An Update On The Courts, Academic Freedom And Creationists: The Peloza, Johnson, And Bishop Cases, Jerry Bergman

Proceedings of the International Conference on Creationism

A review of the Peloza, Johnson, Bishop, and other cases involving creationists educators terminated or censored due to their objections to naturalistic evolution illustrates the current trend for the courts to rule against educators who are labeled not only creationists, but also Christians. These examples illustrate that the law and past Supreme Court rulings are commonly misapplied, abused, or judges openly prevaricate about the conclusions of current and previous cases. The focus on this review is on tying these cases together and outlining current trends.

The last 40 years have seen a dramatic shift in the hiring, evaluation and promotional structures prevalent in higher education. While the model of a largely full time, tenure-track faculty continues to be the ideal of most academic institutions, economic, political and social changes have eroded that model. A substantial percentage, typically a majority, of college and university faculty are now hired on a contingent or part-time basis, with fiscal and other conditions determining job security, compensation, professional advancement, and an opportunity to participate in governance of departments and institutions. Rescinding Admission Offers In Higher Education: The Clash Between Free Speech And Institutional Academic Freedom When Prospective Students' Racist Posts Are Exposed, Clay Calvert

This Article examines the tension between a prospective college student's First Amendment freedom of speech and a public university's unenumerated, inchoate right of institutional academic freedom. The friction between these interests was cast in high relief in 2020 when several schools confronted dual issues: (1) whether to rescind offers of admission to individuals who later were discovered to have engaged in offensive speech, and (2) whether revoking admission offers because of odious, hateful messages would violate the constitutional right of free expression. A Critical Discourse Analysis Of The Professoriate And The Embodiment Of Epistemic Coloniality/Whiteness: A Call For A Contemplative Approach To Academic Freedom, Faith Yacubian

Higher education in the United States has largely been influenced by colonial discourse. Archetypes of the academy, namely the professoriate, reflect and inhabit traces of Western or European schools of thought and colonial genealogy. Inspired by Black, Indigenous Students of Color (BISOC) at a small, private college in the Northeast, this writing aims to unveil the colonial lineage embodied by the professoriate through habits of whiteness. With the use of Critical Discourse Analysis and reflective anecdotes, observations are made about the professoriate’s epistemology and academic freedom’s role in reinforcing colonial epistemic principles, such as objectivity, mastery and autonomy.
