Helm's School of Government Conference - American Revival: Citizenship & Virtue
The Internet is a double-edged sword because it provides easy access to information of both good and bad intentions. Censorship justifications under whoever deems something misinformation, provide little oversight on being a neutral public forum. For instance, the influence of elections by not covering a story and censoring opposing views does not promote the notion of being a neutral public forum. Artificial intelligence being applied to many technological applications have fueled the censorship machine. In some instances, artificial intelligence can generate stories to media sites (i.e., ChatGPT) with no verification of the details. From science fiction to science reality, taking …
Wipo Good Practice Toolkit For Collective Management Organisations 2021: Suggestions For Possible Amendment, Desmond Oriakhogba
Wipo Good Practice Toolkit For Collective Management Organisations 2021: Suggestions For Possible Amendment, Desmond Oriakhogba
Joint PIJIP/TLS Research Paper Series
Drawing examples from national and international legal instruments, and based on existing studies, this comment makes suggestions for possible amendment of the World Intellectual Property Organization’s Good Practice Toolkit for Collective Management Organisations 2021 (CMO Toolkit). The suggestions are for inclusion of good practices in the CMO Toolkit that can inform the regulation of CMOs to prevent them from constituting obstacles to open access non-commercial licensing and L&Es-enabled access for education and research. The suggestion also covers good practices that will prevent CMOs from impeding the smooth and effective development of artificial intelligence systems. Recommendations include protecting rightholders' ability to …
Elaborating A Human Rights Friendly Copyright Framework For Generative Ai, Christophe Geiger
Elaborating A Human Rights Friendly Copyright Framework For Generative Ai, Christophe Geiger
Joint PIJIP/TLS Research Paper Series
This paper analyses the copyright issues related to so-called “generative AI” systems and reviews the arguments currently advanced to change the copyright regime for AI-generated works from a human rights perspective. It argues that because of the applicable human rights framework for copyright but also the anthropocentric approach of human rights the protection of creators and human creativity must be considered the point of reference when assessing future reforms with regard to copyright and generative AI systems. Consequently, the copyrightability of AI-generated outputs should be considered with utmost care and only when AI is used as a technical tool for …
Slaughtering Slaughter-House: An Assessment Of 14th Amendment Privileges Or Immunities Jurisprudence, Caleb Webb
Slaughtering Slaughter-House: An Assessment Of 14th Amendment Privileges Or Immunities Jurisprudence, Caleb Webb
Senior Honors Theses
In 1872, the Supreme Court decided the Slaughter-House Cases, which applied a narrow interpretation of the Privileges or Immunities Clause of the 14th Amendment that effectually eroded the clause from the Constitution. Following Slaughter-House, the Supreme Court compensated by utilizing elastic interpretations of the Due Process Clause in its substantive due process jurisprudence to cover the rights that would have otherwise been protected by the Privileges or Immunities Clause. In more recent years, the Court has heard arguments favoring alternative interpretations of the Privileges or Immunities Clause but has yet to evaluate them thoroughly. By applying the …

The Mad Hatter’S Quip: Looking For Logic In The Independent State Legislature Theory, Nicholas Maggio, Foreword By Brendan Buschi
The Mad Hatter’S Quip: Looking For Logic In The Independent State Legislature Theory, Nicholas Maggio, Foreword By Brendan Buschi
Touro Law Review
The Supreme Court is set to hear a case that threatens the bedrock of America’s democracy, and it is not clear how it will shake out. The cumbersomely named “Independent State Legislature Theory” is at the heart of the case Moore v. Harper, which is before the Supreme Court this term. The theory holds that state legislatures should be free from the ordinary bounds of state judicial review when engaged in matters that concern federal elections. Despite being defeated a myriad of times at the Supreme Court, the latest challenge stems from a legal battle over North Carolina’s redistricting maps. …
Talking About Relational Youth Work: Why Language Matters, Trudi Cooper, Tim Corney, Hilary Tierney, Jamie Gorman, John Sutcliffe
Talking About Relational Youth Work: Why Language Matters, Trudi Cooper, Tim Corney, Hilary Tierney, Jamie Gorman, John Sutcliffe
Research outputs 2022 to 2026
The literature on youth work emphasises the importance of ‘relationship’ to good practice, moreover, the characteristics of the youth-work relationship have been posited as a defining feature of youth work in the British-influenced tradition. Despite this, little attention is paid to the choice of language used to describe how professional youth workers relate to young people, or how language choices reflect political framing of youth work and of power relationships within their practice. Language choice has implications for how youth workers perceive their professional identity, for how accountability is construed, and for inter-professional working. In this article we undertake a …
Protecting Women Migrant Workers’ Rights In South Africa: The Need For A Gender-Responsive Framework, Annah Kahari
Protecting Women Migrant Workers’ Rights In South Africa: The Need For A Gender-Responsive Framework, Annah Kahari
Biennial Conference: The Social Practice of Human Rights
Whilst feminisation of migration plays a great role in enhancing the agency of women and improving their socio-economic status it exposes women migrants, to potential risks. Upon arrival in South Africa, women migrant workers suffer multiple layers of discrimination. Important to note is that women's migration pathways and experiences are distinct from those of men and predominantly involve greater exposure to multiple risks. Women migrants are at greater risk of exploitation and abuse, including trafficking, with a greater likelihood to work in less regulated and less visible sectors than men. Using an intersectionality approach, the paper examines the interconnectedness of …

Positioning Public Services In A Rights-Based Economy, Ruth Getobai Nchagwa
Biennial Conference: The Social Practice of Human Rights
COVID-19 pandemic has put spotlight on major injustices at the core of our current economic model which exposes many to shortages and risks and delivers extreme wealth for the few. War in Ukraine, political instability in Africa and increased foreign debts by governments in the global south have led to increased inflation which has put the poorest on the margins. Governments as primary duty bearers are crippled by reduced revenues and high rates of debt servicing which has negatively affected provision of public services . Public services are vital goods and services that provide a foundation for dignified and enriching …

Vested Patents And Equal Justice, Adam Macleod
Vested Patents And Equal Justice, Adam Macleod
Catholic University Law Review
In a time of renewed interest in equal justice, the vested patent right may be timely again. Vested patent rights helped marginalized Americans to secure equal justice earlier in American history. And they helped to make sense of the law. Vested patent rights can perform those tasks again today.
The concept of vested rights render patent law coherent. And it explains patent law’s interactions with other areas of law, such as property, administrative, and constitutional law. The vested rights doctrine also can serve the requirements of equal justice, as it has several times in American history. Vested rights secure justice …
"The Land That Feminism Forgot": Birthzillas, Madwives, And The Politics Of Chilbirth, Amber Vayo
"The Land That Feminism Forgot": Birthzillas, Madwives, And The Politics Of Chilbirth, Amber Vayo
Doctoral Dissertations
“The Land that Feminism Forgot” is an in-depth exploration of the politics of childbirth that draws together qualitative and quantitative evidence to theorize the connections between treatment in childbirth and maternal mortality. Situating the qualitative research in the larger national context, the second chapter offers a State Reproductive Autonomy Index that provides an overview of the reproductive policy landscape at the national level. The dissertation then explores the role of institutionalized childbirth, medical mistrust, and obstetric violence in the U.S.’s longstanding maternal mortality crisis and offers policy suggestions in key public health areas. Through 120 qualitative interviews with people who …
Jurisprudential And Legal Perspectives On The Protection Of Rights And Freedoms In The 2021 Basic Statute Of The Sultanate Of Oman, M. Mhalla, A. K. Hamid, A. Al-Riyami
Jurisprudential And Legal Perspectives On The Protection Of Rights And Freedoms In The 2021 Basic Statute Of The Sultanate Of Oman, M. Mhalla, A. K. Hamid, A. Al-Riyami
Information Sciences Letters
In this paper, we examine the constitutional protection of economic rights and freedoms in the Basic Statute of the Sultanate of Oman. Through descriptive, analytical, and historical approaches, the study identifies the protection and mechanisms for attaining social justice according to the Basic Statute to achieve Omans 2040 vision. The study concludes that courts must refrain from applying laws that violate the Basic Statute, and that weak guarantees of economic and social rights and freedoms hinder their protection and prevent the achievement of Oman Vision 2040. The study recommends spreading a culture of human rights and education on economic, social, …

Gender In Cultural History: Gender And Education, Dimitra Kalodimou, Maria Kapalika
Journal of Research Initiatives
The position of women in the oldest societies has often occupied the scientific community, which is a great reason to study it. Today's societies put tremendous effort into highlighting the importance of women's contribution. In this text, we will deal with the position of women in the recording of history, with women’s presence within the historical sources as well as the roles held in family business and education. In addition, the gradual changes regarding women's recovery in society will be presented and highlighted. The first steps to improve women's image started in Europe and continued worldwide. The critically studied articles …
The Five Internet Rights, Nicholas J. Nugent
The Five Internet Rights, Nicholas J. Nugent
Washington Law Review
Since the dawn of the commercial internet, content moderation has operated under an implicit social contract that website operators could accept or reject users and content as they saw fit, but users in turn could self-publish their views on their own websites if no one else would have them. However, as online service providers and activists have become ever more innovative and aggressive in their efforts to deplatform controversial speakers, content moderation has progressively moved down into the core infrastructure of the internet, targeting critical resources, such as networks, domain names, and IP addresses, on which all websites depend. These …

Determinants Of Indigenous Rights Adoption In Latin America: Political Implications And Incrementalism 1960-2016, Samantha Ann Hagle
Theses and Dissertations
Broadly, this work asks: what leads to the varied political status of indigenous populations in Latin America? From a uniform point of political exclusion, in recent decades governments in the region have adopted various degrees of constitutional reforms to protect their original populations. Some indigenous populations in Latin America remain unrecognized, like those in Chile. Others have gained some recognition and access to equal democratic rights. In other countries, like Bolivia, indigenous peoples have the potential to gain constitutional autonomy and regional self-government for their communities. First, I argue that the rights expansion process depends partially upon the content of …

End Felony Disenfranchisement And Restore The Right To Vote, Anna Lahr, Hannah Van Otterloo, Nichole Smith, Taylor Ernste
Master of Social Work Student Policy Advocacy Briefs
In Minnesota, felony disenfranchisement is the withdrawal of voting rights of individuals with a criminal offense through incarceration, probation, parole, or supervised release. Current felony disenfranchisement laws prohibit roughly 55,000 Minnesotans' right to vote long after their release from incarceration. This law specifically suppresses Minnesotans of color, vulnerable populations, and low-income communities. Promptly restoring the right to vote for individuals with felony convictions upon release from imprisonment will promote equality in voter representation for actively contributing members of society.

Exploring The Potential Of Administrative Data For Understanding And Advancing Child Protection And Family Support Policy, Practice And Research In Ireland, Donna O'Leary, Olive Lyons
Irish Journal of Applied Social Studies
It is generally understood that administrative data at the level of the individual, family and wider population is fundamental to delivering client centred services which aim to support families and respond to, and reduce child abuse. They are valuable to policy makers and practitioners and play an important role in research. The focus of this paper is the potential use of administrative data from statutory family support and child protection and welfare services in Ireland for policy, practice and research. In the context of an evolving legislative and policy framework in Ireland, we provide an overview of the statutory family …

The Right To Data Encryption, Steven W. Schlesinger, Dr. Shlomit Yanisky-Ravid
San Diego Law Review
Technology drives our society, and we are data-dependent as a people. Though the legal system in the United States lacks neither basic protections nor methods to address data protection-related issues, this Article proposes an essential and more robust alternative.
This Article introduces the prevalence and reliance on data and stored information, noting the growing need for a better balance between enabling users’ ability to access encryption tools and the threats and concerns from a governmental perspective for malicious use of encryption tools for criminal and terror purposes.
The Article first recounts a brief history of encryption, focusing on its growing …
