This essay contends that there is a structural element of federal law and policy that sets up legal battles over American Indian sacred sites. The Supreme Court has held that whatever rights groups may have at sacred sites, the federal government's rights as owner and sovereign of the public lands ultimately prevails. Federal agencies can, if they choose, accommodate various interests on the public lands, but such decisions are left to fluctuating executive policy and the discretion of land managers. This approach reflects well-established doctrine in public lands law, but leaves various citizens and groups clamoring for the federal government …

The Next Epidemic: Bubbles And The Growth And Decay Of Securities Regulation, Erik F. Gerding

This article explores how speculative bubbles undermine the effectiveness of securities regulations and spawn epidemics of securities fraud. A brief historical survey demonstrates that stock market bubbles almost invariably coincide with epidemics of securities fraud, and provides a compelling argument that the outbreak of fraud in the Enron era did not stem merely from factors unique to the 1990s, but from the dynamics of an asset price bubble as well.
Drawing on perspectives from securities law practice and economic theory, the article argues that bubbles dilute the deterrent effect of antifraud rules and promote deregulation. Both effects alter the calculus …

On December 13, 2005, the Governors and Premiers of the Great Lakes states and provinces signed a Compact and Agreement that commits the parties to a rigorous program to regulate individual water uses, with citizen suits to enforce the requirements. While the Great Lakes-St. Lawrence River Basin Water Resources Compact and companion Agreement are commendable in many respects, this Article argues that people who care about the future of the Great Lakes should urge policymakers to reject the current proposals and rethink the entire approach. This article captures the effort of the Digital Age Communications Act (DACA) to craft a new framework for the federal-state relationship in implementing a next generation telecommunications regulatory regime. In particular, it sets forth a DACA model that would implement a "rule of law" regulatory paradigm for an era of technological dynamism. This era requires, as the article explains, a coherent federal framework that circumscribes the role of state and local authorities so as to advance sound competition policy goals. Secure deletion programs purport to permanently erase files from digital media. These programs are used by businesses and individuals to remove sensitive information from media, and by criminals to remove evidence of the tools or fruits of illegal activities. This paper focuses on the trace evidence left by secure deletion programs. In particular, five Windows-based secure deletion programs are tested to determine if they leave identifiable signatures after deleting a file. The results show that the majority of the programs leave identifiable signatures. Moreover, some of the programs do not completely erase file metadata, which enables forensic investigators to extract …

This paper describes procedures for conducting forensic examinations of Apple Macs running Mac OS X. The target disk mode is used to create a forensic duplicate of a Mac hard drive and preview it. Procedures are discussed for recovering evidence from allocated space, unallocated space, slack space and virtual memory. Furthermore, procedures are described for recovering trace evidence from Mac OS X default email, web browser and instant messaging applications, as well as evidence pertaining to commands executed from a terminal.

The application of flight simulation to meet pilot training needs continues to evolve. Flight simulations built with powerful and inexpensive computers are making high fidelity simulation available as a medium for training ab-initio pilots at Pilot Schools and Training Centers. The researchers conducted an 18-month study that applied an experimental flight-training curriculum comprised of 60% flight training device (FTD) flight and 40% airplane flight to certify Private Pilots under Federal Aviation Regulation (FAR) Part 142. This article presents a modeling framework that represents bus priority at signalized intersections in the context of its potential network-level and intermodal effects. The model incorporates bus priority within an intermodal dynamic traffic assignment simulation model. It dynamically assigns travelers to different modes and routes in the network according to prevailing traffic conditions, which result from applying a certain network control/bus priority scheme. The model considers changes in traffic conditions as a result of (1) drivers’ route choice adjustments due to changes in traffic signals settings and (2) modal shifts by travelers to take advantage of improved transit service. A reduced proper motion diagram utilizing Sloan Digital Sky Survey (SDSS) photometry and astrometry and USNO-B plate astrometry is used to separate cool white dwarf candidates from metal-weak, high-velocity, mainsequence Population II stars (subdwarfs) in the SDSS Data Release 2 imaging area. Follow-up spectroscopy using the Hobby-Eberly Telescope, the MMT, and the McDonald 2.7 m telescope is used to demonstrate that the white dwarf and subdwarf loci separate cleanly in the reduced proper motion diagram and that the contamination by subdwarfs is small near the cool white dwarf locus. We investigated a simultaneous temporally and spatially resolved 2-D velocity field above a burning circular pan of alcohol using particle image velocimetry (PIV). The results obtained from PIV were used to assess a thermal particle image velocimetry (TPIV) algorithm previously developed to approximate the velocity field using the temperature field, simultaneously captured by an infrared (IR) thermal camera. By tracing “thermal particles,” which were assumed to be virtual particles that corresponded to pixels of temperature values in successive IR images, the TPIV algorithm estimated a larger scale instantaneous velocity field than either a single-point velocity measurement (e.g., LDV) or the …

Investigation of Earth’s mesosphere using sounding rockets equipped with a myriad of instruments has been a highly active field in the last 2 decades. This paper presents data from three separate instruments: an RF impedance probe, a DC fixed bias Langmuir probe, and an electric field probe, that were flown on a mesospheric sounding rocket flight investigating the presence of charged dust within and/or around a sporadic metal layer. The ability to capture prey and avoid predation in aquatic habitats depends strongly on the ability to perform unsteady maneuvers (e.g. turns), which itself depends strongly on body flexibility. Two previous studies of turning performance in rigid-bodied taxa have found either high maneuverability or high agility, but not both. However, examinations of aquatic turning performance in rigid-bodied animals have had limited taxonomic scope and, as such, the effects of many body shapes and designs on aquatic maneuverability and agility have yet to be examined. Turtles represent the oldest extant lineage of rigid-bodied vertebrates and the only aquatic rigid-bodied tetrapods. We …
