An Analysis Of The Quality Of Ph.D Theses: A Peep Through In-Text Citations And Bibliography, Unnikrishnan S

Library Philosophy and Practice (e-journal)

This study attempts to analyze the quality of Ph.D theses awarded by Mahatma Gandhi University, South India in the field of Social Sciences through their in-text citations and bibliography. This is done by foregrounding the mistakes made by the scholars in their theses. In between 2017-18, the university had awarded 69 Ph.Ds under Social Sciences of which 25 theses were selected for this study. The major finding of the study is that even though American Psychological Association (APA) style of citation is generally accepted across the academic community, none follow it strictly. This is because research guides are often permitted …

Deliberation's Demise: The Rise Of One-Party Rule In The Senate, Charles Tiefer, Kathleen Clark Jan 2019

Deliberation's Demise: The Rise Of One-Party Rule In The Senate, Charles Tiefer, Kathleen Clark

Roger Williams University Law Review

Much of the recent legal scholarship on the Senate expresses concern about gridlock, which was caused in part by the Senate’s supermajority requirement to pass legislation and confirm presidential nominees. This scholarship exalted the value of procedural changes permitting the majority party to push through legislation and confirmations, and failed to appreciate salutary aspects of the supermajority requirement: that it provided a key structural support for stability and balance in governance. The Senate changed its rules in order to address the problem of partisan gridlock, and now a party with a bare majority is able to force through much of …

Efectos Del Proceso Independentista Catalán En Las Relaciones Multinivel Entre La Unión Europea, España Y Cataluña, Karen Melissa Joya Ramírez, Laura Alejandra Barbosa Hurtado, Yerson Yair Salamanca Henao

Negocios y Relaciones Internacionales

The Cisg: Applicable Law And Applicable Forums, Ronald A. Brand Jan 2019

The Cisg: Applicable Law And Applicable Forums, Ronald A. Brand

Articles

Despite being in effect for over thirty years, a debate continues on whether the United Nations Convention on Contracts for the International Sale of Goods (CISG) has been a success. With 89 Contracting States, it clearly is widely accepted. At the same time, empirical studies show that private parties regularly opt out of its application. It has served as a model for domestic sales law, and as an important educational tool. But has it been a success? In this article I consider that question, and suggests that the scorecard is not yet complete; and that it will perhaps take significantly …

Online Dispute Resolution, Ronald A. Brand Jan 2019

Online Dispute Resolution, Ronald A. Brand

Articles

This chapter was prepared from a presentation given by the author at the 2019 Summer School in Transnational Commercial Law & Technology, jointly sponsored by the University of Verona School of Law and the Center for International Legal Education (CILE) of the University of Pittsburgh School of Law. In the paper, I review online dispute resolution (ODR) by considering the following five questions, which I believe help to develop a better understanding of both the concept and the legal framework surrounding it:

A. What is ODR?

B. Who does ODR?

C. What is the legal framework for ODR?

D. What …

Authoritarianism Both In Venezuela And Turkey, Furkan Burcu Yildiz Jan 2019

Authoritarianism Both In Venezuela And Turkey, Furkan Burcu Yildiz

Masters Theses

In this paper, I undertake a comparative analysis of the authoritarian process in Venezuela and Turkey. In both countries, there are signs of political and economic instabilities. Therefore, I examine Turkey's and Venezuela's politics and economy to understand the reasons for authoritarian regimes. The comparison reveals that both countries are en route of authoritarianism; however, the motives are different. As for Venezuela. comparison grounds the argument that their authoritativeness relies on economic instability. On the contrary, Turkey has a stable economy while it has been struggling with political upheavals.

The result of this study pinpoints different ways for authoritarian regimes. …

Vote Choice Of Minority Groups: Emphasizing Their Issue Preferences, Md Kamrul Islam Jan 2019

Vote Choice Of Minority Groups: Emphasizing Their Issue Preferences, Md Kamrul Islam

Masters Theses

In explaining vote choice of minority groups, scholars of American politics often characterize them as natural democrats. They argue that they have become natural Democrats because of their minority identity and the constraints they faced throughout the history of the United States. However, this thesis questions the characterization and highlights the issue preferences of minority groups; it analyzes whether their issue preferences have an impact on shaping their vote choice. By analyzing the Cooperative Congressional Election Study (CCES) 2016 survey, this thesis has explored that minority groups vote for candidates who pay greater emphasis on the issues they care about. …

I Am A Citizen: An Examination Of The Civic Lives Of Adults With Cognitive Disabilities, Jihed Ncib Jan 2019

I Am A Citizen: An Examination Of The Civic Lives Of Adults With Cognitive Disabilities, Jihed Ncib

Masters Theses

This project lays down a foundation to study the civic lives of people with cognitive limitations. Considering the lack of research on the issue, the findings lean more toward theory building. Drawing on in-person interviews conducted with institutionalized individuals with intellectual disability (ID), this work attempts to clarify the impact of their disability on their civic lives. The questions that will be answered relate to their issue preferences, voting behavior, partisanship and mobilization, political awareness, and the influence of their circle on their citizen participation. Getting input directly from people with ID, instead of their proxies, will improve our understanding …

Edward Snowden, National Security Whistleblowing, And Civil Disobedience, David E. Pozen Jan 2019

Edward Snowden, National Security Whistleblowing, And Civil Disobedience, David E. Pozen

Faculty Scholarship

No recent whistleblower has been more lionized or vilified than Edward Snowden. He has been nominated for the Nobel Peace Prize and denounced as a "total traitor" deserving of the death penalty. In these debates, Snowden's defenders tend to portray him as a civil disobedient. Yet for a range of reasons, Snowden's situation does not map neatly onto traditional theories of civil disobedience. The same holds true for most cases of national security whistleblowing.

The contradictory and confused responses that these cases provoke, this essay suggests, are not just the product of polarized politics or insufficient information. Rather, they reflect …

The Quest For Recognition: Taiwan’S Military And Trade Agreements With Singapore Under The One-China Policy, Pasha L. Hsieh Dec 2018

The Quest For Recognition: Taiwan’S Military And Trade Agreements With Singapore Under The One-China Policy, Pasha L. Hsieh

Pasha L. HSIEH

This article examines the evolution of Taiwan’s relationship with Singapore since the 1960s as a unique case study in the Asia-Pacific. The theoretical concept of recognition in international relations (IR) and its nexus with international law are used to analyze the conclusion of the bilateral military and trade agreements absent diplomatic relations. The article argues that beyond security dimensions, the two states’ struggles for recognition exhibit the formation of national identities, which invigorate the claims for sovereign state status in global politics. First, this article explores the emerging notion of recognition in IR and sheds light on the significance of …

“Bullets Of Truth”: Julian Assange And The Politics Of Transparency, Mark Fenster Dec 2018

“Bullets Of Truth”: Julian Assange And The Politics Of Transparency, Mark Fenster

Mark Fenster

This essay updates (to early 2019) earlier work on the WikiLeaks story in order to consider what more recent developments reveal about the theoretical promise that Assange articulated at the time of the website’s emergence. Assange has characterized secrecy as both a form and symptom of corruption, and ultimately as the foundation of a “conspiracy” of governance that states like the U.S. inflict on their subjects and the world. He advocates a non-political, vigilante form of transparency in which WikiLeaks serves as a neutral entity that will save the public and free the world with information. He predicted that corrupt …

Feed: State Transparency Amidst Informational Surplus, Mark Fenster Dec 2018

Feed: State Transparency Amidst Informational Surplus, Mark Fenster

Mark Fenster

An email arrives, promising inside information about the perfidious forces that secretly rule the nation. A Twitter feed from a prominent insider at an establishment think-tank announces the latest disclosure about the president’s secret role in the Russian conspiracy to manipulate the election that elevated him with the blast of toy cannon. Meanwhile, the President’s tweets serve to annoy, distract, humor, or comfort those who see them, and they above all announce some truth about his presidency.

Debates about government transparency presume that the state controls an informational spigot, which can be made to allow information to flow or to …

Reviewer_Report.Pdf, Mark Reisinger Dec 2018

Reviewer_Report.Pdf, Mark Reisinger

Mark Reisinger

By 2047, Hong Kong’s “One Country, Two Systems” government regime will end, promoting the country’s integration into the People’s Republic of China (PRC). To ensure a smooth transition, the PRC has been issuing measures to promote integration by eliminating the border and other forms of geographic barriers that separate the two countries. But despite on-going practices of integration, Hong Kong continues to strengthen its border with China through infrastructural and bureaucratic means, reinforcing a British-colonial era border regime. Thus, my research focuses on this contradiction between the elimination and reinforcement of the Hong Kong-China border as an attempt to understand …

Nietzsche And Emancipatory Politics: Queer Theory As Anti-Morality, C. Heike Schotten Dec 2018

Nietzsche And Emancipatory Politics: Queer Theory As Anti-Morality, C. Heike Schotten

C. Heike Schotten

This article offers an emancipatory appropriation of Nietzsche’s work, making the case that the founding of the field of queer theory exemplifies and proffers a liberatory Nietzschean praxis of anti-morality. This argument requires reading Nietzsche’s work from the perspective of the oppressed and (re-)reading queer theory as part of the project of critical theory.

Development Of Violence And Sectarianism In Lebanon, Alicia Mallo Dec 2018

Development Of Violence And Sectarianism In Lebanon, Alicia Mallo

Alicia Mallo

The pattern and acceptance of sectarianism and the resultant ethnic violence in Lebanon can be traced back to the mid-19th century as the result of European involvement in the Levant. Through the history of Lebanon in the 19th and 20th centuries, the modern sectarianism and ethnic violence can be better understood as results of international intervention and interference.

Effective Communication In Public Services In A Diverse Language And Cultural Landscape: A Challenge For Teaching And Training., John R. Fisher, Halil Asllani

Dr. John R. Fisher

Constantly changing global events impact local policing and emergency services personnel in their roles as guarantors of safety and security. This paper extends research originally completed in the United States and compares the results with findings from Kosovo police. Police in both Kosovo and Utah (in the United States) serve minority populations. In Utah, the population that was once homogeneous is now very diverse. The population in Kosovo is becoming more and more homogeneous, but with some unique challenges for police and other public safety agencies. In Utah, these population changes have occurred because the state has become a magnet …
