Appreciating Advanced Algorithms Technologies to enable effective legal research are often extremely sophisticated. Many apply advanced algorithms for searching, sorting, and even predict- ing results. Legal professionals need to understand the benefits and risks associated with these technologies. This is not a matter of knowing how queries are processed. Instead, the need is to under- stand the scope of what is being searched and the nature and reliability of results returned.

While collaboration is familiar to some legal researchers, the field, for the most part, does not seem to implicate the large-scale complexity and cost that has become associated with big science. These logistical differences, combined with a very strong cultural preference in legal academic circles for solitary work, could potentially keep team research from dominating the production of legal knowledge to the same extent that it has come to dominate the production of knowledge in other areas. Last February, John P. Holdren, director of the White House Office of Science and Technology Policy, issued a new policy designed to increase open access to federally-financed research. The memorandum, covering federal agencies with annual expenditures in excess of $100 million for scientific research and development, requires, inter alia, that: (1) agencies develop “clear and coordinated policies” to make federally- funded studies freely available to the public within one year of publication, and (2) researchers account for and manage the digital data resulting from federally-funded scientific research. E-discovery refers to discovery in civil litigation that focuses on the exchange of information in electronic form. Lainie Crouch Kaiser, a litigation attorney with McDermott Will & Emery, writes that “e-Discovery can be used as an umbrella term for both the legal and operational considerations related to how electronically stored information (ESI) is used in the modern day practice of law.”There are many types of ESI, including e-mail and office documents, voicemail, photos, video, and databases. In February 2005, the Virginia State Bar (VSB) Council approved plans to offer all Virginia lawyers free access to an online legal research program through a portal on the VSB's website. Then-Chief Justice Leroy Rountree Hassell, Sr., considered access to an online research tool a high priority for Virginia attorneys and urged the VSB to provide this kind of service. Johnny's Oyster & Shrimp, Inc., a 1999 US federal district court case, captures a perception of the trustworthiness of digital information that over ten years later is, in many instances, still uncomfortably close to reality. It raises two important questions with which governments providing online information and users of that information must grapple: Is digital government information reliable and trustworthy? A month after the conference, Thomson Reuters launched the WestlawNext iPad app. Current marketing touts mobile access to WestlawNext that is suitable on four major smartphone platforms. At right is a screen shot from the native iPad app as well as WestlawNext in Apple's Safari browser. The iPad app does not let you send documents to your Kindle, and in fact does not let you download or print items directly, as shown in the highlighted screen element in each.

Decisions to eliminate a book collection occur for various reasons, including retirement, downsizing a home library, or a sweet deal from an online vendor. Law librarians regularly receive inquiries about the purchase or donation of used law books. Many times these calls originate in a law school’s development office after an attorney school seeks his or her law school’s advice on eliminating a significant career investment. An attorney may turn to a law firm librarian for advice as well.

One of the underlying obstacles to reproducing older books is that there's no central place to look for information about what is protected by copyright and what may have passed into the public domain. Responding to this need, OCLC recently introduced a new system for tracking various copyright details for published books. The new service, still in beta, is called the WorldCat Copyright Evidence Registry (CER). It could be a very valuable resource for recording and sharing copyright status information.

In this article, I examine alternative uses for information found in patent and trademark filing databases, suggesting ways to locate a law firm's clients, perform competitive intelligence, and locate or investigate expert witnesses.
