"A lot of folks in New Mexico have month-to-month leases that come up for renewal every 30 days or so, and even folks that have longer leases, it's been nine months since the Supreme Court issues their order so a large percentage of leases in New Mexico have come up for renewal in that time period,” said Serge Martinez, a professor at UNM School of Law.

Final Report: Internship At Hull And Hull Llp, Samantha Henderson-Whaley

SASAH 4th Year Capstone and Other Projects: Publications

Over the summer of 2020 I completed a remote internship at Hull & Hull LLP, an estates law firm in Toronto, for the SASAH experiential learning course. Hull & Hull handles estates and trusts litigation. I worked on digitizing charts for a passing of accounts (which is a court audit of a fiduciary’s accounting) for which there have been a considerable number of objections that we had to either refute or attempt to resolve, or there would be a trial. I was responsible for linking evidentiary material to the existing charts in order to ensure that the information was presentable …

Google And Shifting Conceptions Of What It Means To Improve A Product, Ramsi Woodcock Dec 2020

Google And Shifting Conceptions Of What It Means To Improve A Product, Ramsi Woodcock

Law Faculty Popular Media

Judges sometimes claim that they do not pick winners when they decide antitrust cases. Nothing could be further from the truth.

Competitive conduct by its nature harms competitors, and so if antitrust were merely to prohibit harm to competitors, antitrust would then destroy what it is meant to promote.

What antitrust prohibits, therefore, is not harm to competitors but rather harm to competitors that fails to improve products. Only in this way is antitrust able to distinguish between the good firm that harms competitors by making superior products that consumers love and that competitors cannot match and the bad firm …

Justice As Message Symposium: What We See When We See Law … Through The Eyes Of Dame Laura Knight, Diane Marie Amann

Scholarly Works

The eye cannot help but be drawn to the cover of Justice as Message, the new analysis by Carsten Stahn of, to quote the subtitle, Expressivist Foundations of International Criminal Justice. On the high-gloss paper jacket we see a tableau of blacks and browns and olive drab, accented only by the purple of a lawyer’s robe and the teal of a dossier perched on the bar behind him. In front, we see that the bench is buried in paper – paper that turns to ashes as the back wall gives way to a vision of buildings in ruin …

New Mexico In Depth Interviews Vinay Harpalani: Complexity Of Colorism, Vinay Harpalani, Claudia Silva

Faculty Scholarship

“Our discourse on race in this country has largely been framed around black or white,” said University of New Mexico civil rights law professor Vinay Harpalani.

But assumptions about varying shades of skin color can, for example, lead someone who is Indian, like himself, to be mistaken as Hispanic, he said.

Academics who’ve studied racial discrimination say discrimination based on a person’s skin-tone exists across many racial and ethnic groups and generally manifests as a systematic preference for lighter skin over darker skin.

Harpalani explains it can be the other way around in some instances, such as the bullying Clark …

A federal judge is accused of misconduct and an investigation begins. Before the investigation has concluded, though, the judge leaves her post. What happens next? Does it create an accountability gap, and if so, how much should that concern us? These are the questions that Veronica Root Martinez takes up in Avoiding Judicial Discipline.

This case illustrates how the First Amendment functions as an essential backstop to Fourth Amendment freedoms—and vice versa. As revealed by the national response to the killing of George Floyd and so many similar injustices, the ability to record encounters with government representatives is critical to preserving civil rights, and especially the right to avoid excessive force. The public only “became aware of the circumstances surrounding George Floyd’s death because citizens standing on a sidewalk exercised their First Amendment rights and filmed a police officer kneeling on Floyd’s neck until he died.” Index Newspapers LLC v. U.S. Marshals Serv., …

Brief Of Professor Edward A. Zelinsky As Amicus Curiae In Support Of Plaintiff’S Motion For Leave To File Bill Of Complaint, Edward A. Zelinsky

Faculty Amicus Briefs

Professor Edward Zelinsky submitted an amicus brief with the U.S. Supreme Court in New Hampshire’s constitutional challenge against Massachusetts’s recently promulgated regulation imposing its income tax on nonresident remote workers, arguing that the Court should grant New Hampshire’s motion for leave because a state cannot source nonresidents’ income earned beyond the state’s borders; taxpayers have “no practical remedy” for relief from unconstitutional taxation under the Tax Injunction Act; and only the Court can make rulings over the boundaries of state authority.

In the court file, there’s no explanation of why he wasn’t simply let go. Legal experts say judges need to give that explanation.

"You have to explain, if you’re a judge, to the defendant why it is that you’re assessing them money," said former judge and UNM professor Joshua Kastenberg.

Archuleta had a long record, and Kastenberg believes that’s a big factor in the judge setting bail.

"You want judges to be able to exercise their discretion, but without a ruling, we don’t know what this particular judge had in his or her thought processes," he said.

He says the …
