A Framework For Data-Driven Legal Regulatory Reform, Michael Cherry
A Framework For Data-Driven Legal Regulatory Reform, Michael Cherry
Seattle Journal of Technology, Environmental & Innovation Law
To fulfill its responsibility to the Washington Supreme Court to innovate new avenues for persons not currently authorized to practice law to provide legal and law-related services, the Washington Supreme Court’s Practice of Law Board (POLB) studied how to improve the regulation of legal services through legal regulatory reform, with an eye towards closing the access to justice gap. As the traditional processes for legal regulatory reform generally rely on the anecdotal experiences of participants in the reform; take significant time to create, evaluate, and implement; and rarely go on to measure whether the reform had the intended goal without …

An Analysis Of The Legal Framework For Telemedicine In Jamaica, Lynette Martins
An Analysis Of The Legal Framework For Telemedicine In Jamaica, Lynette Martins
Seattle Journal of Technology, Environmental & Innovation Law
The ubiquity of telemedicine worldwide makes it hard to imagine a time without it. While global iterations of remote healthcare services began decades ago, telemedicine as a phenomenon has existed in Jamaica since at least the late 1990s. Still, its use and uptake were inconsistent and sporadic for a multitude of reasons, one of which was the strong preference for in-person healthcare services. However, as the last few years have demonstrated, the expansion of medicinal practice beyond the confines of the examination room can prove immensely valuable, not only during times of crises, but in the everyday practice of medicine. …
The Shadow Of The Law Versus A Law With No Shadow: Pride And Prejudice In Exchange For Generative Ai Authorship, Mira Moldawer
The Shadow Of The Law Versus A Law With No Shadow: Pride And Prejudice In Exchange For Generative Ai Authorship, Mira Moldawer
Seattle Journal of Technology, Environmental & Innovation Law
As generative AI that can perform almost any intellectual task a human could, is already a game changer in miscellaneous aspects of modern life, determining its authorship, ownership, and accountability is critical.
The axiom held by current American law that human creativity is “the sine qua non at the core of copyrightability”, has very little to do neither with legal history nor with the current state of the law regarding the perception of legal agency as equal human personhood. Likewise, If the human factor is so essential to copyrightability, it should follow that the relevant legislation should state that principle. …

6ppd-Q, Tires, And Salmon, Oh My: Policies And Remedies For Tribes In The Acute Mortality Of Coho Salmon In The Puget Sound Region., Meralina Morales
American Indian Law Journal
The pervasive reliance on automobiles within society exacerbates environmental degradation in low-income and communities of color, notably in Native and tribal communities. The leaching of Tread Wear Particles (TWP), including the detrimental 6PPD-quinone (“6PPD-q”), into waterways, significantly impacts aquatic ecosystems. This issue is especially impactful for endangered species, like the coho salmon, that hold profound cultural significance for indigenous tribes in the Pacific Northwest, for example, the Nez Perce Tribe believes that the fate of the salmon and people are linked.[1]
The scientific foundations of 6PPD-q's impact on salmon through bioaccumulation and biomagnification highlights its environmental justice implications. This …

Locke’S “Wild Indian” In United States Supreme Court Jurisprudence, Anthony W. Hobert Phd
Locke’S “Wild Indian” In United States Supreme Court Jurisprudence, Anthony W. Hobert Phd
American Indian Law Journal
This article explores the impact of John Locke’s Two Treatises on United States Indigenous property rights jurisprudence. After discussing Locke’s arguments, the article turns to the rationales of the first and last cases of the Marshall Trilogy—Johnson v. McIntosh (1823) and Worcester v. Georgia (1832)—arguing that, contrary to prevailing political theory, Marshall’s opinion for the Court in Johnson puts forth a fundamentally Lockean justification for the dispossession of Indigenous property. This article also provides a brief analysis of Marshall’s explicit Vattelian rationale in Worcester, commentary on recent developments regarding the precedents, and recommendations for reconciling them within contemporary …
