Toward Rational Regulation Of Genetically Modified Food, Gregory N. Mandel

Santa Clara Journal of International Law

The regulation of genetically modified food pursuant to statutes enacted decades prior to the advent of biotechnology has created a regulatory system that unnecessarily exposes society and the environment to adverse risks of biotechnology and introduces numerous inefficiencies into the regulatory system. These risks and inefficiencies include gaps in regulation, duplicative and inconsistent regulation, unnecessary regulatory expense, agencies acting outside their areas of expertise, and unnecessary increases in the cost of and delay in the development and commercialization of new biotechnology products. This Article details how to achieve a comprehensive, efficient, and scientifically rigorous regulatory system for genetically modified food. …

Should We Have Gm Crops?, Paul B. Thompson

The title question is evaluated in light of three key sub-issues: consumer rights of exit with respect to consumption of GM crops, environmental risk from GM crops and the effectiveness of the scientific community in addressing non-technical issues that have been raised by GM crops. Three key theses are argued. U.S. labeling policy for GM crops provides only tenuous protection for a consumer's ethical right to eat a diet that conforms to religious, cultural or politically based values. Environmental risks, though real, have been overstated by critics of GM crops, who have ignored significant environmental risks from non-GM agricultural technologies. …

The Trials Of Tenofovir: Mediating The Ethics Of Third World Research, Peter Hammer, Tammy Sue Lundstrom

A clash between a union of Cambodian sex workers and a team of international researchers funded by the Bill and Melinda Gates Foundation led to the cancellation of an important HIV/AIDS prevention study. The union was demanding better disclosure of information, insurance against the threat of long-term study-related side effects, and assurances of future access to the study drug (tenofovir) if it proved effective in preventing HIV transmission. The union was also demanding to be taken seriously as a stakeholder in the joint fight against HIV/AIDS. Harmonizing Race: Competing Regulatory Paradigms Of Racial Categorization In International Drug Development, Jonathan Kahn

This article examines the implications of U.S. federal and international regulatory mandates in the construction and circulation of racial categories in biomedical research and drug development. It will focus on the interface between two regulatory mandates in particular: the International Conference on Harmonization (ICH) Guideline Document E-5 on Ethnic Factors in the Acceptability of Foreign Clinical Data, and the U.S. Food and Drug Administration (FDA) Guidance for Industry: Collection of Race and Ethnicity Data in Clinical Trials.
