Performing Discretion Or Performing Discrimination: An Analysis Of Race And Ritual In Batson Decisions In Capital Jury Selection, Melynda J. Price

Research shows the mere presence of Blacks on capital juries--on the rare occasions they are seated--can mean the difference between life and death. Peremptory challenges are the primary method to remove these pivotal participants. Batson v. Kentucky developed hearings as an immediate remedy for the unconstitutional removal of jurors through racially motivated peremptory challenges. These proceedings have become rituals that sanction continued bias in the jury selection process and ultimately affect the outcome of capital trials. This Symposium Essay examines the campaign that led up to the last presidential election to illuminate the complex interplay between race and class within our society. Specifically, it explores how race and class functioned together to disadvantage President Obama in the race to the White House (even as he ultimately won the election). Section II focuses on how Obama’s income, job status, and prestigious education functioned as markers of elitism during the campaign, even as compared to opponents with more elite and wealthier backgrounds, and how these factors were used as tools by his opponents to convince lower-class white voters …

Identity Development Among Black Gay Men : The Relationship Between Racial And Sexual Orientation Identity Development, Sandra Lauren Dipillo

This study examined the relationship between racial and sexual orientation identity development among Black gay men. Preliminary research implied that the relationship between these two processes was complex though there was little research that explored it. Fifty-seven Black gay men participated in an anonymous online survey which asked a range of questions about racial and sexual orientation identity as well as the experience of being both Black and gay. Findings indicated that Black gay men experience more internalized homophobia and racism than individuals who are Black or gay but not both. This study was conducted to ascertain the kinds of messages that African Americans are being exposed to that introduce them to the existence and reality of skin color bias within the African American community. This included identifying the time frame, source, and nature of those exposures as well as exploring the efforts African Americans have made to try to protect younger generations of African Americans from the impact of skin color bias within the African American community.
