orthodoxy for more than half a …

A presentation of my doctoral research, in which I examine reading as a taken-for-granted and under-studied aspect of information seeking and information use. Specifically, I look at the role of voluntary reading in the negotiation of alternative sexual identities amongst young women (18-23 years of age) who self-identify as lesbian, queer, or bisexual.

At the end of August 2003, representatives of Alabama, Florida, and Georgia ceased negotiating over a water apportionment formula for an interstate compact governing the Apalachicola-Chattahoochee-Flint ("ACF') River Basin ("the Basin" or "the River Basin"). The negotiations began in 1998 after the states stepped back from ongoing litigation. They ended with the probability of future litigation, which might involve the doctrine of equitable apportionment in federal courts and could invoke the original jurisdiction of the United States Supreme Court. It has been conventional to conceptualize civic life through one of two core images: the citizen as lone individualist or the citizen as joiner. Drawing on analyses of the historical development of the public sphere, we propose an alternative analytical framework for civic engagement based on small group interaction. By embracing this micro-level approach, we contribute to the debate on civil society in three ways. By emphasizing local interaction contexts—the microfoundations of civil society—we treat small groups as a cause, context, and consequence of civic engagement. Fall Prevention Programs For The Elderly: A Bayesian Secondary Meta-Analysis, Joseph F. Lucke

A secondary meta-analysis of programs to reduce falls in the elderly is undertaken to demonstrate a Bayesian analysis. The Bayesian statistical tradition is carefully distinguished from the standard Neyman-Pearson-Wald (NPW) statistical tradition. In the 12 studies, the logit effect size is used to compare treatment groups using a prevention program to control groups without a program. To contrast the Bayesian analysis, independent-effects and fixed-effect meta-analyses are first conducted in the NPW tradition. This is followed by Bayesian independent-effects and fixed-effect meta-analyses that numerically replicate the NPW results but have conceptually different interpretations. This ethnographic study explores the contradictory literacy practices of 10 high school students of Mexican background from the rural Midwest. The author uses the term Mexican background to encompass both settled Mexican Americans and recent-immigrant Mexicanos. Literacy is investigated through English and Spanish in a sociocultural context. Findings reveal how Mexican-background students demonstrate different literacy practices in their homes and communities than those acknowledged at school. Educators in the school setting did not recognize Mexican-background students’ linguistic proficiency. In school, Mexican-background students were viewed in terms of their limited-English status and were mostly enrolled in low academic tracks. At home, …

The U.S. Judicial Conference Advisory Committee on Civil Rules recommended a package of proposed amendments to the Federal Rules of Civil Procedure to address issues raised by discovery of electronic information. The recommendations were based on the theory that discovery of electronic information is truly different from discovery of non-electronic information and that the differences require a special set of discovery rules. This Article tests the bases for the Advisory Committee's theory and concludes that there are five true differences between discovery of electronic information and discovery of traditional hard copy information, but two of the differences are addressed by …

This paper analyzes the interaction of financing and output market decisions in a duopoly in which one firm is financially constrained and can borrow funds to finance production costs. Two ideas have been separately analyzed in previous work: Some authors argue that debt strategically affects a firm’s output market decisions, typically making it more aggressive; others argue that the threat of bankruptcy makes debt financing costly, typically making a firm less aggressive. International copyright law must be based on an assessment of what types and levels of protection best further the purposes of copyright law. But constructing the international copyright regime is difficult as the international system must wrestle with copyright dilemmas that exist at the national level as well as broader challenges facing international law.
