The Nonexceptionalism Thesis: How Post-9/11 Criminal Justice Measures Fit In Broader Criminal Justice, Francesca Laguardia

Contrary to the assumption that ‘‘9/11 changed everything,’’ post-2001 criminal justice practices in the area of terrorism show a surprising consistency with pre-2001 criminal justice practices. This article relies on an analysis of over 300 terrorism prosecutions between 2001 and 2010, as well as twenty full trial transcripts, content-coding, and traditional legal analysis, to show the continuity of criminal justice over this time in regard to some of the most controversial supposed developments. The social construction of terrorism in the public sphere naturally limits and directs logical policy options. In the United States, media are a primary vehicle for the construction of social problems and accompanying policy solutions, as much of public discourse takes place in media narratives. News media play a major part in political communication, both between government and governed as well as among different segments of government.

Terrorism in the new millennium has morphed drastically since the 1970s. The terrorist organizations of today are a hybrid between the insurgent group models of the 1960s and modern terrorist organizations such as Al Qaeda. This hybrid model has created what has become a transnational insurgency recruited, trained, and led by major terrorist networks such as the Islamic State of Iraq and the Levant (ISIL). The emerging phenomenon of Western women Islamic converts learning radicalized ideology through social media constitutes a challenge to cyber policy makers hampered by a lack of gender-nuanced radicalization research. The purpose of this exploratory qualitative case study was to develop a greater understanding of how the differential reinforcement tenet of social learning theory may help to explain the conversion and radicalization of Western women towards a fundamentalist Islamic ideology through their participation in the social media. Following the issuance of the National Preparedness Guidelines in 2009 by the Department of Homeland Security, it remains unknown whether homeland security programs have been consistently implemented in the nation's rural areas. Research findings have been inconsistent and inconclusive on the degree of implementation. Two problems may result from inadequate implementation of these programs: weakened national security from the failure to protect critical infrastructure in remote areas and a threat to public safety in rural towns.
