The open source software (OSS) model represents an alternative to traditional proprietary software usage. Yet relatively little is known about the conditions impacting policy related to OSS development, diffusion, and adoption. This paper explores the concept of a state-level open source index (SLOSI) to measure open source policy related initiatives at the state-level in the United States. One rationale for developing a SLOSI is to gauge how well a state's (political, economic, social, technological) environment relates to its OSS policies. This metric readily lends itself to evaluating the political, social, and economic aspects of adoption of the OSS approach. The …

Neighborhood Dynamics And The Housing Price Effects Of Spatially Targeted Economic Development Policy, Douglas J. Krupka, Douglas S. Noonan

Neighborhoods are the result of a complicated interplay between residential choice, housing supply and the influences of the larger metropolitan system on its constituent parts. We model this interplay as a system of reduced-form equations in order to examine the effects of a generous spatially targeted economic development program (the federal Empowerment Zone program) on neighborhood characteristics, especially housing values. This system of equations approach allows us to compute direct effects of the policy intervention as well as the effects mediated through non-price channels such as changes in the housing stock or neighborhood demographics. A Dialogical-Republican Revival: Respect-Worthy Constitutionalism In Post-Conflict Northern Ireland, South Africa, And Southern Philippines, Edsel F. Tupaz

This Article addresses the question of constitutional design and negotiation for deeply divided societies in post-conflict settings. It argues in favor of the adoption and application of what might be termed as the “dialogical” model of democratic constitutionalism as opposed to the “enforcement” model which characterizes much of contemporary legal ordering. In discussing their features, the Article charts a normative apparatus for making the constitutional choice between the two, and, thereafter, it tests theory into practice by undertaking a comparative analysis of what might well be successful policymaking and constitution-making practices in Northern Ireland and South Africa. This Article addresses the question of constitutional design in young and transitional democracies. It argues for the adoption of a “weak” form of judicial review, as opposed to “strong” review which typifies much of contemporary adjudication. It briefly describes how the dialogical strain of deliberative democratic theory might well constitute the normative predicate for systems of weak review. In doing so, the Article draws from various judicial practices, from European supranational tribunals to Canadian courts and even Indian jurisprudence. The study compared and contrasted the views of police leaders and minority ethnic community representatives on different aspects of shared leadership in the context of policing in minority ethnic communities. Drawing on data collected in the UK during 2003-2005, the challenges facing police forces pursuing shared leadership approaches to delivering services are examined, with a view to providing supporting evidence for addressing training needs and reviewing institutional development. There is clear support for policing systems where the views of community members are actively sought by police leaders. Housing associations are a key part of the non-profit sector and the adoption of strategic planning by this sector is of considerable significance. This article provides a qualitative report examining the use of strategic planning practices by housing associations in Northern Ireland, and the impact of such action on the performance of the associations. The article also critically examines reasons for the non-profit housing sectors’ enthusiasm for strategic planning practices concluding that strategic planning is a legitimating seeking activity as well as a rational analytic process.

The purpose of this paper is to examine the utility of a qualitative ‘card sort’ research tool – when it is merged with traditional quantitative data gathering methods – to add to our understanding about the nature of competency-based approaches to leadership studies. The study demonstrates how a qualitative technique (card sort) was used for the task of testing a clinical leadership competencies model. All the steps in the card sort methodology are described through its application to the research problem. The Intersection Of Judicial Attitudes And Litigant Selection Theories: Explaining U.S. Supreme Court Decision Making, Jeff L. Yates, Elizabeth Coggins

Two prominent theories of legal decision making provide seemingly contradictory explanations for judicial outcomes. In political science, the Attitudinal Model suggests that judicial outcomes are driven by judges' sincere policy preferences -- judges bring their ideological inclinations to the decision making process and their case outcome choices largely reflect these policy preferences. In contrast, in the law and economics literature, Priest and Klein's well-known Selection Hypothesis posits that court outcomes are largely driven by the litigants' strategic choices in the selection of cases for formal dispute or adjudication -- forward thinking litigants settle cases where potential judicial outcomes are readily …

This article contributes to the growing body of network neutrality literature by describing and commenting on recent developments in Canada. There have been and still are ongoing industry practices, regulatory policy proceedings, judicial decisions and pending litigation, and legislative proposals relevant to the issue of network neutrality in Canada. While most of the network neutrality literature has an economic focus, this paper dwells more on implications for Canadian culture. This research was conducted at a national training workshop held in February 2008. Almost all councillors from The Gambia participated and all of those who attended responded to the Secretariat’s questions. It finds that a statistically ‘typical,’ ‘average’ councillor in The Gambia in 2009 can be characterised as a 41 year old male who completed secondary level education, works over 38 hours per week as a full time councillor, lives off his allowance only without any other income, serves his first term in office and represents 16,000 people.

This article takes a governance perspective to examine the contemporary revitalization of Guaraní, a “repressed” language that is spoken by a majority of the population in Paraguay. A historical overview highlights the striking endurance of the language in spite of two centuries of official subjugation. The article traces the positive impact of political democratization since 1989 on the revitalization of Guaraní by examining four interrelated areas that are closely linked to the governance agenda: the education system, the media, the political system, and popular culture. This paper suggests that LIS might benefit from critical political economy as a way of theorizing and responding to enclosures of information commons. The autonomist Marxist re-invigoration of ‘primitive accumulation’ offers a register for apprehending contemporary erosions of the commons. Enculturation is the process by which individuals of an ethnic group unintentionally, unconsciously, and naturally, acquire culture specific values, knowledge, behaviours, manners, and identities (Gob, Lee, & Yoon, 2008) (Grovtevant, Gunnar & Hellerstedt, 2006) (Kim & Omizo, 2006) (Constantine & Miville, 2006). There are many psychological concepts that can be linked to enculturation such as psychological protective factors, perceived sense of well being, social connectedness, psychological health, cultural identity, help seeking, self efficacy, and self esteem. The Israeli- Palestinian ethnic conflict will continue to escalate throughout both the short term and long term world future. The current and future animosity between both ethnic groups can be attributed to (a) history based accounts and religious tensions, (b) polarizing ideologies held by both sides, and (c) middle eastern resentment toward the Jewish state of Israel. History based accounts will refer to both biased historical accounts and factual historical events that have contributed to the Israeli- Palestinian ethnic conflict.
