Legal Mobilization In Schools: The Paradox Of Rights And Race Among Youth, Calvin Morrill, Lauren B. Edelman, Karolyn Tyson, Richard Arum

In this article, we analyze ethnoracial patterns in youth perceptions and responses to rights violations and advance a new model oflegal mobilization that includes formal, quasi-, and extralegal action. Slightly more than half of the 5,461 students in our sample reported past rights violations involving discrimination, harassment, freedom of expression/assembly, and due process violations in disciplinary procedures. Students, regardless of race, are more likely to take extralegal than formal legal actions in response to perceived rights violations. Self-identified African American and Latina/a students are significantly more likely than white and Asian American students to perceive rights violations and are more …

In this article, organizational conflict management is conceived as a "disputing process" involving the social escalation from grievance stage to conflict and dispute stages. The Disputing Process Instrument (DPI) was designed us a way to study these phenomena quantitatively. Seven behuviors are represented in the instrument: conciliatory negutiution, third-party mobilization, overt retaliation, covert retaliation, toleration, avoidance, and discipline. The DPI demonstrated high reliability, content, discriminant, and construct validity relative to wrlier conflict instruments. Organizational theory emphasizes how new organizational forms are produced by technological innovation but has glossed over the role of cultural innovation. This chapter suggests that social movements are important sources of cultural innovation and identifies the scope conditions under which social movements create new organizational forms. By doing so, it lends substance to the notion of institutional entrepreneurship and enlarges the theoretical reach of neo-institutionalism.

This review considers a class of political activity that has largely been ignored by researchers extending social movement theory into organizations: covert political conflict. Although much of the literature we discuss focuses on contemporary corporations where the bulk of research on covert conflict has occurred, we also explore studies of covert conflict in a range of historical and organizational contexts that fall outside the contemporary work world. As we define it, covert political conflict encompasses four interrelated elements: contestation of institutionalized power and authority, perceptions of collective injury, social occlusion, and officially forbidden forms of dissent. This article examines the customs of conflict management among executives at the tops of two large business organizations. The argument advanced here derives ftom the notion that conflict management varies with the informal norms that govern interpersonal networks. Ethnographic, social network, and perceptual data collected in the present investigation suggest that where executives experienceftagmented and atomized interpersonal networks, they are more likely to manage conflict without conftontation than in networks of strongly and densely connected individuals. Conflict Management, Honor, And Organizational Change, Calvin Morrill

How do top managers of a large American corporation manage conflict among themselves? This article investigates intracorporate executive conflict management in a Fortune 500 manufacturer via ethnographic methods. It focuses on the links between executive conflict management and widespread innovations in (1) top managerial formal structure and (2) hostile takeovers and their symbolic imagery. More specifically, the article focuses on how these innovations disrupted the traditional social structure and "rules of the game" among top managers. The resulting new "culture of honor" suggests several implications for the study of managerial uncertainty, inertia, accountability, and control in contemporary American corporations.

This study departs from mainstream criminology to approach youth conflict and violence from a youth-centered perspective drawn from cultural studies of young people and sociolegal research. To access youth orientations, we analyze experiential stories of peer conflict written by students at a multiethnic, low-income high school situated in an urban core of the western United States. We argue that youth narratives of conflict offer glimpses into how young people make sense of conflict in their everyday lives, as well as insights as to how the images and decisional bases embedded in their storytelling connect to adult-centered discourses found in popular …

Widespread satisfaction among users of community mediation, but low voluntary usage, provides a context within which institutional isomorphism between state and informal social control organizations can be empirically investigated. Data drawn from a triangulated ethnography of a single community mediation center suggest that community mediation centers come to be isomorphic with more established governmental social control agencies in order to manage resource uncertainties and assure organizational survival. Everyday legal discount refers to the spoken language with which ordinary people constitute the law-in-action. In this article, we experimentally investigate the social distribution of rule-and relationally-oriented discourse found by ethnographers in small-claims court settings. We examine the influences of sex differences and social ties between disputants on these types of discourse in a mock small-claims setting using a quantitative content coding scheme. We do not find empirical support for sex differences in the production of simulated everyday legal discourse. There is a rich intellectual history to the sociological study of crime and punishment that encompasses multiple and interrelated traditions. Some of these traditions trace their roots to the European social theorists of the nineteenth century, particularly Emile Durkheim, Max Weber, and Karl Marx. Although only Durkheim and Weber systematically studied law (and only Durkheim actually studied punishment), all three social theorists facilitated the development of sociological research and theory on crime and punishment. Durkheim's Suicide: A Study in Sociology, for example, investigated the relationship between social integration and suicide rates, which, in turn, provided a model of inquiry for …

Previous research has charged that the language used by witnesses & litigants influences evaluations of credibility & blame made by legal decisionmakers. To determine the extent of this influence at different levels within the dispute resolution process, 3 experiments measured how speech style (powerful, powerless) & discourse (rule, relational) impacts sitting superior court judges, practicing mediators, & undergraduates at the U of Arizona (N = 42, 33, & 71, respectively).
