Master's Theses

The purpose of this research is to argue that U.S. immigration policy, specifically the 1996 IIRIRA (also known as IIRAIRA), needs to change regarding the legal treatment of immigrant U.S. military veteran deportees due to the following concepts. The first concept is to articulate how the criminalization of immigration, and how the military system intersects to facilitate the Deportation of U.S veterans. A key concept in this analysis is the standard of “good moral character” set by the U.S. government that enlistees need to meet to be accepted into the military; this standard is also used against immigrant veterans during …

Enforcing Higher Standards For Flood Hazard Mitigation In Vermont, Tamsin Flanders Dec 2020

Enforcing Higher Standards For Flood Hazard Mitigation In Vermont, Tamsin Flanders

Masters Theses

The state of Vermont faces increasing risk of costly damage from catastrophic flooding events as climate change increases the frequency of heavy rains and cumulative precipitation. In addition to increasing flood inundation risk, extreme precipitation events are leading to high rates damage from fluvial erosion—erosion caused by the force of floodwater and the materials it carries. As in all U.S. states, flood hazard governance in Vermont is shared by multiple levels of government and involves a complex compliance model that relies on local governments to regulate private property owners to achieve community, state, or federal goals.

To encourage municipalities to …

Just A Girl In A Man’S World: Factors Affecting Women In Leadership In Law Enforcement, Gina Barras Holland

University of New Orleans Theses and Dissertations

Federal Bureau of Investigation (FBI) statistics from 2013 revealed that of about 477,000 sworn law enforcement officers at the local level in the United States, only 12% are women; and only 6.2% of those who hold intermediate-level rank are women (U.S. Department of Justice, Bureau of Justice Statistics, Local Police Department, 2013: Personnel, Policies, and Practices, 2015). Although legal mandates have afforded women career opportunities in law enforcement, those mandates have not provided protection within the structures of law enforcement agencies regarding achieving high ranking positions. Women are more likely than men to remain in lower-ranking positions throughout their entire …

A Crisis Within A Crisis: Nyc Landlords Ramp Up Harassment Of Vulnerable Tenants In Wake Of Pandemic, Joseph A. Jungermann Iii

Capstones

Already burdened with more sickness and death during the pandemic than other New Yorkers, low-income tenants and tenants of color are particularly vulnerable to additional harassment by landlords who seek to take advantage of the city's health and financial crisis to force them out. Brooklyn residents Delene Ahye, Dexter Lendor and Sonny Singh tell stories of their landlord, landlord agents and building manager’s harassment, which began during the pandemic’s most dangerous spikes in New York City. These forms of harassment included intimidation, abusive construction, constant buyout offers and biometrics and surveillance technology.

Who Upholds Your Human Rights When You Are “Stateless?” Why Couldn’T The Un Protect The Rohingya’S Human Rights?, Hyochan Lee

Student Theses and Dissertations

In 2017, genocide in Myanmar took place against the stateless minority Rohingya Muslims. Why couldn’t the UN protect the Rohingya’s human rights? The international community's efforts to oppose these violations against the stateless people have been only passive. Then, who upholds your human rights when you are stateless? Using chronology, historical institutionalism, and process tracing analyses, this thesis (1) evaluates the UN’s legal regime’s systemic design and capabilities in protecting human rights; then (2) identifies the design flaws of our international human rights regime; and lastly, (3) develops a recommendation to protect all people, stateless or not. Based on both …

Federation Divided, Max M. Balton Dec 2020

Federation Divided, Max M. Balton

Capstones

At the start of the 2020 school year, a lack of covid safety plans led teachers like Rosy Clark to protest, urging her union the United Federation of Teachers to act. She and other progressives in the dissident caucus, Movement of Rank and File Educators, were willing to strike to ensure their safety. Union leadership hesitated largely because public union strikes are illegal under the state’s Taylor Law.

This four-part audio documentary looks at the history of the UFT and this contentious state law. The union began striking under more onerous strike prohibition legislation. Its roots are steeped in radical …

Baldia Town Factory Inferno: Justice Delayed And Denied, Rabia Bugti

MSJ Capstone Projects

The Baldia Town Factory Fire — as it came to be known — was one of the deadliest incidents in the history of Pakistan — the 9/11 of the country.

Over 260 ill-fated people lost their lives in the garments factory named Ali Enterprises, 16 of whom were charred beyond recognition. In September this year, finally after eight years, the anti-terrorism court announced its verdict (ANTI-TERRORISM COURT, 2017). Two key culprits were sentenced to death and four handed life imprisonment. According to the joint investigation team’s report, the factory was set on fire deliberately by the facilitators of a political …

After Nypd: Scores Of New York City Police Officers With Substantiated Complaints Move To New Public Safety Jobs., Luca Powell

Capstones

In the wake of the nation’s 2020 summer protests about policing and use of force, New York State made public the Civilian Complaint Review Board records documenting complaints against police officers, including those at the NYPD, an agency with just over 34,000 officers. Those records showed that officers with substantiated accusations of misconduct and use-of-force were able to remain at the department and get promoted.

The New York City Civilian Complaint Review Board documents show something else: A New York City News Service review found at least 81 former NYPD officers with substantiated accusations of wrongdoing have been able to …

A study on what fairness means both in ethical and economical terms is done to suggest a new basis of a fair …

Corporations And The American Polity, Patrick Labossiere Dec 2020

Corporations And The American Polity, Patrick Labossiere

Student Theses and Dissertations

Research on corporate communications’ effects on politics presents an acknowledgement of a relationship between the two topics, leaving a void in the explanation and examination of this topic. The void presents an opening to introduce a conceptual process for how corporations are able to craft communications to influence the American Polity, the democratic social organization within the United States. This research begins with a historical review of how corporations gain prominence in American society, capturing the ability to participate in the democratic social organization of the polity. A qualitative analysis of several conceptual frameworks serves as data, to establish an …

Pirate Radio Proves Invaluable To Immigrant Communities During The Pandemic — But The Fcc Isn’T Having It, May Olvera Dec 2020

Pirate Radio Proves Invaluable To Immigrant Communities During The Pandemic — But The Fcc Isn’T Having It, May Olvera

Capstones

In January 2020, congress passed the PIRATE Act into law, expanding the legal consequences for operating pirate radio tenfold. Although the FCC claims that the reason they are cracking down on pirate stations — that is, stations broadcasting on regulated airwaves without an FCC license — is that they could interfere with emergency messaging, the pandemic has proven otherwise; there is no evidence of pirates interfering with official safety warnings. In fact, most pirate stations are run by immigrants speaking in their native tongue and they have been able to provide vulnerable and underserved communities with the information they need …

Crisis Within A Crisis: A Comparative Analysis Of Covid-19’S Implications On Greece And Spain’S Migrant And Refugee Processing Policies, Injy Elhabrouk

Undergraduate Honors Theses

With the onset of the COVID-19 pandemic came a collective global panic regarding health, safety, and security. Since the major outbreak of the coronavirus in March of 2020, few issues have received scrutiny and attention in the public sphere. Yet, the problems that existed before COVID-19 have not become obsolete, however, they were removed from the public eye. One such issue to receive less scrutiny is the treatment of the most vulnerable populations in the world—migrants and refugees. Spain and Greece’s locations on the Mediterranean Sea mean they are often the first place migrants seek refuge in their journey to …

Cannabis For Therapeutic Purposes: Older Adult Perspectives, User Characteristics And Motivations For Use, Lean Fiedeldey

Electronic Thesis and Dissertation Repository

Use of cannabis among adults 55 years of age and older is increasing. In Q4 of 2018, slightly over half of cannabis users used for therapeutic purposes at least once, where many reported using for both medical and non-medical reasons (mixed use). Research on older adults regarding the use of Cannabis for Therapeutic Purposes (CTP) is fragmented and there are no comprehensive or in-depth studies on their perceptions or self-reported motivations. Understanding in these areas is important to inform policy that takes the protection of public health and safety as central aims. Does policy affect one of, if not both, …

Disparities In Oral Health: Socioeconomic Status And Policies To Increase Access To Primary Dental Care, Mckenzie Nutter

Theses/Capstones/Creative Projects

Primary dental care is a patient-centered service consisting of routine dental checkups. The oral cavity is the first point of entrance to the body for many harmful pathogens. Therefore, primary dental care is essential to not only prevent and treat conditions in the mouth, but to also reduce the number of systemic diseases in the rest of the body. However, people with higher incomes or wealth have increased access to primary dental care. People with low socioeconomic status have decreased access to primary dental care, at least in part due to difficulties in paying for separate dental insurance. Disparities in …

Copyright's Fixation Requirement: Is It Still Needed?, Attamongkol Tantratian Dec 2020

Copyright's Fixation Requirement: Is It Still Needed?, Attamongkol Tantratian

Maurer Theses and Dissertations

While the United States requires fixation for an original work to be entitled to federal copyright protection, many other countries ignore such requirement. The difference could lead to partial copyright protection standards across jurisdictions over certain works that are not fixed. Examples of such works include extemporaneous speeches, lectures, improvisational performances, and contemporary arts that are transitory. Moreover, with today’s rapid development of arts and technologies, creative works can be presented via new media without being fixed in a traditional way. The examples include live streams of lectures and music performances, which have become part of the “new normal.” In …

Law Student Works

The Small Business Reorganization Act of 2019 (SBRA) went into effect on February 19, 2020 to provide small businesses bankruptcy relief that was previously untenable under a traditional chapter 11 reorganization. The SBRA created subchapter V of chapter 11, codified as 11 U.S.C. §§ 1181 – 1195, that is available for small business debtors with debts less than $2,725,625. The debt limit has been temporarily increased to $7,500,000 until March 26, 2021 by the Coronavirus Aid, Relief, and Economic Security Act (the CARES Act).

The timing of the new law could not have been better considering how small businesses have …

Gender Pay Discrimination & The Equal Pay Act: Legal Research & Methods, Emily Sullivan

Law Student Works

More than 50 years since the Equal Pay Act (1963) was passed, the subject of wage inequality between the sexes remains a critical topic for women, members of Congress, advocacy groups, business and legal communities. Within the last decade, the legal community has seen a wave of litigation alleging discrimination across a wide variety of industries, including within the legal field itself. Wage discrimination has negative consequences for women, communities, and employers—discrimination in the workplace is inefficient and resulting litigation is costly.

In this Pathfinder guide, you will find a brief background on the Equal Pay Act as it pertains …

Racial Adultification And The American Criminal Justice System, Keshia Dauphin

Master’s Theses and Projects

African Americans are overrepresented in the criminal justice system and known to experience disadvantages in society because of their race, ethnicity and sometimes gender. With determination to understand the barriers that hinder African Americans from equal opportunities; this thesis explores the disparities against Black boys in the American criminal justice system. This thesis uses a qualitative study approach in which I analyze three historical cases that happened in different eras, George Stinney Jr. (1944), Central Park Five (1989); and Tamir Rice (2014). Each case will demonstrate the denial of Black childhood and Black boys being seen as adults, mistreated and …

Prenatal Care For Undocumented Women In The United States, Cristina Mendoza Dec 2020

Prenatal Care For Undocumented Women In The United States, Cristina Mendoza

Nursing | Senior Theses

Background: While prenatal care is an essential preventive service, access is not equal. Undocumented immigrants in the United States face many barriers that prevent them from accessing primary health care needs, including adequate prenatal care. Throughout the United States, standard Medicaid provides coverage for all pregnancy-related care, encompassing the antenatal period, childbirth, and postpartum. However, undocumented women do not qualify to receive these services. Many studies showed that lack of prenatal care for undocumented pregnant women jeopardizes their health and their neonates’ health by increasing their risk of complications related to pregnancy and birth. Objective: To bring awareness of the …

Brazil has the largest sugarcane acreage in the world (FAOSTAT, 2020) and is the world leader in the production of sugarcane-based ethanol (Sousa Junior et al., 2017). Due to the technical experience in the production of biofuels and the availability of sugarcane straw and bagasse, the country has a great potential to commercially produce second-generation ethanol (E2G) (Nyko et. al., 2010). In 2017, Brazil enacted a new National Biofuels Policy, called RenovaBio, to expand the production and use of biofuels in the country. This dissertation combines three essays that explore biofuels law and policy with a special focus on Brazil. …

Comparative Views On Age Discrimination Within Appellate Court Decisions: Utilizing Werner And Bolino’S Framework, Daniel Trinkle

Undergraduate Honors Theses

The manner by which courts view performance appraisals in relation to the outcome of case is certainly a topic worthy of discussion. Utilizing the framework used within the work of Werner and Bolino (1997), the following study was able to accomplish two main goals: (1) update the information of Werner and Bolino (1997) by evaluating modern cases, and (2) to evaluate new data regarding age discrimination utilizing the same framework as Werner and Bolino (1997). Utilizing chi-square analysis to test all of the hypotheses, it was demonstrated that there was statistical significance in performance appraisals with the presence of a …
