An Empirical Study Of The Relationship Between Metacognitive Skills, Performance In A Bar Prep Course And Bar Passage, Jennifer A. Gundlach, Jessica R. Santangelo
The Journal of Law Teaching and Learning
This article builds on our prior research about metacognition and its importance for law students’ learning. We hypothesized that given our past findings about the relationship between metacognition and academic performance during the first year of law school, it was possible that metacognition might also play an important role in success with a third-year bar preparation course and/or on the bar exam.
Our current study documents law students’ metacognitive skills during a final-semester bar prep course and examines the relationship between those students’ metacognitive skills and performance in the course and bar passage. We found that students are capable of …

Talking about race, gender, and sexual orientation can be painful, messy, and difficult. This country’s history of discrimination and violence against historically underrepresented, marginalized, excluded individuals—racial and ethnic minorities, women, LGBTQIA+, those living with disabilities, the socioeconomically disadvantaged/lower class—makes these topics fraught with controversy and risk. We can easily offend someone accidentally when we try to address these topics even with the best of intentions. For example, some people may get nervous trying to figure out whether to use the words African-American, Black, BIPOC, person of color, or all of the above when discussing these topics and referring to someone …

The purpose of this bibliography is to record in one place the substantial body of scholarship produced by the current faculty at the Catholic University, Columbus School of Law. I have come to think that, most of the time, radical critics of a given discursive practice were once believers in that practice’s necessities and realities. In particular, I am of the opinion that one comes to appreciate the power of a discourse only when one has genuinely and personally experienced the necessitarian pull as well as the realities such discourse creates. To put it in phenomenological terms, I think that radical scepticism is often the expression of some self-revulsion at one’s earlier beliefs. The phenomenological causality described here is thus not simply about the devastating rage that one can …

Parity In Higher Education In Prison Programs: Does It Exist?, Michael Lee Griggs, Vianey Luna
Electronic Theses, Projects, and Dissertations
The expansion of college-in-prison (CIP) programs, especially in California, where incarcerated college enrollment increased from 11,472 students to over 15,000 in two years, has spotlighted higher education for incarcerated individuals. This increase, supported by legislation that expands funding for CIP programs and allows time off sentences for successful course/degree completion, is further bolstered by the restoration of Federal Pell funding for incarcerated students after a 28-year ban. Despite the acknowledged benefits of CIP programs in reducing recidivism and enhancing post-release outcomes, existing research highlights the need for additional exploration into the quality of CIP programs. Senate Bill 416 further emphasizes …

As the factual nature of legal inquiry has become increasingly apparent over the past century, courts and commentators have fallen into the habit of labeling the facts behind the law “legislative facts.” Loosely, legislative facts are general facts courts rely upon to formulate law or policy, but that definition is as contested as it is vague. Most agree that legislative facts exist in some form or another, but few agree on what that form is, on who should find them, and how. This Article seeks to account for and resolve that confusion. Teaching "Is This Case Rightly Decided?", Steven Arrigg Koh

“Is this case rightly decided?” From the first week of law school, every law student must grapple with this classroom question. This Essay argues that this vital question is problematically under-specified, creating imprecision in thinking about law. This Essay thus advocates that law professors should present students with a three-part framework: whether a case is rightly decided legally, morally, or sociologically.
Additionally, this Essay argues that disaggregating the question exposes deeper deficiencies in legal education. Many law professors do not provide students with serious grounding to engage in rigorous thinking about the relationship between law, morality, and justice, not to …

An Approach To Monitoring And Assessing Online/Hybrid J.D. Programs, Rti International

The expansion of distance learning among American Bar Association (ABA)-approved J.D. programs has the potential to increase access to a legal education, especially for students who have traditionally faced barriers to J.D. attainment because of employment, family duties, geographical location, and other circumstances. Compared to attending class in person, distance learning provides greater flexibility and increased convenience and may also result in cost savings since students do not have to relocate or forgo earnings to enroll full-time.
Before the COVID-19 pandemic, only a few law schools offered ABA-approved hybrid J.D. programs, but the pandemic temporarily forced all law schools online …

The Legal Imitation Game: Generative Ai’S Incompatibility With Clinical Legal Education, Jake Karr, Jason Schultz

In this Essay, we briefly describe key aspects of [generative artificial intelligence] that are particularly relevant to, and raise particular risks for, its potential use by lawyers and law students. We then identify three foundational goals of clinical legal education that provide useful frameworks for evaluating technological tools like GenAI: (1) practice readiness, (2) justice readiness, and (3) client-centered lawyering. First is “practice readiness,” which is about ensuring that students have the baseline abilities, knowledge, and skills to practice law upon graduation. The UNCITRAL Working Group III (WG III) is discussing procedural reforms in the investor state dispute settlement system (ISDS). The ISDS framework is criticized on various grounds, including arbitrator bias, lack of transparency, and inconsistent arbitral decisions. One of the recent reform proposals before the WG III is the possibility of a multilateral investment court (MIC). This proposal is championed by European Union states and supported by Canada. The proposal recommends replacing ISDS’ Ad hoc investment tribunals with an established and permanent court where states appoint judges. A bit uncomfortable. That is how it feels to be among dear friends but labelled professionally as an outsider. I have a law degree, a bar membership, and a PhD in Jurisprudence and Social Policy. I am a professor in a women’s studies department at Concordia University. At conference receptions, people respond breathlessly, “But they don’t have a law school at Concordia!?,” as though I am hearing confession in a gas station, or something as heretical. When law librarians think about making out libraries a welcoming and inclusive environment for all library patrons, we need to include individuals of all abilities in this process. This article discusses how law librarians can best create a welcoming and inclusive environment in their libraries and services. It also focuses on how to best support neurodivergent patrons through universal design.
