This article aims at exploring the contribution that creative forms of research can make to the study of a little-known aspect of academic freedom in the Canadian context – academic freedom in curriculum development. It seeks to address the methodological challenge posed by research on academic freedom, that is, the fact that any academic writing on this topic necessarily draws initially, though not exclusively, from the researchers’ own experiences and perspectives. The Academic and Intellectual Freedom Ad Hoc Committee presented a First Thursday discussion on May 4 about academic and intellectual freedom. Starting with a brief definition of these terms, they traced the history of Academic Freedom and how current events affect us at FIU. The committee posed several real-life scenarios threatening Academic/Intellectual Freedom in libraries. All library staff were invited to attend this lively discussion.

AAUP’s turn to collective bargaining grew out of a more expansive view of unionization than is typical for American labor unions. The mission of the AAUP incorporates addressing economic matters, as does the purpose of unions generally. But the AAUP adopted collective bargaining as a means of protecting and expanding the professional interests of the profession. This paper surveys the various approaches that AAUP chapters have used to accomplish the safeguarding and expansion of academic freedom.

The article focuses on the principles of academic freedom and the application of those principles in the context of faculty speech. Topics include the origins and endorsement of the 1940 Statement of Principles on Academic Freedom and Tenure, the distinction between speech as a citizen and disciplinary speech, and a proposal for revising academic freedom policies and establishing a faculty committee for adjudication.

The Intersection Of Academic Freedom And Trigger Warnings, Ashleigh Maldonado

The purpose of this policy brief is to explore the intersection of academic freedom and trigger warnings. The author argues that the vague language within academic freedom policies and the blurred lines between judicial jurisdiction over first amendment rights and institutional jurisdiction over academic freedom policies sets the stage for future limitations on teachers’ rights within the classroom. Te author also argues that while much attention is given to the academic freedoms of instructors, more attention should be afforded to the academic freedoms of students when considering their requests for trigger warnings.

Released in 2017, Jordan Peele’s critically acclaimed film Get Out explores the horrors of racism. The film’s plot involves the murder and appropriation of Black bodies for the benefit of wealthy, white people. After luring Black people to their country home, a white family uses hypnosis to paralyze victims and send them to the Sunken Place where screams go unheard. Black bodies are auctioned off to the highest bidder; the winner’s brain is transplanted into the prized Black body. Black victims are rendered passengers in their own bodies so that white inhabitants can obtain physical advantages and immortality.

The purpose of this study is to explore the perception of scholarship requirements for faculty members teaching in Health Professions Programs (HPP) at a public institution of higher learning located in NYC. This research was guided by the self-determination theory (SDT), which examines how an individual's social interaction can influence different types of motivations. Guided by a central research question and two sub-questions, this study utilized a transcendental phenomenological approach to gain a better understanding of HPP faculty perceptions regarding the requirements for academic scholarship. The right-wing attack against critical race theory is the latest manufactured panic designed to whip up supporters of a party beholden to Donald Trump. Since late 2020, hundreds of measures have been introduced across the U.S. to ban antiracism education, critical race theory, the 1619 Project, and any understanding of racism as systemic and embedded in U.S. history and law. Transition Design offers a framework and employs an array of tools to engage with complexity. “Cancel culture” is a complex phenomenon that presents an opportunity for administrators in higher education to draw from the Transition Design approach in framing and responding to this trend. Faculty accused of or caught using racist, sexist, or homophobic speech are increasingly met with calls to lose their positions, titles, or other professional opportunities. Such calls for cancellation arise from discreet social networks organized around an identified lack of accountability for social transgressions carried out in the professional school environment. In this study, academic freedom in teacher education is related to preservice teachers’ possibilities to develop critical and autonomous thinking in teaching practice. Self-awareness and self-confidence provide certainty to deal with the uncertain situation in teaching where creativity and judgment must be given priority over an instrumental teaching based on authorities, effective methods or ready-made solutions. Although academic freedom is considered a pillar of the academy in the United States, little legal precedent has been established to legitimize faculty academic freedom. Moreover, no legislation or case law outlines a hierarchy of academic freedom whereby institutional academic freedom may be positioned as authoritative over faculty academic freedom or vice versa. As a result, many institutions of higher education have violated academic freedom and then subsequently apologized for overstepping legal boundaries, stemming from infringing upon individuals’ rights that have not been codified through law. Teaching is one of the primary responsibilities of most university faculty members. Yet, pedagogical training and professional development in teaching and experiential learning are not employment requirements for most Ontario university faculty. This incongruence impacts faculty’s sense of self-efficacy, ability to protect their academic freedom, and their ability to design pedagogically informed curriculum. Additionally, it can negatively impact student outcomes while influencing institutional reputations and funding. In response, recommendations to address this problem of practice (PoP) must acknowledge the faculty prerogatives of autonomy, self-governance, and academic freedom. It has become an accepted commonplace that college admissions officers will view applicants’ social media profiles as part of the screening process. Between 25 and 40 percent of admissions employees, according to one annual survey, look at candidates’ social media feeds -- and, by one study, 8 percent of admissions officers at public institutions have made an adverse decision based on something they found on social media. Lost in this discussion is that state universities are bound by the First Amendment in every other speech-based decision they make. Discussion of the ways in which Open Access (OA) and academic freedom interact is fraught for a number of reasons, not least of which is the unwillingness of some participants in the discussion to acknowledge that OA might have any implications for academic freedom at all. Thus, any treatment of such implications must begin with foundational questions. An Update On The Courts, Academic Freedom And Creationists: The Peloza, Johnson, And Bishop Cases, Jerry Bergman
Proceedings of the International Conference on Creationism
A review of the Peloza, Johnson, Bishop, and other cases involving creationists educators terminated or censored due to their objections to naturalistic evolution illustrates the current trend for the courts to rule against educators who are labeled not only creationists, but also Christians. These examples illustrate that the law and past Supreme Court rulings are commonly misapplied, abused, or judges openly prevaricate about the conclusions of current and previous cases. The focus on this review is on tying these cases together and outlining current trends.

The last 40 years have seen a dramatic shift in the hiring, evaluation and promotional structures prevalent in higher education. While the model of a largely full time, tenure-track faculty continues to be the ideal of most academic institutions, economic, political and social changes have eroded that model. A substantial percentage, typically a majority, of college and university faculty are now hired on a contingent or part-time basis, with fiscal and other conditions determining job security, compensation, professional advancement, and an opportunity to participate in governance of departments and institutions. This Article examines the tension between a prospective college student's First Amendment freedom of speech and a public university's unenumerated, inchoate right of institutional academic freedom. The friction between these interests was cast in high relief in 2020 when several schools confronted dual issues: (1) whether to rescind offers of admission to individuals who later were discovered to have engaged in offensive speech, and (2) whether revoking admission offers because of odious, hateful messages would violate the constitutional right of free expression.
