Use Of Protective Behavioral Strategies And Reduced Alcohol Risk: Examining The Moderating Effects Of Mental Health, Gender And Race, Shannon R. Kenney, Joseph W. Labrie Dec 2013

Use Of Protective Behavioral Strategies And Reduced Alcohol Risk: Examining The Moderating Effects Of Mental Health, Gender And Race, Shannon R. Kenney, Joseph W. Labrie

Heads Up!

Recent research indicates that protective behavioral strategies (PBS)—previously established as effective self-regulating tools for reducing alcohol risk among college students—may be especially useful for students with poor mental health, who are shown to be at heightened risk for alcohol-related harm. The current study examined the moderating influence of mental health (depression and anxiety severity), gender, and race (White, Asian) in the relationship between PBS use and alcohol-related negative consequences. Participants were 1,782 undergraduate students from two West Coast universities who reported past month incidence of heavy episodic drinking. Students reported on their drinking, experience of alcohol-related consequences, use of PBS, …

There is a lack of consistency with respect to the use of the terms like species richness, diversity and biodiversity, which extends to the analysis of diversity indices and the merit of using diversity indices in the evaluation (comparison and contrast) of biological communities. The purpose of this article is to provide working definitions for these terms and cite examples from the primary literature that demonstrate the utility of estimating richness, evaluating proportional abundance patterns, as well as comparing indices of diversity and similarity to study patterns of biological organization at different ecological scales. Additionally, we provide a manual in …

E.F. Schumacher’S Critique Of Modern Philosophy, Maximilian Lyons

Writing Programs

A freshman major in business marketing from Temecula, California, Max Lyons defends German philosopher E.F. Schumacher’s criticism of modern philosophy and his theory of philosophical mapmaking. Lyons fluently synthesizes Schumacher and modern philosopher David Hume’s work to address the philosophical approaches to climate change, while simultaneously navigating the complicated divergence between modern and post-modern philosophical discourse. The essay was written for Dr. Scott Cameron’s First Year Seminar, The Ethical Implications of Climate Change.

Heads Up!

Objectives

Personalized normative feedback (PNF) interventions are generally effective at correcting normative misperceptions and reducing risky alcohol consumption among college students. However, research has yet to establish what level of reference group specificity is most efficacious in delivering PNF. This study compared the efficacy of a web-based PNF intervention employing eight increasingly-specific reference groups against a Web-BASICS intervention and a repeated-assessment control in reducing risky drinking and associated consequences.

Method

Participants were 1663 heavy drinking Caucasian and Asian undergraduates at two universities. The referent for web-based PNF was either the typical same-campus student, or a same-campus student at one (either …

The Pink And Yellow Star, Naomi Cahn Dec 2013

The Pink And Yellow Star, Naomi Cahn

Writing Programs

Cahn utilized a history major and Jewish studies minor to write her fictional piece for Dr. Michael Datcher’s Creative Writing class of fall 2013. “The Pink and Yellow Star” tells the story of a young woman’s struggle to survive as a homosexual during the Holocaust. There were many difficulties writing this heavy-handed of a story, both factually and emotionally. Cahn wanted to make good the motto that Jews had promised, “Never again.” However, she believed that Jews and most of the world had not abided by this ideal. There’s still genocide in the world; there’s still discrimination, oppression, and persecution. …

Jesus And Paul’S Teachings Today, Parker Mccloud

Writing Programs

A freshman history major from Laguna Niguel, California, Parker McCloud addresses the relationship between Christian ethics and its effect on the contemporary political and social climate in the United States. By weaving in examples of Jesus and Paul’s biblical teachings, McCloud examines the role that Christian ethics plays in defining American sociopolitical debates, including freedom of religion, war, and women’s reproductive rights. The essay was written for a First Year Seminar course entitled On Faith and Politics in the fall of 2013 with Dr. Siker.

Proactive, Not Reactive: Evolving Elm Management In The Nation's Capital, Jessica R. Sanders, James W. Woodworth Jr., Joseph E. Duszak

Cities and the Environment (CATE)

Washington D.C. is home to many historic elm corridors managed in close partnership between numerous urban forestry stakeholders. In recent years, the city's elms have been used as part of streetscape revitalization initiatives due to their quick-growing nature. The use of a popular Ulmus americana cultivar, Princeton, has brought about notable challenges in urban tree management. From the nursery to the tree box and even ten years later, these elms have required consistent attention in order to adequately train the form to achieve a sustainable canopy while minimizing structural defects. Two such plantings are explored, both with hand-selected trees from …

Safeguarding Federalism By Saving Health Reform: Implications Of National Federation Of Independent Business V. Sebelius, Brietta Clark

Loyola of Los Angeles Law Review

On June 28, 2012, the Supreme Court issued one of its most anticipated decisions in National Federation of Independent Business v. Sebelius (“NFIB”)—the constitutional challenge to the Patient Protection and Affordable Care Act (“ACA”). The ACA is President Obama’s signature accomplishment and creates a number of reforms intended to reduce cost, improve the quality of healthcare and health outcomes, and expand access to care. The main pillars of the ACA are the expansions of public and private insurance coverage. These expansions were the targets of a number of legal challenges by states, private individuals, and various organizations, with two reaching …

Peeking Behind The Plea Bargaining Process: Missouri V. Frye & Lafler V. Cooper, Laurie L. Levenson

Loyola of Los Angeles Law Review

In Missouri v. Frye and Lafler v. Cooper, the Supreme Court affirmed that plea bargaining, although controversial, has become a dominant feature of America’s criminal justice system and is here to stay. Both cases establish that a defendant has a Sixth Amendment right to effective assistance of counsel during plea bargaining. But neither delineates the minimum standards of attorney competence that will satisfy this newly identified right. This Article seeks to cure some of the uncertainty left in the opinions’ wake by proposing procedures for defense counsel, prosecutors, and courts that will safeguard a defendant’s Sixth Amendment rights. After exploring …

The Voracious First Amendment: Alvarez And Knox In The Context Of 2012 And Beyond, Vikram David Amar, Alan Brownstein

Loyola of Los Angeles Law Review

Supreme Court jurisprudence often privileges certain constitutional provisions to the detriment of others. Following World War II, the Court’s elevation of the equal protection doctrine drove decisions that limited the rights of states and individuals. Over the last twenty years, however, the First Amendment—particularly the Free Speech Clause—has knocked equal protection from its perch.

This Article analyzes United States v. Alvarez and Knox v. Service Employees International Union by critiquing the Court’s opinions, comparing these opinions to other contemporaneously decided cases, and situating the cases within the larger doctrinal field of the First Amendment. In doing so, this Article illustrates …

Foreword: Federalism Points And The Sometime Recognition Of Essential Federal Power, Jonathan D. Varat Nov 2013

Foreword: Federalism Points And The Sometime Recognition Of Essential Federal Power, Jonathan D. Varat

Loyola of Los Angeles Law Review

For some time now, a narrow but persistent majority of the Supreme Court has undertaken the project of circumscribing federal power. Marching under the banner of state sovereignty, this majority has attacked the flanks of congressional power in at least three areas: its enumerated powers, its power to direct the state administration of federal programs, and its power to abrogate state immunity from suit. During the October Term 2011, the battle over the appropriate balance of federal power and state sovereignty continued in earnest on all three fronts. This Foreword examines the Court’s 2011 term to find those points where …

Federal Immigration Detainers After Arizona V. United States, Christopher N. Lasch Nov 2013

Federal Immigration Detainers After Arizona V. United States, Christopher N. Lasch

Loyola of Los Angeles Law Review

In Arizona v. United States, the Supreme Court held that three of the four challenged provisions to Arizona’s “Support Our Law Enforcement and Safe Neighborhoods Act” were preempted. The Court reached this conclusion by focusing on the federal government’s supremacy in immigration enforcement. Ironically, the Court’s focus on federal supremacy undermines the executive branch’s central enforcement measure for obtaining custody of suspected immigration violators: immigration detainers.

The executive branch issues over a quarter million immigration detainers each year to state and local law officials. These detainers command state and local officials to hold a prisoner, who would otherwise be released, …
