The key mechanism for effectiveness in the ERAS protocol is the attenuation of the surgical stress response combined with treatments that support the return of functions that delay recovery in traditional methods. The purpose of this scholarly project was to evaluate the results of the ERAS Pilot program currently initiated at Baptist Memorial Hospital to improve patient outcomes undergoing major abdominal surgery. Prior to the implementation of the ERAS protocol there was no standardized method in place at …

Lincoln Memorial University Law Review Archive

This paper will investigate the current law as it relates to the unlawful public release of classified information. Genetic Markers Involved In Macrocyclic Lactone Resistance In Dirofilaria Immitis And Estimation Of Heartworm Prevalence In Resident Canine Populations Of The Cumberland Gap Region Of Kentucky, Tennessee, And Virginia., Hailey Watlington, Charles T. Faulkner

Faculty Scholarly Content

Infection with heartworm (Dirofilaria immitis), is a significant cause of disease in companion animals worldwide. Macrocyclic lactones (MLs) have been the standard treatment for heartworm prevention for the last 25 years. Although widely used and highly effective, recent studies have shown a potential loss of efficacy. Investigations suggest the involvement of a single-nucleotide polymorphisms (SNPs) of a gene encoding a fragment of P-glycoprotein (P-gp) within the Dirofilaria. immitis genome. This reveals a potential relationship between SNP frequencies within the P-gp gene and ML resistance. The prevalence of heartworm infection in the Cumberland Gap Region (CGR) is reported to …

Survivors Representing Survivors: Shared Experience And Identity In Direct Service Lawyering, Kelly Jo Popkin Feb 2018

Survivors Representing Survivors: Shared Experience And Identity In Direct Service Lawyering, Kelly Jo Popkin

Lincoln Memorial University Law Review Archive

First, the survey gauges the effects that personal experiences of gender-based violence may have on the delivery of quality direct legal representation for survivors of gender-based violence. Instead of tracking trial outcomes or other tangible legal “wins,” these questions assess metrics of quality through empathy, professional distance, client-centered practice, and other commonly regarded ideals within the practice of direct service lawyering for under-served communities. The survey also gauges the lasting effect that this work may have on the attorneys themselves, in both their approach to lawyering and their perception of gender-based violence on an individual, local, and systemic scale.

Does Article Iii Require Putative Unnamed Class Members To Demonstrate Standing, Jonathan D'Andrea Feb 2018

Does Article Iii Require Putative Unnamed Class Members To Demonstrate Standing, Jonathan D'Andrea

Lincoln Memorial University Law Review Archive

This article examines the question of whether a class can be certified under the Federal Rules of Civil Procedure when putative, unnamed class members lack Article III standing. The federal circuits are currently split on this issue. The majority of circuits hold that a class cannot be certified if any class member lacks standing. The minority of circuits require only the named class representative to demonstrate standing. This article argues that the minority rule is correct because it is consistent with recent Supreme Court jurisprudence. In addition, the purpose of the class action device—judicial efficiency—is served by the minority rule.

Risk-Filled Risk Aversion: The Troubling Nature Of Third Party Litigation Financing Arrangements In The Context Of Aggregate Claims, Houston Bragg Feb 2018

Risk-Filled Risk Aversion: The Troubling Nature Of Third Party Litigation Financing Arrangements In The Context Of Aggregate Claims, Houston Bragg

Lincoln Memorial University Law Review Archive

The pursuit of justice, with infrequent exception, requires financial stability and sometimes even wealth. The cost of litigation has become so burdensome over the years that a system of third party litigation finance, also known as “litigation lending,” has developed in the background of the U.S. justice system. On its face, third party litigation financing shifts risk from risk-averse individual plaintiffs to well-insulated investors, promoting a more even-handed adversarial system. The practical success of litigation lending in the individual context1 has led to an outgrowth of rhetoric concerning, and even attempts at applying, litigation lending to aggregate claims.2 From court …
