In April 2011 the Mexican Parliament approved a legislative package that regulates class actions. The amended laws are six: (1) Federal Code of Civil Proceedings; (2) Federal Civil Code; (3) Federal Law of Economic Competence; (4) Federal Law of Consumer’s Protection; (4) Organic Law of the Federal Judicial Power; (5) General Law of Ecological Equilibrium and Environmental Protection; and (6) Law of Protection to the User of Financial Services. On August 30th 2011, the Federal Official Gazette published this amendment to the federal law.

Este artigo examina dois temas relacionados à arbitragem. O primeiro diz respeito aos motivos pelos quais indivíduos e empresas decidem, em alguns casos, voluntariamente submeterem-se ao procedimento arbitral. Em síntese, aqui argumento que essa decisão está relacionada, a duas considerações. Em primeiro lugar, à busca pela redução dos custos de transação especificamente associados à resolução das disputas. Em segundo lugar, à busca pela melhoria do ambiente jurídico em que prospectivamente se dará a relação contratual. Regulatory Overlap, Overlapping Legal Fields, And Statutory Discontinuities, Todd S. Aagaard

Lawmakers and scholars alike criticize regulatory overlap on the ground that giving administrative agencies overlapping jurisdiction leads to duplicative or conflicting regulation which is inefficient and unduly burdensome. This Article challenges this orthodox account of regulatory overlap through examination of six case studies in which the Environmental Protection Agency and the Occupational Safety and Health Administration have managed their jurisdictional overlap so as to create regulatory synergy rather than dysfunction. Although this Article is not the first to argue that regulatory overlap may improve the effectiveness of regulatory programs, the case studies examined here highlight two important aspects of regulatory …

The international legal framework regulating the problem of human trafficking contains the presumption that the return of victims of human trafficking to their countries of origin is the standard resolution for their cases. However, victims might have legitimate reasons for not wanting to go back. For those victims, resort to the legal framework of the European Convention on Human Rights could be a solution. Transnational corporate conduct that negatively impacts the environmental human rights of local communities is widespread in the operations of extractive sector companies. Yet, under principles of international environmental law, home states of transnational mining companies are neither obligated nor arguably even permitted to regulate and adjudicate environmental problems in host states. Proposals put forward in developed country home states to address these problems are often met with the claim that such regulations would be an imperialistic violation of host state sovereignty, and would create a competitive disadvantage for home state companies. Bridging the fields of federalism and negotiation theory, Negotiating Federalism analyzes how public actors navigate difficult federalism terrain by negotiating directly with counterparts across state-federal lines. In contrast to the stylized, zero-sum model of federalism that dominates political discourse and judicial doctrine, it demonstrates that the boundary between state and federal power is negotiated on scales large and small, on an ongoing basis. The Article is also the first to recognize the procedural tools that bilateral federalism bargaining offers to supplement unilateral federalism interpretation in contexts of jurisdictional overlap. INTRODUCTION: It is far too soon to tell what the precise impact of the 2008 global financial crisis (GFC) will be on trade and investment. First, it will take time for the full impact of the stimulus packages and crisis-related policies to be assessed by trading partners and private entities. Second, given the global nature of the crisis, governments may initially be reluctant to challenge governmental measures taken to assist domestic industries, particularly since in 2009 all major trading nations adopted measures designed to help domestic industries at home and in export markets.
