The Need For A Law Of Church And Market, Nathan B. Oman
The Need For A Law Of Church And Market, Nathan B. Oman
Nathan B. Oman
This Essay uses Helfand and Richman’s fine article to raise the question of the law of church and market. In Part I, I argue that the question of religion’s proper relationship to the market is more than simply another aspect of the church-state debates. Rather, it is a topic deserving explicit reflection in its own right. In Part II, I argue that Helfand and Richman demonstrate the danger of creating the law of church and market by accident. Courts and legislators do this when they resolve questions religious commerce poses by applying legal theories developed without any thought for the …

God And The Executioner: The Influence Of Western Religion On The Use Of The Death Penalty, Davison M. Douglas
God And The Executioner: The Influence Of Western Religion On The Use Of The Death Penalty, Davison M. Douglas
Davison M. Douglas
In this Essay, Professor Douglas conducts an historical review of religious attitudes toward capital punishment and the influence of those attitudes on the state's use of the death penalty. He surveys the Christian Church's strong support for capital punishment throughout most of its history, along with recent expressions of opposition from many Protestant, Catholic, and Jewish groups. Despite this recent abolitionist sentiment from an array of religious institutions, Professor Douglas notes a divergence of opinion between the "pulpit and the pew" as the laity continues to support the death penalty in large numbers. Professor Douglas accounts for this divergence by …

Use Of Spiritual Coping Strategies By Gender, Race/Ethnicity And Religion At 1 And 3 Months After Infant’S/Child’S Intensive Care Unit Death, Dawn Hawthorne, Joanne M. Youngblut, Dorothy Brooten
JoAnne Youngblut
Background and purpose
In the US, 57,000 children (newborn-18 years) die annually. Bereaved parents may rely on religious or spiritual beliefs in their grief. The study’s purpose was to examine differences in parents’ use of spiritual and religious coping practices by gender, race/ethnicity and religion at one and three months after infant/ICU death.
Methods
The sample consisted of 165 bereaved parents; 78% minority. The Spiritual Coping Strategies Scale was used to measure religious and spiritual coping practices, separately. One-way ANOVAs indicated that Black non-Hispanic mothers used significantly more religious coping practices at 3 months than White non-Hispanic mothers. Protestant and …

The Legacy Of Civil Rights And The Opportunity For Transactional Law Clinics, Lynnise E. Pantin
Lynnise E. Pantin
At the end of the historic march from Selma to Montgomery in 1965, Reverend Dr. Martin Luther King Jr. famously paraphrased abolitionist and Unitarian minister Theodore Parker stating, “the arc of the moral universe is long, but it bends towards justice.” The implication of the phrase is that the social justice goals of the Civil Rights Movement would eventually be achieved. His prayer was that servants of justice would be rewarded in due time. In other words, that the goals of the Civil Rights Movement would be achievable at some point in the future. President Obama resurrected the phrase throughout …

Jeffrey M. Greeson
Objective: Mindfulness-based stress reduction (MBSR) is a secular meditation training program that reduces depressive symptoms. Little is known, however, about the degree to which a participant's spiritual and religious background, or other demographic characteristics associated with risk for depression, may affect the effectiveness of MBSR. Therefore, this study tested whether individual differences in religiosity, spirituality, motivation for spiritual growth, trait mindfulness, sex, and age affect MBSR effectiveness.
Methods: As part of an open trial, multiple regression was used to analyze variation in depressive symptom outcomes among 322 adults who enrolled in an 8-week, community-based MBSR program.
Results: As hypothesized, depressive …

Changes In Spirituality Partly Explain Health-Related Quality Of Life Outcomes After Mindfulness-Based Stress Reduction., Jeffrey M Greeson, Daniel M Webber, Moria J Smoski, Jeffrey G Brantley, Andrew G Ekblad, Edward C Suarez, Ruth Quillian Wolever
Jeffrey M. Greeson
Mindfulness-Based Stress Reduction is a secular behavioral medicine program that has roots in meditative spiritual practices. Thus, spirituality may partly explain Mindfulness-Based Stress Reduction outcomes. Participants (N = 279; M (SD) age = 45(12); 75% women) completed an online survey before and after an 8-week Mindfulness-Based Stress Reduction program. Structural equation modeling was used to test the hypothesis that, following Mindfulness-Based Stress Reduction, the relationship between enhanced mindfulness and improved health-related quality of life is mediated by increased daily spiritual experiences. Changes in both spirituality and mindfulness were significantly related to improvement in mental health. Although the initial mediation hypothesis …

A Randomized Controlled Trial Of Koru: A Mindfulness Program For College Students And Other Emerging Adults., Jeffrey M Greeson, Michael K Juberg, Margaret Maytan, Kiera James, Holly Rogers
Jeffrey M. Greeson
OBJECTIVE: To evaluate the effectiveness of Koru, a mindfulness training program for college students and other emerging adults. PARTICIPANTS: Ninety students (66% female, 62% white, 71% graduate students) participated between Fall 2012 and Spring 2013. METHODS: Randomized controlled trial. It was hypothesized that Koru, compared with a wait-list control group, would reduce perceived stress and sleep problems, and increase mindfulness, self-compassion, and gratitude. RESULTS: As hypothesized, results showed significant Group (Koru, Wait-List)×Time (Pre, Post) interactions for improvements in perceived stress (F[1, 76.40]=4.50, p=.037, d=.45), sleep problems (F [1, 79.49]=4.71, p=.033, d=.52), mindfulness (F [1, 79.09]=26.80, p CONCLUSIONS: Results support the …

Understanding The Essex Junto: Fear, Dissent, And Propaganda In The Early Republic, Dinah Mayo-Bobee
Dinah Mayo-Bobee
Historians have never formed a consensus over the Essex Junto. In fact, though often associated with New England Federalists, propagandists evoked the Junto long after the Federalist Party’s demise in 1824. This article chronicles uses of the term Essex Junto and its significance as it evolved from the early republic through the 1840s.
The Epistemology Of Esoteric Culture: Spiritual Claim-Making Within The American Neopagan Community, Marty Laubach
The Epistemology Of Esoteric Culture: Spiritual Claim-Making Within The American Neopagan Community, Marty Laubach
Marty Laubach
Non-institutionalised religious communities within western esotericism, such as New Age or Neopagan subcultures, are dynamic marketplaces for knowledge construction that may appear to be chaotic and governed only by the rule of caveat emptor. However, a close examination reveals authorization processes developing along similar lines as those followed by scientific empiricism during the seventeenth century. Claims of esoteric knowledge are developed from psychism experiences, and are authenticated by examining the claimant’s social standing, the narrative structure of the claim and the interests of the claimant and the judge. Such claims are authorized by incorporation into collective action, publications, workshops and …

The South Dakota Periodicals Index is a subject and author index to selected periodicals and annuals published in South Dakota. Its purpose is to facilitate the location of information about the people, places, events, and issues that make South Dakota a special place. As reference librarians at South Dakota State University we are aware of the difficulty of finding specific information about South Dakota. National periodical indexes provide very limited coverage of South Dakota, and it is not unusual to search through many different indexes without finding a single reference to the state.

Concerning The Use Of Solitary Confinement In Immigrant Detention Facilities In The United States Of America (2013), Sarah Dávila-Ruhaak, Steven D. Schwinn
Sarah Dávila-Ruhaak
This report relates to the situation of immigrant detainees who are held in solitary confinement in detention facilities in the United States. It is submitted in response to the United States’ fourth periodic report and specifically addresses the widespread use of solitary confinement in immigrant detention as it violates immigrant detainees’ rights to due process and judicial remedies, violations of minimum standards of the right to humane treatment, and the right to personal liberty. The report discusses the policies and practices of the U.S. Department of Homeland Security (DHS) and Immigration and Customs Enforcement (ICE) that support the use of …
