Large majorities of consumers believe that the term "privacy policy" conveys a baseline level of information practices that protect their privacy. In short, "privacy," like "free" before it, has taken on normative meaning in the marketplace. When consumers see the term "privacy policy," they believe that their privacy will be protected in specific ways. In particular, when consumers see the "privacy policy" they assume that a web site will not share their personal information. Of course, this is not the case. Two opposing conceptions of responsibility animate the debate about reparations for slavery. Opponents of reparations espouse an individualist conception, and hold that one may be held responsible only for an action in which she participated directly, and only to the extent that her contribution caused harm. Since no contemporary citizen participated in slavery, opponents conclude that no contemporary citizen has a duty of repair. Supporters of reparations, or reparationists, adopt or develop theories of collective responsibility, according to which responsibility attaches to a group first and foremost, and then gets ascribed to the group's members derivatively. Recent efforts at fetal protection transgress the nation's most fundamental political commitments. These efforts notably include the enactment of the Unborn Victims of Violence Act (UVVA) in 2004 and, in 2002, a doctrinal development that presaged the potentially illiberal effects of the UVVA when a Michigan court recognized a woman's right to use deadly force to protect her fetus even as it denied her right to self-defense. This Article adopts a theory of political liberalism that can be traced from the Founders to contemporary political theorists, and argues that the UVVA, as well as the extension of defense of others …
